Mas antes eu queria, só que a gente falasse um pouco da Maria da Penha, né, dessa mulher que deu nome a essa lei, porque a história dela ajuda a gente a entender, porque que essa lei precisou existir, né? Então a Maria da Penha era farmacêutica, hoje aposentada, ela tá com 81 anos, Maria da Penha era professora universitária, tinha três filhos, quando sofreu uma tentativa de feminicídio dentro da própria casa, isso ainda em 1983, ela tava dormindo, o Marido deu um tiro nas costas dela, e essa agressão deixou ela para a plédica. Ele alegou que tinha sido uma salto, que a casa tinha sido assaltada, então ela voltou para casa e sofreu uma segunda tentativa de feminicídio, que esse Marido tentou, ele trocutar a Maria da Penha durante o banho. A Maria da Penha já tava tentando sair desse relacionamento, ela tava dizendo que queria se separar, e ele foi lá e tentou matá-la duas vezes. Isso não é um padrão incomum entre agressores, porque muitas vezes é o momento em que uma mulher tá tentando buscar autonomia, tentar romper a relação, que é um dos períodos de maior risco de feminicídio. Vou fazer um parênteses para dizer, bom, olha aí as mulheres entendendo cada vez mais o seu direito, e saindo de relacionamentos, e a epidemia de feminicídios que a gente tá vendo. Então, muitas vezes, a tentativa de matar a parceira é ligada exatamente a esse desejo do agressor de manter o controle de impedir a separação. E aí nesse caso, a Maria da Penha conseguiu se separar, denunciou o Marido, e aí começou uma batalha longguíssima na justiça. O primeiro julgamento só foi acontecer oito anos depois do crime. Aí ele foi condenado, o esmarido foi condenado, mas ele seguiu em liberdade por causa de infinitos recursos. No final, foram quase duas décadas entre o crime e a prisão do esmarido da Maria da Penha, que ficou uns aninhos presos e já saiu. No caso da Maria da Penha, diante dessa demora e da falta de resposta da um missão do Estado, ela levou o caso para a Comissão Interamericana de Direitos Humanos da Organização dos Estados Americanos, a OEA. E aí em 2001, a Comissão responsabilizou o Brasil por negligencia e omissão no combate à violência doméstica. E aí que recomendou que o Brasil adotasse medidas para prevenir, investigar e punir esse tipo de crime. Então foi essa condenação internacional do Estado brasileiro, né? A condenação do Estado brasileiro. Exato. Que acelerou a elaboração dessa legislação. Então em 2006, foi sancionada a Lei Maria da Penha, então pela primeira vez o Brasil passou a tratar a violência doméstica como uma violação de direitos humanos e criou mecanismos específicos para proteger as mulheres em situação de violência, responsabilizar o agressor como a gente está falando, mas também estruturar essa rede de atendimento, né? Então dar a Lei, esse nome Maria da Penha foi uma forma de reconhecer que ela transformou uma história de violência pessoal numa luta coletiva, então o caso dela pudo a história de como a gente fala de violência doméstica. Amigna, semana que vende a 7 de agosto, essa Lei completa 20 anos. E só para deixar bem claro, a Lei Maria da Penha não prevei apenas um boletim de ocorrência. Ela preve toda uma rede de proteção para interromper o ciclo da violência. Com acesso à justiça, e aí estamos falando de defensoria pública, mas também a saúde, atendimento psicológico, assistência social e todas essas outras medidas para que a mulher consiga reconstruir a sua vida. Então a mulher não precisa estar machucada fisicamente para acessar a Lei Maria da Penha. Ela pode ir para delegacia especializada de atendimento a mulher, ela pode pedir medidas proteitivas de urgência, conseguir atendimento pelo SUS, defensoria pública, tudo isso em qualquer um dos tipos das 5 violências que a gente já falou aqui. Você está falando, vai completar 20 anos. E aí é mais uma camada de por que, então, uma das leis mais conhecidas. A pessoa se fala, o nome da lei, as pessoas já ouviram falar, mas ser uma lei tão pouco conhecida no detalhe. E acho que uma das razões é a quantidade de fake news que fazem sobre a Lei Maria da Penha. A quem interessa criar fake news sobre a Lei Maria da Penha? Eu acho que a mãe de todas as fake news sobre a Lei Maria da Penha, a maioria das denúncias são falsas, 90% das denúncias são falsas, são inventadas para prejudicar os homens. Mas a gente fazia uma denúncia falsa, que no código penal é chamado de denunciação caluniosa, que é acusar alguém de um crime. Sabendo que a pessoa inocente é crime. Você pode ser condenado até 8 anos de reclusão por fazer uma denúncia falsa. Então você acha que essa denúncia contra você é falsa, vai lá e denúncia de volta. Então isso é uma das mentiras. Outra coisa que falam muito é que a Lei prende o homem sem provas. E não, você faz uma denúncia e você tem que passar por todo o devido processo legal. As medidas protetivas de urgência, elas são concedidas. Quando a justiça identifica que tem mesmo um risco para vítima e ela é um caráter preventivo para evitar novas agressões. Para você ser realmente preso, aí depende de outros requisitos previstos na Lei que um juíza analise a prisão. Uma coisa é ordem de restrição, outra coisa é prisão. Acho que a outra fake news é essa, de que só vale quando tem agressão física. E a gente explicou que a Lei reconhece cinco formas de violência doméstica, física, psicológica, sexual, patrimonial, moral. Então assim, controlar o seu dinheiro te humilhar constantemente, ameaçar, tesolados amigos. Isso também é uma forma muito conhecida, porque faz você começar a não confiar na opinião dos outros e não ter certeza da sua própria opinião. Tudo isso pode configurar violência doméstica. Vamos! E essa desinformação, ela acaba funcionando como mais uma barreira para quem já enfrenta tantos outros perrengues nessa rota crítica, porque as notícias falsas também são parte da estratégia de dificultar o acesso à lei. Porque o fio que costura tudo isso é esse mesmo. A legislação não é assim, só que se eu não sei como é direito, eu caiu nas feirinhos. Então eu preciso estar bem informada no que tem a lei, para eu não caí em feirinhos. Esse foi um ano que infelizmente a gente falou muito de feminicídio, porque é uma epidemia no Brasil, mas acho que eu queria ressaltar como, por trás de cada feminicídio, tenho uma história de violência que ela pode ser interrompida, inclusive usando a lei Maria da Penha. Então os últimos dados, que eram de 2025, segundo o Forum Brasileiro de Segurança Pública, eram 1563 feminicídios. Mas eu quero lembrar que muita gente não denuncia por medo, porque agressiu a seu vizinho, a seu parente, muita gente denuncia, mas algumas delegacias registram como homicídio. Então com certeza esse número é muito maior, foram quase 1.500 feminicídios, mas foram quase 4.000 tentativas de feminicídio. 95 mil caras. de stocking, quando o cara começa a te perseguir, te perseguir na rua, te perseguir em casa, né? Então, unidades de saúde no Brasil atenderam 270 casos por dia com o característica de residência. Amiga, então, a gente explicou um pouquinho aqui todo o papel do Estado, né, de antes da violência contra a mulher e com a lei da Maria da Penha, mas a gente também falou que é necessário uma rede aí na sociedade civil para acolher essas mulheres. A ideia do mapa do acolhimento é facilitar o acesso à informação, ao acolhimento emocional, e da toda a orientação jurídica para a mulher que precisa de ajuda, para conseguir quebrar esse ciclo de violência. Amiga, eu até perguntei para o pessoal do mapa do acolhimento o que fazer se a gente tem uma amiga num relacionamento abusivo, porque às vezes você percebe, mas ou ela não fala, porque ela tá com vergonha ou porque ela ainda não percebeu, mas você percebeu ou ela fala, mas inicialmente ela não tá querendo ajuda. Então, o que a gente deve fazer? O pessoal do mapa do acolhimento disse que é uma escuta ativa para levar a informação e autonomia. Ou seja, você precisa se mostrar presente, que você tá lá para o que ela precisa, não é dando ordem, não é julgando, não é mandando ela fazer determinadas coisas. Você erra nisso, amiga. Eu erro, amiga, você jogou para mim, porque eu erro. Eu sou amiga que implora para outra embora de casa, apareço de carro na porta de casa, querendo meter os móveis no porta-mala e tirar minha amiga de lá, já fiz isso. E também é desesperador, porque a pessoa tem o tempo dela. Você tem o tempo, você precisa decidir o que você vai fazer, não é fácil. Sai de casa, não é fácil decidir separar do pai dos seus filhos, não é fácil ter a força de que você vai conseguir seguir a vida sozinha e dar conta de pagar todas as contas, porque aquilo que a gente tava falando. Isso é precedido por anos do cara tentando te fazer se sentir mal, te afastando das suas amizades, se não ser seus amigos são mentirosos ou falsos, tão em cima dele, que, na verdade, querem ser o mal. Você tem que reconstruir uma autoestima e uma auto confiança, que é difícil. Eu já senti que, em uma situação assim, o que aconteceu foi que minha amiga parou de me contar, o que tava acontecendo, porque eu ia para cima do tipo "vambora agora, eu vou ir buscar e separa". A postura não é essa, não pode parecer que você tá julgando. É uma postura de apoio aberta a ajudar na decisão que ela for tomar, na hora que ela for tomar, porque isso ela não pode parar de te contar, amiga, ela precisa se sentir segura para dividir e também para denunciar. No fim das contas, ela precisa criar essa confiança e segurança para fazer a denúncia. É que nem terapia, né? Você vai se tocando do que você pensa e do que você quer, enquanto você relata em voz alta. Então, amiga, acho que falar para todo mundo conhecer o mapa do acolhimento, se você é advogado, se você é psicóloga que exerce voluntaria e para lá, para as nossas ouvintes e ouvintes homens, ficarem de olho, se isso tá acontecendo e aquilo, violência doméstica não é um problema de casal, é um problema de saúde pública, é um problema de segurança pública, fiquem de olhos bem abertos e diria também para ficar em de olhos bem abertos porque a eleição tá na porta e esse é um assunto muito importante, a gente tem falado aqui no 2 e tanto em vários momentos como as mulheres vão definir essa eleição e temos que prestar atenção em quem são homens e mulheres candidatos que de verdade se preocupam com violência doméstica e não ficam apresentando essas soluções individuais que não são solução para ninguém, se armar ou não sei o que, não, a gente precisa de uma solução sistêmica, né, como faz o mapa conectando várias serviços para oferecer segurança, garantia, saúde, preservar a vida dessa mulher e fiquem de olho porque também tem candidatas mulheres que não votam a favor do direito das mulheres.
