all right guys welcome in uh welcome in welcome in i hope everybody has had a fine day standing still watching the tv all day uh your humble host did that of course uh we got a lot to talk about we had a preliminary hearing summation today and we got a surprise plea at the end of the day i wasn't expecting that if i'm being honest um but uh no surprise as to the content of the plea go ahead and hit the like button if you uh so you don't forget now i mean just assume you're gonna like the content go ahead and hit the like button um but yeah no we got a surprise plea i was not expecting that i was not expecting that i figured the um the prosecution would um or the defense would request a few days to think everything over but they didn't they just snap not guilty and at first i thought oh that seems like a mistake um but then i started thinking i've never tried a case this public maybe it's an opportunity to steal a few headlines right now everybody's going to be running with uh or you would expect everybody to be running with judge finds probable cause now maybe you'll get a headline or two that says tyler robinson pleads not guilty maybe throw that into the mix i don't i don't really know the strategy for it um they certainly didn't consult your humble host though though i'm gonna be honest there were a few lines today i'm not gonna highlight them because i don't want to call anyone out it's hot in my house so if i'm sweating i apologize um i don't want to uh to call anybody out but there were a few lines today that made me think at least the defense lawyers are watching some podcasts maybe not only your humble host maybe uh candace as well and others i heard a few lines today that i think came directly from shows i've been watching uh and maybe even shows i've conducted i was a little surprised i was a little surprised for being honest we're going to go through the preliminary hearing i have an opening for you uh the number one question i've gotten during this entire preliminary process is why didn't they use a grand jury i thought the u.s constitution required a grand jury so i'm going to answer that question today it's as good a day as it gets it's a day where if you release news it might get buried and i don't want it to get buried candace owens played some pretty devastating footage today i don't want this to get lost in the shuffle uh played today some shocking footage that demonstrates i think two things one is butch hibbs was not there to meet charlie kirk in my opinion my opinion is just an opinion don't sue butch don't sue butch i hate we have to say this every time we speculate i don't think butch hibbs is any longer can be considered there in good faith uh what she played today was so shockingly disgusting um i am frankly beside myself i don't think that's a good thing i don't myself uh i place him down in the uh toilet tier with terrell farnsworth at this point in terms of shockingly disgusting acts in the immediate aftermath of charlie kirks uh being taken down so that's number one is he is now a toilet monger to me he's a he's a sewer dweller in my opinion uh so that's number one but number two well there's really three points of it number two it showed she has a lot of footage stocked away i don't know what else she has but there's no way she's dropping these little drip drips of footage and that's all she has and if she's if you go back and listen to questions she's specifically asking she asked one today who's the guy in the blue shirt and the pink hat she's asked other questions where did blake go in the immediate aftermath she's asked other questions something tells me she's acting a little attorney like that she's asking questions to which she knows the answer um so i want to look at that footage today because for the third point of that footage uh number one she must have a lot of footage number two uh uh butch hibbs is is a a swamp creature in my opinion as a result of this footage the footage is so shocking it shocked my conscience then it's hard to shock my conscience your humble host has seen and been through a lot if i get my conscience shocked something has gone wild wild uh and it did it shocked my conscience uh and then the third point is i noticed and she didn't point this out she only had the circle or the arrow or whatever on butch hibbs but i saw a few other people in this video footage and i want to point them out now i want to ask the question are they acting right were these people acting right in the immediate aftermath we're talking maybe five seconds three seconds five seconds after charlie kirk gets taken down before the body is carried to the suv i want to take a look at this video footage i want to watch it carefully and i want to point particular people out that i recognized in this footage and i want to ask you what the hell are these people doing what the hell are these people doing maybe they're not the same people they're not the same people they're not the same they're not the same people they're not the same people they're not the same people maybe we'll speculate on some other things uh relative to that footage so stay tuned this will be a good one and finally there's a petition out there's a petition to remove erica kirk um as the head of tpsa and i'm very very very concerned with this petition um i have had this really gross feeling in my and it just deepened my soul relative to erica kirk i i i worry i worry about erica kirk as much as i worry about tyler robinson genuinely um and this petition sent a chill down my spine because of who sponsored the petition and what particularly it's asking for and i want to explain why that is uh and and this may be a little sympathetic to erica if i'm being honest today uh the third part of the show today it might be a little sympathetic but i think it's going to be necessary um because i may be i may be trying to figure out who killed charlie kirk how and why i may be concerned about some of the actions and actors in and associated with um turning point usa but at my heart i'm i'm a human and i'm a lover of other humans and i don't want to see anybody harmed and i have just this sick sick feeling that i've pieced something together and i just have to say it out loud because sometimes um the best way to disrupt a plan is just to call it as you see it and i'm sorry i have to call this one out uh i have no notes on this. This is going to be from the top of the head when I get there. I really wanted it to be from the heart. I didn't want to script anything out. I, you know, a lot of times when I cover a story, I'll bullet point out some phrases I want to get out or some turns of phrase or some expressions or the order in which I want to cover it. I don't want to do that for this one. I have one single line on my notes for this whole section. And all it says is petition to remove Erica or something like that. What does it say? Uh, it says Z Cohen's put change petition. That's all it says. And if you are a TP USA adjacent person, you're going to want to hear this. If you are a person who's remotely concerned with, um, violence or, or bad behavior in this case, spiraling out of control and affecting other people, you're going to want to hear this. And if you're one of those people that thinks I just hate Erica Kirk and I despise her and I want bad things to happen to her, you're going to want to hear this as well, because it's not true. It's absolutely not true. And I am so concerned about this petition and I'm going to stack it up with a couple of other unreleased unrelated pieces of news. And I think it puts together a pretty cogent story that, that has me very, very sleepless on this issue. Very, very sleepless on this issue, but I want to get into this stuff. I want to get into this stuff. Where did I put my opening? I want to break into this opening because you know, one of the things we do is here, we, we help each other learn. That's one of the, it's a high IQ outfit. Ladies and gentlemen, I don't just say that. I mean that we are elevating the discussion. We are helping people's lives improve day by day. And part of that is, um, you, you, you get knowledgeable on things that other people just don't know. I call it cocktail party knowledge. Frankly, a lot of this stuff we talk about is cocktail party knowledge. It is helpful. It is helpful, but sometimes, um, at a cocktail party, someone will say, why do we have grand juries? And why does the constitution require it? But, but Tyler Robinson didn't get one. You say, oh, well, let me tell you. And that's what this opening's about. A lot of lawyers, uh, non, a lot of non-lawyers and even lawyers who, who practice in fields other than criminal law, they learn a lot about criminal law from high profile televised court cases. A lot of us felt that way with OJ Simpson and some of the other court cases along the way. We saw how evidence was introduced. We saw how juries are selected. We saw the problems that juries have right now. A lot of people are experiencing that when, uh, the jury came back today in the Lindsay Clancy case and said, we can't reach a verdict. The judge said, I don't care. Get back in there and figure it out. Um, uh, off topic, I will say, if I was the judge, I would not let them hang that jury. I would say, I'm going to lock you up. I'm going to put you away for six months. If you can't come to a jury verdict, somebody we're not doing this trial again, somebody's going to either be innocent or guilty. We're getting this out of the way. I digress. I digress. The Tyler Robinson case is a good example because one of the things about criminal procedure, uh, people are learning in this case is the use of the preliminary hearing instead of the grand jury. So we have to answer the question. What is a grand jury? What, when are they required and why aren't they required for every crime in every state? So we have to go all the way back in history to figure out where grand juries came from the first place. And they came out of English, local inquests. They still have inquests in England. We don't have them here. Um, well, we don't have them in the way they have them there, but this is kind of a common origin story. And it traces this direct ancestor of grand juries, these local inquests all the way back to Henry the second, he gave a pronouncement in 1166 and it required quote, good and lawful, men in each locality to name suspects, to, to rat on their neighbors, robbery, murder, theft, you know, big crimes, big crimes. It was a way to kind of clean up the community. If you had somebody out there stealing from people, uh, group of good and lawful men could get together and say he's a stealer yeah lock him up and at first these groups were sort of tools of the king they weren't paid they were neighbors they were sort of pressed into service and they helped the king identify offenders and they helped collect revenues that flowed from the criminal processes so if there was money recovered from a crime it could be returned back to that that inquest group over the centuries this accusing body became known as the grand inquest a few hundred years later it was still in service and it was actually larger than a trial jury it was 23 men rather than the 12 who would who would determine guilt or innocence it also allowed a majority to return an accusation rather than unanimity so if if seven of the 12 determined somebody was was you know probably guilty of a crime they could they could return that it didn't require the unanimity that a trial jury required and there were two kinds of chargings that sort of came out of this one was called a presentment and the other was an indictment and they were different but they were the same a presentment was something the jurors brought on their own they would investigate they would have knowledge of something they would get together they would put together um the charge or charges and they would present it to the government the other was the indictment and the indictment was a charge the government asked them to improve approve the government come and say this guy's a uh a murderer we want you to indict him and so by the 17th century english lawyers had sort of treated indictment by neighbors as part of the law of the land and law of the land was an important phrase in england because it's associated with the magna carta meaning it came from their foundational document their foundational legal document kind of what like an early runner to sort of like our constitution well when english settlers arrived in north america they brought this institution with them so for example in massachusetts they actually impaneled a grand jury all the way back in 1635 they wouldn't become a state for another hundred and something years 150 plus years virginia held sessions even earlier so colonial governments began requiring these bodies and they began requiring them as a prerequisite in all criminal cases this is before independence this is before 1776 this is before paul revere you know but it was a shield function as much as a a sword function i always i always put things in uh sealed and shield and sword right when you're doing research on somebody you have to decide is this research a shield or a sword meaning am i going to protect myself with this research if somebody comes after me or am i going to attack them with it well that's kind of the way the early grand juries worked grand juries refused to indict people that was a shield that was saying hey that's government overreach this guy's not this guy there's no way he did this crime so there was a an early printer i guess uh his name was john peter zinger and he was being charged with seditious libel and the jury refused to indict him they said no uh in boston they were declined to indict the stamp act protesters and those those episodes taught colonists that a local panel could stall an otherwise unpopular prosecution even when the evidence looked pretty good and it's for that reason among others that people immediately began to notice that the evidence looked pretty good and it's for that the evidence looked pretty good and it's for that reason among others that people immediately began to notice when the constitution of 1787 our united states constitution came out and it did not have a grand jury guarantee so a few years later the bill of rights comes and the fifth amendment included a grand jury requirement for all federal prosecutions that was 1791 the fifth amendment is very explicit i'll read the text of it right here no person shall be held to answer for a capital or otherwise infamous crime unless on a presentment or indictment of a grand jury but that kind of said big crimes infamous crimes capital crimes we've sort of read in over the years that infamous crime means felonies felonies are generally considered offenses punishable by more than a year in prison federal misdemeanors can still be charged by information prosecution just files a request hands it to the judge the judge signs off on it the defendant can waive the indictment for a non-capital felony but the default is that the defendant can waive the indictment for a non-capital felony but the defendant can waive the indictment for a non-capital felony but the the defendant can waive the indictment for a non-capital felony but the the default in federal felony prosecution is a grand jury so the founders put that gate out in front of federal power and they did it for a reason they feared this distant national prosecutor sitting at the nation's capital reaching out into the local community and overrunning some community that got sideways with all you didn't vote for me we're going to arrest everybody so the panel of ordinary citizens drawn from that community was supposed to kind of stand between the powerful federal government and the little bitty accused farmer in west virginia and the little bitty accused farmer in west virginia somewhere courts still describe this federal grand jury process as a sword and a shield again as a sword it investigates it can subpoena witnesses it can sit in secret it can get records it can ask questions and it can develop evidence in quiet before anyone's arrested but as a shield it has to find probable cause before the united states government can put a person on trial at least for felony the supreme court has said the grand jury belongs to no branch of the institutional government meaning the judicial branch the judge summons a grand jury the prosecutor presents evidence but neither owns the decision it's the people themselves sitting on the grand jury 12 people have to return an indictment and the grand jury can range from 16 to 23 people so it can be just over a majority 12 of 23 or it can be 12 of 16 you know three quarters and this practice though the shield and sword the shield is rarely used it's almost always a sword proceedings are one-sided they um they target someone who has no right to show up cross-examine hearsays allowed and historically federal grand juries have returned true bills in almost every case but before them very very seldom do they decline to find probable cause in fact it happens so often people call it a rubber stamp but the constitutional design remains the federal government can't start a felony trial at a prosecutor's whim they can't do it by signature alone so federal courts still require these grand juries for felonies the claw the clause is written too clearly for any court to interpret it away and both prosecution agencies and defense interests have all come together and begged the federal government to do away with grand juries and they can't do it the the constitution is too clear you'd have to amend the constitution so the original 10 amendments we call the bill of right here i know not all of you are american watching but in the united states we have 10 amendments the original 10 amendments the united states constitution is originally supposed to be 12 the first two didn't get ratified but the 10 that got ratified we call the bill of rights and they originally only applied to the federal government states were sort of immune from the federal constitution but after the 14th amendment was adopted and it was adopted right after the civil war the supreme court began applying the due process clause that's contained in the 14th amendment down to all the criminal procedure guarantees and they were they were applying it to the states but they did didn't do it with the grand jury clause probably because people didn't like grand juries by and large people don't like grand juries neither prosecutors nor defense really like them uh in hurtado versus california this is a supreme court decision back in 1884 and it's still good law all the way back in 1884 california charged this guy named hurtado and they charged him with murder by information meaning the prosecutor just signed a a note and the judge the judge sort of called a trial and they they convicted him and they sentenced him to death and he argued that due process required a grand jury indictment the supreme court took up the case and disagreed it was a 7-1 decision the court said due process demands a fair method for bringing a person to trial but it doesn't require a grand jury it doesn't require i think the words they use were the particular english form so a magistrate's hearing with counsel and cross-examination can satisfy uh there have been a lot of cases challenging this and the supreme court every time upholds this original 1884 ruling the grand jury right is one of the very few bill of rights protections that have never been incorporated against the states so you end up with this patchwork you have this patchwork of different processes you've got all these different procedures over all the 50 states and all the other jurisdictions the united states about half the states require a grand jury indictment for at least serious felonies uh some states make the grand jury optional connecticut and pennsylvania have abolished grand jury for ordinary ordinary criminal cases but states that retain grand juries often use different sizes maybe they have a different term or they have a different voting system that that differs from the federal system that that the constitution sort of requires so the courts have said the constitution requires it just doesn't dictate the constitution doesn't dictate how a state charges a felony it just doesn't that's why a person can be tried for murder in one state after a you know a secret citizen vote and in another state you're going to have a public hearing before a judge like we've wrapped up today in the tyler robinson case but these are three criminal legal procedures but they all answer the same question is there probable cause to hold someone for trial against their will it just accomplishes that goal by different routes a grand jury indictment is a formal accusation it's returned by citizens it's secret it's non-adversarial prosecutor gets to choose all the evidence The defendant typically is not there. If you get enough jurors, that vote a true bill, the indictment becomes the charging document. And in a lot of systems, it replaces the need for any type of preliminary hearing. I guess on the corollary, a no bill sort of stops that path. It's not jeopardy. It doesn't trigger double jeopardy. The state could bring another grand jury and try to prosecute them in a different venue or for different crimes. But grand juries investigate, man. They issue subpoenas. They sit for months. They often hear a lot of cases, not just one. So that's sort of grand juries. Informations are different. The information is my least favorite of all these. This is just a charging document signed by a prosecutor rather than a grand jury. In federal court, it's how you normally do misdemeanors. But in a lot of states, it's the ordinary method even for felonies. And some states don't even really require a judge to have much of a finding at all. Maybe just sort of sign off that they think it meets probable cause. So legally, an information and an indictment serve the same function in that they tell the judge, they tell the defendant the charge, and they authorize the case to move forward. But the difference is who screened the accusation. Was it a panel of their peers? Was it members of the community? Or was it just a single prosecutor and maybe a judge signing off on it? And then you have the third, which is what we saw here with Tyler Robinson. Not a grand jury, not an information, but you have a preliminary hearing. A preliminary hearing happens in open court. It's an adversarial process. It takes place before a magistrate, sometimes a judge sitting as the magistrate. The defendant is there. He's present. He has a right to be there. He has a right to have an attorney present with him. They can cross-examine the state's witnesses and even in some limited circumstances can call its own witnesses and present its own evidence. Not every instance, but some. Evidence rules are pretty relaxed. You don't necessarily have to comply with the criminal rules of evidence that the state has adopted. But the hearing is still somewhat of a contest. It's not a lecture. It's not just the prosecution rattling off a bunch of facts and the judge determining whether or not that's enough. No, the defense gets to participate. They get to actively participate. They get to file motions. They get to be heard. But if the judge finds probable cause, the prosecutor still files an information. The complaint can be dismissed, but again, it's rare. It almost never happens. It's like a grand jury in the sense that it's almost a rubber stamp. The hearing also creates a transcript. This is a big advantage in preliminary hearings in that we have a public transcript. Grand juries often don't have, public transcripts. Some limited circumstances, you can invade the grand jury and grab that transcript, but very limited, very limited. I've actually tried to do that in the past and failed. And the public hearing and the public transcript sort of locks people into their testimony. So we heard from Lance Twiggs, for example. He wasn't cross-examined, but he is locked into a story. His story cannot change at trial without being impeached. The police officers, Bagley and Hull and all the other ones, they are locked. They are locked into that testimony. And I will tell you, I don't think their testimony was precisely accurate. And that's going to cause a real headache at trial because the defense is now going to be able to impeach them with their own words. But this early testing is exactly what a grand jury and an information denies. That's why prosecutors often prefer a grand jury if you have a vulnerable witness or if you have particularly intense public scrutiny or if they just don't want to preview their case. Defendants usually prefer preliminary hearings. Preliminary hearings for exactly the opposite reason. You have a participatory role. But what all three of these mechanisms have in common, whether it's a grand jury, an information, or a preliminary hearing, they're only required to meet a very low standard. They're determining whether the government has probable cause to move to trial. They're not looking for proof beyond a reasonable doubt. None of them decides guilt or innocence. They differ only in things like publicity or the right for the defense to participate, perhaps the investigative power, and even who holds the ultimate pen to decide the answer about whether the defendant has to go to trial. And so federal felonies, yes, Constitution requires a grand jury. Some states also require a grand jury. But American law sort of treats it as an inheritance, as a template, but it's not a universal requirement, which is why we got what we got in Utah. We got a preliminary hearing. Which a lot of people are not accustomed to. So I hope that helps you sort of understand the difference, understand what you saw July 6th through 10th at the preliminary hearing, what you saw in the different motions where the, or excuse me, the different pleadings, where the prosecution and the defense were both sort of offering a summation, and then today's oral summation, and ultimately the judge's ruling. You got to see a preliminary hearing at work. And it was pretty instructive. Like I said, a lot of people learn, criminal law. Unfortunately, a lot of people learn criminal law from CSI Miami and NYPD Blue or whatever the famous cop shows are now. I don't watch TV anymore, so I have no idea what the famous TV shows are these days. I'm thinking 90s TV. A lot of people learn criminal law from that. That's why everybody in America, even like a seven-year-old can repeat, you got, you know, they'll play cops and robbers in the backyard. And they're like, you have a right to remain silent. I'm like, how do you know that? How do you know that you have a right to remain silent under the Fifth and Sixth Amendment? How do you know that? You don't know that. But they do because they've seen it on TV. You have a right to remain silent. You have a right to an attorney. If you can't afford one, one will be appointed for you. So forth and so on. This is where a lot of people learn criminal procedure. But if you want to take it up a notch, you can observe some of these televised court appearances on court TV or your humble hosts show or Trigger Smart had a good one today. He had Nissi and Cassia. And Nate on that was a good program. Zach Costello covered it. Coach covered it for a little while. There was a lot of good coverage today of the, I think Basie was a dank. Danks was covering it for a little while. So everybody had sort of a, their own spin on what was going on today. What I do, what I want to do is sort of summarize a little bit. I want to summarize a little bit of what we saw because it's, it's interesting. It's interesting. First thing I want to show you is, I want to show you a little bit of what we saw because it's, it's interesting. It's interesting. First thing I want to show you is, first thing I want to show you is who showed up early. Now you remember, you remember at the preliminary hearing, Erica Kirk brought a bunch of people. The way this works is the defense gets a few people and the, the victim gets a few people. Sometimes it's like 10, sometimes it's 12, sometimes it's 15. I'm not sure how they decide the number of people. I don't really care, but today apparently each side was able to bring 12. I don't know if they brought all 12 people, but among the people showing up today was a newbie. We have a newbie on, the loose this from diligent Denison. He captured this this morning while he was there. Check out this. You have Andrew Colvette there. There's Taylor Hansen, I think in the background, if I recognize him, I think that's him. But you have Andrew Colvette here walking in. He's carrying a bag. Notice his suit fits. This is different from the Andrew Colvette. We saw in it in Athens, Georgia when he interviewed vice president Vance at the last second, he's wearing a suit. It actually fits his shirt looks appropriate. It fits his neck. This looks like he intended to be there today. Unlike what we saw in Athens. So Andrew Colvette shows up. Look, it's Tracy Martin. No Botox there girl for four different facelifts, I think, but no Botox, no Botox. You don't believe me. Just look at her Instagram. She'll tell you there's no Botox. So they roll in early. But so we had a different mix of people. We had a different mix of people today than we've seen in the past. Gone are the influencers. Nobody likes Johnson. No, he's not there today. I told you the outcome weeks ago. They were going to bind it over trial. There's no, no shock to me here. So we had a different mix of people show up today. 365 podcast so he was there um andrew colvette the pr person for tpsa stacy sheridan because why would you go to a court hearing without your fundraiser everybody's there everybody's there now we got an interesting tidbit today i wondered if the state was going to address this because of how misrepresented they were by all of the fed sloppers all of the fed sloppers ran after the filing see candy colt baron conman callman these guys are telling you that that he didn't send those text messages and there they are admitting they're his text messages there is the defense admitting tyler robinson fired the fatal round they're only arguing about the aggravating factors well not exactly not exactly ladies and gentlemen because we did hear from the defense today i was hoping we would and we did and we did here is a little preview of what the defense had to say about the allegations evidence of course um these are not concessions of facts this is the evidence that's before the court we do understand we're in a probable cause hearing we understand what the standard is we understand the law um we're all on the same page about that there well not all of us because if you are blake neff or gary melton or andrew colvette or any one of the other fed sloppers you ran crazy over the last week or so or month or so where you couldn't post enough that the defense doesn't challenge any of these facts they're admitting he did it well no they're not they're these are not concessions they should have put that in their brief they should have put it in their brief there was a huge error they could have easily put it in their brief and it would have avoided all the headlines and all the social media and all the media chatter but there it is right there clean and clear they are not conceding any facts the defense is not conceding any facts the defense is merely arguing the evidence as presented by the prosecution so therefore ladies and gentlemen you are free to disregard anything the rest of those people say they're liars we told you the truth they lied to you so i will give you a jury instruction if you find a witness has been less than forthcoming i'll give you a jury instruction on any relevant fact to this case you are free to disregard everything that witness has said there you go ladies and gentlemen that's it you're free to disregard everything they said because they knew that that was the case and they went with it anyway and i do want to address briefly um the error that i made in the briefing about uh crystal ball and uh not citing the additional law that came after it i'm playing this for a particular reason if you make a mistake you own it you don't ignore it you don't paper over it you don't act like you were really right she just admitted it you know then i'll tell you what this was there was a a p if you watch this show after the last prosecution filing i don't know a couple of weeks ago i pointed out that uh-oh i think i agree with the prosecution i did a little tiny bit of research i'm not a utah lawyer i don't know all utah law top to bottom but i did a little bit of research i did a little research and i thought oh i think the prosecution's right here i think the defense has misrepresented the law relative to speculation and inference i i tended to agree with the prosecution there and i said as much because i'm an honest actor and i will tell you the truth as i see it well i wondered if the defense was ever going to address this and they did they addressed it right here she said i want to own up to the mistake i made in other words i included that line i put that section in our brief and it was wrong and she's owning up to it i do want to provide a little context to the court about that uh case in particular that is cited by other cases it's really just that one sentence that was overruled and i absolutely should have put that into the brief and i apologize to the court for that mistake that's how you do it ladies and gentlemen that's how you do it um guess what people make mistakes we don't judge people by their own up to it make amends confess i did it i'm sorry it happened in this situation it was a very public mistake so you have to apologize very publicly um if it had been a private mistake if this was an off the record conversation between the prosecution and the defense and she had misrepresented some action law which frankly i think is inappropriate also um i think she would have owed the apology only to the prosecution she wouldn't have had to state it publicly on the record but they screwed up they screwed up people screw up it happens uh case law is complex it's hard it's it's not as easy as you know uh looking up a dictionary definition of a word so if you are going to find the law that you have represented is actually not true just tell the judge hey i screwed up i made a huge mistake judge i shouldn't have done that and i'll give you a point when i'm wrong i say i'm wrong that's from dirty dancing that's from dirty dancing now we've got an interesting new fact that we got an interesting new fact you're gonna love this you're gonna love this um i actually i want to show you something i want to show you something uh i think this is the better way to demonstrate it there's something called the fosbury flop it was invented as a means of high jumping uh-oh i screwed up what did i do there we go oh where'd i go oh here we go the fosbury flop all right this was a high jump technique invented in the oh i'm gonna have to silence actually you know what let me let me find one that's not from hey here we go this would be perfect so in 1968 prior to 1968 in the olympics if you went in to do the high jump you jumped over like this and you're like oh i'm gonna have to do the high jump like a hurdle like you you jumped over like a hurdle and it was to see basically who could hurdle the highest there's a guy named bob fosbury and he invented a way to get over the high jump by simply flopping over it this is a may it's amazing feat we we see it now and we recognize it but this is the introduction of the fosbury flop i'll speed it up a little bit here we don't need to watch a minute and a half of this oh i missed it there we go watch watch him run here and this is important this is very important to what we're going to study today so here he runs and watch he flops that's a fosbury flop you run facing the obstacle you contort your body around the obstacle and you flop over it backwards and you land on your back why am i talking about the fosbury flop well ladies and gentlemen you'll never guess how the alleged assassin was believed to have gotten over the gate with a gun in his pants by the way by the way with a gun in his pants check this out the fosbury flop ladies and gentlemen through that tunnel and then going up the stairs we know that he then made his way and he's recorded on camera making his way up to the low c center roof where he comes to the railing does a fosbury flop over the railing and is out of the camera does anyone believe that's how he got over the railing a fosbury flop you're telling me he ran at full speed turned his back to the railing jumped over it backwards with his hind end and his back over the railing and landed on his back on the other side no come on stop it i refuse to believe it sir you're not telling the truth notice something here notice his his screen in front of him see this screen in front of him here look at that incredibly high quality trigger smart noticed this today when i was watching his show earlier incredibly high quality now this might actually be 4k incredibly high quality footage but watch as he discusses the flop shirt long pants to obscure the rifle he had concealed down his pants um and he made his way through campus the same route of ingress into campus that he had taken during his second scouting mission coming through the north parking lot so notice he's showing him everything he's describing he's putting on camera for those in the courtroom he's talking about him entering campus during his ingress phase he ingresses on the campus we've got a picture of him coming on the campus he talks about him walking through the parking garage we get a video of him walking or a picture a still frame of the video of him walking through the parking garage just keep watching making his way through that tunnel and then now we see him in the stairwell we have an image on his screen of him in the stairwell going up the stairs we know that he now we lose the camera footage my man i want to see the fosbury flop i want to see the flop you you promised me a flop old man I want to see him flop. No, I'm raising an important point. It's not about the flop. The important point I'm raising is they are not showing the footage of him getting onto the roof, getting over the railing, and assembling the gun. Now, we're promised it exists. We're promised it exists. But watch. And made his way, and he's recorded on camera. Recorded on camera. Well, why can't I see this recorded on camera event develop? Way up to the low-sea center. He's on the low-sea center roof. Why do I not have an image of him walking up the stairs to the low-sea center roof? Is it the same guy? In other words, I'm supposed to believe that this guy that I was watching walk through this parking lot is the same guy on the roof, but you're unwilling to show me footage or images of him getting into position, getting up there on the roof? We just lose him from camera? The roof where he comes to the railing, does a Fosbury flop over the railing. I'm holding him to that. I'm holding him to the Fosbury flop. You remember when the defense screwed up and they cited the wrong case law, or they said some case law was controlling and it actually wasn't. She came in and said, hey, I promised you that that was correct. I misrepresented the law to the court, and I apologize. Here's the limited circumstance in which I will accept that I was wrong. Everything else I stick with, standby. Is this goofy fella here? Is he going to stand up and say, well, it wasn't really a Fosbury flop? I said that for exaggeration. Or are we going to see a Fosbury flop? I doubt it. I doubt it. He's an acrobat. Not only can he jump off of 16-foot buildings without getting injured, that squirmy little guy that you see, in all those images, Tyler, is apparently a hell of an athlete. I don't know. I mean, I know he got an academic scholarship to Utah State. I don't know why he didn't get an athletic scholarship. Fosbury flopping over here, leaping off of tall buildings over there. He sounds amazing. He sounds amazing. Now, there was an interesting exchange about the gun. The defense, I mean, the prosecution made a lot of representations about things that were not borne out by the evidence. Here's an example of that. Relative to the gun, listen to the defense complaining about the prosecution's presentation of the evidence. The state didn't show, actually, how that would happen with the screwdriver. The rifle wasn't even here. This is just speculation. But on top of that speculation, the state is also asking the court to speculate that with this configuration of gun, that would impact the reliability of the shot, the accuracy of the shot, and then speculate that this individual, the shooter, knew about that. These are not inferences. This is speculation. This is a prime example of speculation. I don't know if you could hear that. It was only coming out of one of my ears. So, in short, what she's saying is they're making all these representations about the gun that they've not proven. They didn't even put it in evidence. It's not even that they have to prove it. They have to at least put some kind of evidence on. You have to, you know, it's a low bar, but it is a bar. You know, it's not like you could just walk in and start saying stuff, but that's what they did. In a lot of instances, that's just what they did. They assumed that this screwdriver played some kind of a role, but they put no evidence on. Did we ever see the screwdriver? Are we to believe that the screwdriver was the type of screwdriver that would work the screws or bolts of the gun? I saw no evidence of that. Were we shown how the gun is taken apart using one of these screwdrivers, and is this screwdriver sufficient to even accomplish that objective? I saw no evidence about that. We're just supposed to believe them. Hey, there was a screwdriver. He must have used it to assemble the gun. I'm not sure. That's a real story. That's a reasonable inference. I'm not to believe that is a reasonable inference. Then they go on to presume as a matter of fact that the gun is actually in his pocket or in his pants. Now, I'm going to show you something here because I don't think this is the case. I notice this is also just coming out of one ear, so if this is hard to hear, I apologize. Hopefully, this goes out well. But I would never play it without putting it on the screen. Come on. What do you think I am? Some kind of amateur? That would never happen. Just because the sound isn't good doesn't mean I would hide it from you. Come on. Let me start it from the beginning where I was intending to start it. And there's a note on the slides before those exhibits. Thank you. The defendant then returned at 1154 a.m. this time dressed to kill. Black shirt, long pants to obscure the rifle he had concealed down his pants. And he made his way through campus the same route of ingress into campus that he had taken during his second scouting mission. Coming through the north parking lot, making his way. Dressed to kill, ladies and gentlemen. Dressed to kill with a gun down his pants. That's what we're told. He was dressed to kill and had a gun down his pants. I want to show you just a little. Steve Cameron on Twitter put this. It's a nice little slow-mo of this guy who's dressed to kill entering campus with a gun down his pants. Find the gun. Everybody look for the gun. All right. Now, it can't be in his left leg because his left leg just bent. Now, he was limping because of this supposed gun. But it can't be in his left leg. His left leg just bent. So let's check out the right leg. Nope. Can't be in his right leg either. Look how bent that right leg gets. Look at that. Where is the gun? Show me the gun. Show me the gun. Show me the gun. I see a cell phone right here. We all agree that's a cell phone. Where's the gun? So they just presume things that they're not going to be able to get away with a trial. A jury, as the state actually noticed, noted today, the jury is not required to check their common sense at the door. They are more than welcome to draw common sense conclusions from everything they see. If they look at this image and they say, well, that doesn't look like he has a gun in his pants, then they don't have to believe there's a gun. They don't have to believe there's a gun in his pants. What if the state puts on a witness that says there's a gun in his pants and the defense does not counter with a witness of their own? They can say, I don't believe the state. That doesn't look like a gun. I find that less than credible testimony. I'm afraid to disregard it. They don't have to believe it. Now, I want to show you something that is getting a lot of confusion. There's a lot of confusion about what happened here. I want to take my shot. I want to take my shot at clarifying this confusion. I'll admit this was not the defense's finest moment. But you have to put it in the context of everything that's taken place in this hearing. The defense basically agreed with the state that Charlie Kirk was the kind of guy that said hateful things or that at least make people hate him. Now, obviously, people are running with that. They're saying, oh, this defense is trashing Charlie. I hate the defense. I'm not exactly sure. Let me play. Let me play this. And then let's talk about what's actually being said. And let's put it in the context of the case here. There is no evidence of Mr. Robinson having heard or seen anything specific from Mr. Kirk or having expressed anything about Mr. Kirk until the statement, which basically says some hatred can't be negotiated. So he's commenting on the. Evidence. He said there's no evidence that this that that Tyler Robinson knew of anything Charlie Kirk said. And that's true. Do you recall during those five days of preliminary hearing any evidence put forward whatsoever about specific statements that Tyler Robinson heard and acted upon anything at all? No, no. There was that one line in the pre confession letter, the confession letter. That took place before where he said some hate can't be reasoned out or can't be argued with or something like that. But that's it. That's the only reference to any kind of hate. And there was no specific statement that the state offered as evidence. Of course, the defense is not going to offer it. So he's putting this in the context of the evidence as presented in the court. So I'm going to let him continue to play. I want you to hear his words, but I want to put his words in that context, that context right there. We're talking about the evidence. The evidence the state put on during the preliminary hearing from July 6th to July 10th. So what is it? Is it political expression? Which political expression? It is. True that Mr. Kirk spoke hatefully. Of certain groups of people. He spoke hatefully. Of people who don't have traditional. Norm-conforming gender identities. Now, do you remember evidence of that? I don't. I don't. And again, we're supposed to use the evidence to make our arguments. So the state is bound by their evidence. They showed no evidence of the screwdriver, for example, other than that a screwdriver exists. They showed no evidence of a firearm in his pants other than a firearm exists. And they believe it got on the street. on the roof somehow. It must have been in his pants. That had to be why he was limping. There was no evidence of that. And we're right to be critical of them when they raise those particular issues. But I think likewise, we're right to be critical of the defense when they say, you know, of all the evidence the state presented, they didn't present a particular statement of hate that Tyler Robinson appreciated and acted upon. Now, reading this in the light most favorable to the state, or not really the parties, to Charlie Kirk fans, what the defense lawyer just said here is pretty bad. Because he's saying, yeah, it's true, Charlie said all these hateful things. But if you read it in the light most favorable to that guy speaking, what he's saying is, hey, they're saying he acted on this stuff and these statements of Charlie Kirk. And they're saying that Tyler Robinson interpreted those as hateful things. Some hate can't be reasoned out. Therefore, we know that Charlie Kirk spoke on these issues. And the defense, the defendant, Tyler Robinson, must have interpreted those things as hate. So, yes, it's true that we know there were all of these statements Charlie made. We know Tyler Robinson interpreted those as hate. So, yes, this hate could have been things like on traditional marriage values or homosexuality or all these other things. But what a clumsy way, sir, to say that. What a clumsy, clumsy way to say that. He spoke hatefully of people who are not strictly heterosexual. He spoke hatefully of people who. Now, what is strictly heterosexual? That's a phrase I've not come across in my 47 years, 46 and a half years on this planet. I've never come across the phrase strictly heterosexual. That's kind of like being strictly pregnant. You either are, sir, or you are not. You either are or you are not. have sexual relationships out of marriage. And, yes, it is true that the evidence from Mr. Twiggs is that he identified in a non-gender conforming way to his friends and that he was in a romantic relationship with Mr. Robinson. But that doesn't mean that those personal choices by Mr. Twiggs and by Mr. Robinson, equate with the hate that at least Mr. Robinson says he had toward Mr. Perk. So we don't know what that is. Again, very, very clumsy presentation. I'm giving him the benefit of the doubt. Clumsy presentation. If I read it any other way, kind of a horrible thing to say about a man who just died. I mean, if we're being honest, right? You don't speak ill of the dead. Kind of a horrible thing to say about somebody who just died. So not exactly the defense's finest moment. I think, you know, if that had been me and I thought about it, instead of saying, yeah, he said all these hateful things, I think I would have said, look, they're saying that Tyler did not like Charlie Kirk and that he interpreted Charlie Kirk's statements as hateful. Well, these are the types of things he spoke on that might impact Tyler Robinson. He spoke on Trump. He spoke on traditional marriage. He spoke on sex outside of marriage. He spoke on homosexuality and different issues. It's possible that Tyler Robinson interpreted some of that as hateful. But they didn't give us a particular statement that he was responding to. And they didn't tell us anything in particular that Tyler Robinson said that he interpreted as hateful. He just said some hate can't be negotiated out. I'll keep in mind, though, that, like, I hate. Chicken. I don't like chicken at all. I'll eat Mrs. Coleman's chicken if she flavors it in a way that I can't taste the chicken. If it's just a grilled chicken breast, I'll starve to death. No, thank you. I would rather not. Maybe that's the hate he's talking about. Some hate can't be negotiated out. He's an anti-chick-ite. Ah, well, you know, we know he ate a Chick-fil-A. That's the last place he ate. He must love chicken. He might not like me very much for saying I don't like chicken. He might consider me an anti-chick-ite. But is that an aggravating factor? No. I mean, no. So I think the defense lawyer was on to something here. If you're going to say that you're going to use this political or religious expression as some sort of aggravating factor, then you need to point to a particular religious or political slogan that Tyler Robinson took issue with. Not just generic hate. Because hate could be anything. He could hate video game players. Well, that's not an aggravating factor. Not an aggravating factor. So anyway, just something I noticed, not the state's finest moment, not the state's finest moment. Now, this was an interesting discussion, and not because I think it impacts the preliminary hearing. I heard what he was saying. But again, preliminary hearing, all inferences must be drawn in favor of the state. This is going to be interesting for trial. Again, keep in mind, we've now locked in our witness statements. The witness statement here is about DNA. DNA. It's a very boring, dry subject, but this was actually kind of exciting. DNA and whether or not you can attribute that DNA to Tyler Robinson. We stay with fact all the time. Oh, the DNA's on the roof. The DNA's on the gun. The DNA's on the screwdriver. Well, I mean, is it? The state is overreading the DNA evidence in this case when it asserts to the court that Mr. Robinson's DNA was found all over the weapon. What mis. Oliver and Ms. Baker said was that it was a Mr. Robinson was a possible contributor to the DNA, not that he was a contributor. So, that's interesting to me. That's interesting. Possible contributor versus probable versus was a contributor. It'll be interesting to see how a jury contends with that. Now, I've tried cases involving. Complex scientific findings. I've mentioned this before. I've tried a lot of cases that had a HIV testing component. HIV testing is very complex. What the HIV test claim and what popular culture believes they claim are very different. Very, very different. I don't want to go into it here, but most people think if you go in and get an HIV test, it's going to tell you yay or nay if you have it. That's not at all what they claim. They create a presumption that. That a condition exists, but that presumption must be confirmed by a doctor who finds corroborative clinical symptoms. No corroborating clinical symptoms, no HIV, despite the HIV test saying, yeah, it looks like you might have it. Most people don't know that. And so, you go into a jury trial and try to explain that, and they're like, no, he took a test. That test said he's positive. They're like, yeah, but that's not what the test says. They're like, I don't care. Did he take a test? Yeah, he took a test? Okay, then he's positive. And that's. Yeah, and you put up on a screen in front of them, you say, but the test itself says that's not true. And they're like, I don't care. I know what it says. And I think a lot of people are going to treat a DNA test that way. Because the state took the DNA test that way. And I think the judge interpreted the DNA test that way. We don't care about your limitations. We understand people just have to say stuff, you know, because we have to disclaim everything these days. But that's not at all what the DNA test itself says. If you go listen to the testimony again, the DNA, Ms. Oliver's DNA testimony, she basically said, I mean, it might be him. It might be him. So the state might be reaching a little bit on that issue. Now, let me find what page is this? Page 13. Line three. There was a little discussion today. There was a little discussion today of whether Tyler Robinson was a decent shot. And I thought both the, I thought the state actually undermined their own case with a little misinformation. I'm going to go back to their filing. One of the reasons they said that this should be a aggravated murder is because Tyler Robinson necessarily put other people's lives at risk. And the reason he put other people's lives. At risk is he was a pretty lousy shot. I think today they said out of the 28 or so shots that were taken at these targets, only four actually hit the target. That's like a one in seven. That's not very good. One in seven is not very good, but I'll say this. If you're zeroing a rifle, you have no idea what those shots mean. Now, if the rifle was zeroed and he's one in seven, then the, I think it's probably likely that you, he would not be able to hit. Charlie Kirk on the first shot with all that pressure and adrenaline and everything. Um, but we don't know. I mean, when you're, when you're zeroing a rifle, you're going to miss the target a little bit. So, but I want to, I want to go to this here real quickly because they said the evidence also demonstrates the defendant was not certain to hit only his target. Then it loaded his rifle with four cartridges, creating a reasonable inference that he had anticipated his first shot might miss. Moreover, evidence of defendants target practice before the shooting shows. he did not always hit the bullseye. Indeed, some of his shots completely missed the paper target. Yeah, we noticed. We noticed. That's the first thing I noticed when they put that evidence up. Holy mackerel, this guy can't shoot. Even if defendant had previously calibrated his rifle in scope, he had disassembled the rifle to transport it to the roof undetected, then reassembled it on the rooftop using his screwdriver he left there. Again, there's no evidence of this. There was no evidence presented that this happened. None. But they state it as fact, and other people in the media state it as fact. And I'm a little weirded out by that. But nevertheless, they say one reasonable inference from the—oh, missed it. One reasonable inference from the—oh, gosh. Anyway, they say one reasonable inference is he was a lousy shot and he might have injured someone else. I think that's an interesting tactic from the state. Yeah. Yes, we're confident this was Tyler Robinson. Nailed him on the first shot. Also, he's a terrible shot. He's a horrible shot. What's the bottom line? There were very few fireworks today. I predicted there would be none. He bound over all seven charges. I predicted that. I don't know why he would not. Again, the preliminary stage is a very low burden. Very, very low burden. So all seven counts get bound. What does that mean? They're going to go to trial. Or at least it's going to be scheduled for trial. He could still plea out. But they're going to be scheduled for trial. You got a little taste today afterwards at the very end. And I didn't make notes on this because this is when I was getting ready for the show. Actually, I was taking a shower. I was listening with an earpiece. But we got a little taste of how this might go because there are so many lawyers. This is such a high-profile case, and there are so many people not wanting to make a mistake. That they were just trying to schedule the pre-trial conference. And pre-trial conference is just a place where they're going to set out some sort of a timeline on discovery. Maybe when motions are due, we'll set a tentative trial date. We'll get all that stuff out of the way. Trial dates often get kicked. That's not necessarily saying if they set a trial date, it's going to trial. What the trial date does is allow the judge to sort of back-order motion due dates. Pretty standard. It's also pretty standard. It's standard that after you set it, it gets kicked because motions dates get missed. Discovery dates get missed. We end up with disputes. We have to set a date to settle that dispute, and that pushes the trial date back. But we got a little taste of it because for some reason, the victim representative gets up there. The lawyer for the victim representative gets up there and like, I demand you schedule this in two weeks. And the judge is like, yeah, yeah, buzz off. You can almost hear him like, stop, stop talking. Like you do a five-year-old. Hey, hey, hey. And then you started hearing the actual lawyers talk, not the people playing lawyer in Utah. The actual Utah lawyers, you started hearing them talk, the state's lawyers and the defense lawyers. And they're like, well, one guy was like, I'm not going to be here for the next 16 days. I can't participate in any of this discussion. So please don't set it in the next 16 days because I will not have had an opportunity to discuss it. Well, then the state's like, yeah, that's fine. We'll kick it off. How about 30 days? Yeah, great. So then he looks out the first date. He had available. And I didn't see how this ended because by that time, it was time to start the show. But the first date I could see he had available was like late October. This is for the pretrial. This is the first conference. This is before you have a trial date. This is before you have motion due dates and discovery due dates. It was late October. Guys, it's September 1st. You're looking six or seven weeks. If that's the date they end up settling on. And that's a date that may not hold. Keep that in mind. You got a lot of lawyers involved here. Three or four for the state. I think three for the defense, maybe four for the defense. So it'll be interesting. Yeah. Daisy says here, October 23rd, 1 p.m. Mountain time. That's 2 p.m. God's time. 2 p.m. God's time. You'll have our first pretrial hearing. Now, again, the major change. Today, something I didn't expect was the plea. I figured he'd plead not guilty. I mean, stupid to go in there and plead guilty. Especially with a death penalty on the table. Not ideal. Not ideal. But you figure he's going to plead not guilty. But he did plead not guilty today. The judge asked him if he was ready to enter a plea. They were like, yeah, sure. And looking back, I think that might have been the right thing to do. You might be able to steal a headline or two. Instead of. Judge finds probable cause. It could be defendant. Please not guilty, which is a better headline. Better headline. What happens between this pretrial hearing and now? Nothing. Not much. Not much. I mean, people are free to file whatever they want. You'll probably start to see discovery filings pretty quickly. Maybe as soon as this. What's today? Tuesday. Maybe as soon as this week. Maybe next week. You'll probably see some discovery filings. They may have already. I mean. 740 Mountain Time. They may have already fired one off. I assume they knew it was going to get bound over for trial. They probably already have some motions drafted. I would be shocked if we went a week and a half without one. Because now we have a right to discovery. Before the defense could ask. And they just sort of was at the mercy of the prosecution. Whether the prosecution wanted to play nice or not. But now they have to turn it over. We know we're going to trial. So I think the defense probably will file off at least a motion or two. On some specific discovery requests. And we'll see how. The prosecution responds. Maybe they respond. Maybe the judge sets a hearing. Maybe the judge is just ruling. I don't know. But we'll have to sit back and sort of wait. And see how they intend to proceed between now and October 23rd. I will say this. If there's a filing between now and October 23rd. It won't be heard before then. That October 23rd likely will be the next time they go to court. Unless something crazy happens. Unless something very crazy happens. All right. I want to switch gears. Because I don't want the whole day to get away. Without. Showing this. I'm concerned. This is a big gear change here. I'm very concerned right now. I saw this pop up today. I saw this pop up. It's board should listen. Why? Why? Again, if you don't know who Z Cohen is, she hates TPUSA. Her entire organization was created. I can't remember what's called national ground game or something. These are the people who run the unblank America tour. They would show up and I think they showed up at three or four events. They would show up at events. And they would counter. Program Charlie Kirk's TPUSA events. So Charlie Kirk would haven't asked me anything. Show up under the tent. Students would line up across the street. Unblank America with Z Cohen and her ilk, including Hunter Kozak would show up and they would hold a counter event, a counter protest, if you will. Why, if, if their goal was to, and I'll, let me just play how she says it. Let me see if I can find her here. Yeah. Here we go. Every video she does, she puts up this and she says a lot of foul words and I'm not going to bleep them out. So, uh, I'll, I'll just play the beginning of this. I'm not going to play the whole thing, but I just want to play the beginning of, Oh, just actually, let me look here. Let me pull this back down. She doesn't show the event, does she? Hold on. Let me, let me preview this real fast. I did. I did not intend to show this video. So give me just a second. Okay. No, she doesn't. Um, if she does, I'll stop it immediately. So this is Z Cohen. She leads the unblank America tour. She leads this national ground game. Here's how she describes her organization. The Charlie Kirk murder case just took a major step forward because today was the last day of the preliminary hearing. So here's everything you need to know. It's the first time you're seeing me. I run the largest counter organization to turning point USA on the left. So don't forget to follow me. I run the largest counter organization for TP USA on the left, meaning. She should be celebrating that TP USA is falling apart. Her goal for existing is that TP USA would go down. Right. It's like the SPLC, the Southern poverty law center exists to fight racism. They should celebrate the reduction of racism. They shouldn't say, well, these organizations are getting less racist. We should throw out their leaders. No, you should say great. These organizations Petitions are crumbling. They're not racist anymore. We've won. If Zee Cohen, if her goal is to defeat TPUSA and her statement here is that Erica is doing a lousy job, and that's what the change petition is about. It says essentially she's doing a lousy job. And because she's doing, two of you went off and signed this thing. Come on, guys. I asked you not to sign it. Now we're at 290. It's been at 288 for like an hour. So if in recent months, there have been at least two significant public breaks involving campus leadership. In March, University of Arkansas chapter announced it was disaffiliating from the national organization, rebranding as Young American Revival. Then in April 2026, Caroline Maddox resigned as president of TPUSA's Georgia chapter. She said she believed TPUSA's current direction no longer aligned with the principles on which the organization was founded. These are documented decisions. By individual student leaders, but they should matter to an organization whose mission depends heavily on students. Erica Kirk serves as both the CEO and chair. We believe these recent student departures give TPUSA's board sufficient. Listen, what you're saying is everything you've been working for since founding your stupid organization is coming to fruition. You're winning. You founded an organization. And you're the one who's going to make it happen. Rather than celebrate, she's saying we should get rid of Erica Kirk and get somebody better. Why? Why? If you think she's destroying TPUSA, you should be popping Dom Perry on. You should be putting off those little cannons that rain down confetti. This should be something you're excited about. I'm very concerned she's not. And here's why. Here's why I'm concerned she's not. I don't trust any of this. I don't trust any of these people involved. I don't trust the TPUSA people, and I don't trust Z Cohen at all. And I wonder if there's not some sort of coordination. I can't state for certain. But I know, for example, that the TPUSA people have put out surrogates to go out there and accuse conservatives of working with this woman to take down TPUSA. And they've included accusations. They've included accusations of taking money. Taking money from ActBlue. ActBlue is the big Democrat funding mechanism. People donate to ActBlue, and then ActBlue gives money to Democrat organizations. The Republicans have a counter one called WinRed. So ActBlue is the Democrat version, the leftist version. And they've been accusing people of taking money from ActBlue and working with Z Cohen. And now we have Z Cohen out there saying we need to replace Erica Kirk. But this is in the context of everything that's taken place in the last couple of months. It's September 1st. Let's go back to July 1st. We learned last week that the Department of War, formerly the Department of Defense, I think still officially the Department of Defense, but they call it the Department of War or whatever. The Department of Defense, the Department of War has gone around hiring conservative influencers like Graham Allen, Data Republican and others. And they're paying them essentially to. To carry out their mission. One of the missions seems to be supporting Erica Kirk on its face. But in supporting Erica Kirk, what they're saying is not Erica's doing a great job. They're saying people are attacking Erica Kirk and they're putting her life in jeopardy. It's an interesting support. That Candace is somehow leading this organization that's endangering Erica Kirk. Now you have the story come out. That all these these organizations that are endangering Erica Kirk may be working with Z Cohen. And Act Blue funded by Act Blue. And now you have Z Cohen coming out saying, I'm worried for TPSA. We need Erica Kirk to step down. Too much targeting on Erica Kirk here. Too much getting ready to blame Candace if something happens to Erica Kirk. And that's essentially what Data Republican concluded. After she went to work for the Department of War, she started this. Series of social media posts or about the time she went to work for the Department of War. She started this series of social media posts essentially saying Candace is putting Erica's life in jeopardy. By her coverage of the Tyler Robinson case. And I worry that the same thing that I think might have happened to Charlie Kirk. Might be in the works for Erica and it's terrifying. I don't want anything to happen to her. I don't want anything to happen to anybody. We have enough violence in this world. We have enough bombs exploding overseas. We have enough people being displaced and killed. We have schoolgirls dying in schools. Let's let's let's dial back the violence for a little bit. Let's just take this back to conversation and rhetoric. Let's just have debates over which way we should govern ourselves. Let's stop with the violence. But I really worry that that the Erica Kirk experiment has failed. And that they recognize. That everything Z Cohen just said about Erica Kirk is true. Frankly, she is doing a poor job. People are losing faith in her. Nobody's watching the Charlie Kirk show. Nobody's showing up at TPSA events. Attendance is way down. Donations have to be down. At least small dollar donations have to be down. Merch sales probably collapsed in the, you know, in the immediate aftermath after Charlie passed. They went way up, but they've probably collapsed since then. And it wouldn't be a stretch to believe that the. The Erica Kirk experiment is failing. But you're never going to get her to step down. You're never going to convince her that she's had enough. You're never going to get the board to fire her. But if you can create this idea in people's minds that Erica Kirk is in danger and if something happens to her, it must be some crazy Candace cult follower. Well, then you've created an environment where. You could have her removed. And you could blame Candace. You could blame the independent researchers who are trying to figure out who killed. Charlie Kirk. How and why? And I had this idea floating in my head. I'd had this concern floating around in my head. But it wasn't until I saw her video today that it sort of all clicked. And I thought, oh, my. This is why they're saying everyone's working with Z Cohen. This is why they're saying everyone's being funded by Act Blue. This is why they're saying Erica Kirk's life's in danger because of Candace Owens coverage of the Tyler Robinson case. There's it would be a perfect environment. I'm not saying they're doing it, but it would be a perfect environment to. Set up an act on Erica Kirk that could be blamed on someone else. Why am I mentioning that? Because I think the safest thing to do is to identify it. The reason Charlie's dead is because he tried to handle everything behind the scenes. Imagine if Charlie had gone public and said, I think they're going to kill me. I'm making a public break. I have to make a break with my former supporters, and I'm concerned they're going to kill me. Well, then if they then if he died, who do you think people would blame? The people. He said might kill him. The people he said might kill him. You know, instead of sending a private text to a group of of of donors and supporters saying you guys have left me with no choice but to leave the pros real cause. What if he'd held a press conference? What if he'd put something on X? What if he had done a quick video and put it up on his YouTube page and said, hey, I'm being hassled and I'm having donors leave and I'm left with no choice but to leave the pros real cause. And they died the next day. Who do you think people would blame? Think they blame Tyler Robinson? Think they think he acted alone? No. I don't think so at all. And that's why I'm saying this tonight. I think people need to know that I have this really bad gut feeling deep in my soul that the Erica Kirk experiment has failed and the people closest to her know it. And when the Charlie Kirk experiment failed. He died. He died. And I don't want the same fate to befall Erica Kirk. I think the safest thing to do is just to call it out as I see it. I'm deeply and gravely concerned. I don't know. Part of me thinks anyone who watches Candace Owens or watches this program would ever do anything to Erica. Not one single part of me. But I also don't think. Tyler Robinson did that to Charlie Kirk. I think someone else may have done it. I think there may have been a larger plan. I've stated as much many times on the record. And that's that's what I fear. I have a deep fear of that. I don't know. I don't know any other way to read all these tea leaves and come to any other conclusion. And so I encourage people to stay away from this stuff. Stay away from this conversation. Stay away from this nonsense. Don't sign the petition. Don't get involved in it. Don't don't interact with Z. Z is not our friend. Z is not a friend. She's the enemy. She's the enemy. She doesn't want to find out who killed Charlie Kirk. How and why? Keep in mind, it was her cohort. Her buddy. Hunter Kozak, who was at the microphone. Asking about trans violence when an alleged guy motivated by trans issues. Supposedly acted violently. on Charlie Kirk. that's not lost on me are you saying hunter kozak is involved no no i can't i can't possibly say that i don't know that but i can point out the absurdity of the situation i can point out the absurdity of the situation i can point out that it looked like he was prepping preparing his reaction ahead of time i can point out that he looked more nervous than anyone else getting ready to ask a question nobody else was pacing around nobody else was looking at their watch look like they uttered the s word nobody else was making weird hand gestures towards charlie kirk hunter kozak looked nervous it was a long-tailed cat in a room full of rocking chairs he looked terrified and that's her buddy that's that's that guy was with her group when charlie died and so the fact that she's getting involved with trying to have a a movement to have erica kirk removed that worries me that worries me a lot because if you if you want the downfall of tp usa you you form an organ your z coach your z colin sanchez and you you form an organization and that organization exists solely to oppose tp usa you want to destroy tp usa with your protesting with your organizational skills and all of a sudden you look and tp usa is in grave danger and you think you've identified the problem erica kirk like you think that's the problem you think that's the cause of the destruction of tp usa and you exist to destroy tp usa are you going to remove the cause and make tp usa a better stronger organization or are you going to celebrate its demise the fact that that's what she claims to want but she's not celebrating it instead she's trying to remedy it so that tp usa is now somehow stronger gives me a deep concern about her motivations and her integrity frankly and her motives i don't know that i want to say any more than that but i i would caution people very much about getting involved with with her or her organization um because i have those questions i can't state for certain that she has any motivation to harm anyone i cannot state that with certainty but i can say it causes me grave concern grave concern that there could be now some multi-organizational effort to have erica kirk removed so that they can blame candace owens that they can blame the people who have asked questions about who killed charlie kirk how and why and have to ask questions about erica kirk's background or her qualifications so i say all that just to leave it there i don't want to go into it any more deeply i don't i'm certainly not accused let me just say this blanketly this is all opinion i'm not accusing anyone of anything i'm not stating with certainty but i am i will conclude this way the fact that people have without any evidence because it's not true claimed that that people are taking money from Act Blue or working with Z Cohen in order to accommodate this opposition to the Fed slop narrative. And now you see Z Cohen coming out and sort of furthering that narrative herself. I'm concerned. I'm very, very concerned. Very, very concerned. I think the best thing to do when you're under threat is to be under threat publicly. And I'm trying to state publicly my concerns. I wish Charlie had stated publicly his concerns. The defense lawyer is engaging in the state's arguments and demonstrating why he believes, they failed to prove them, even under the given hearsay standards.
