In 2019, 25-year-old Asia Levy was found dead in her Jacksonville apartment, a tragic victim of a premeditated and brutal murder. Her boyfriend, Spencer, discovered the apartment after a day-long absence, where he found blood, bleach, and a disturbing note threatening both Asia and Marcus Fishburn, who had stayed briefly with them. The crime scene revealed signs of a violent struggle, including a bloody hammer and extensive injuries consistent with torture. Marcus Fishburn, the only other person present, initially claimed to have been a victim, but his story was repeatedly inconsistent: he failed to recall Asia’s name, provided false alibis, and had no DNA in a sexual assault kit. Digital forensics uncovered that he had researched serial killers and violent acts online, and he recorded a video in which he taunted Asia, threatening to condemn her to hell. The medical examiner confirmed multiple stab wounds and blunt force trauma, indicating intentional and prolonged torture. Marcus also had a history of violence, including punching a coworker, and later stabbed an inmate in jail, reinforcing his dangerous and premeditated nature. After confessing to the murder and the act of placing her in a storage bin, he was convicted of first-degree murder and aggravated battery. The jury recommended the death penalty, which was upheld by the judge due to the extreme cruelty, premeditation, and religiously charged motive. Despite his plea, the state maintained that the crime was not impulsive but a calculated, evil act rooted in a desire for revenge and psychological domination. Ultimately, the case stands as a chilling example of a premeditated, violent crime driven by twisted ideology, leaving behind a young woman whose life was taken not by accident, but by a deeply disturbed individual who sought to inflict pain and suffering.
I just got home and my gun's gone. Asia's not gonna answer me all day long. There's blood all over my heart. Asia Levy was in the prime of her life. She was her daddy's little girl. She was living her best life with her boyfriend. But a week before Christmas, the happy couple opened their door to a friend in need. And Asia was never seen alive again. This case was chilling from the get-go. My dog's freaked out. My couch is all pushed. It was very evident to them that this was a crime scene. There was a note on the living room table that essentially said, "Keep your mouth shut or you and your daughter are next." I don't know what's going on. This young lady did nothing wrong. We don't know why, but she paid a huge price. He says something the effect of nothing could help you now. And I'm going to condemn you to hell. It's something that you'd see in a horror movie. [MUSIC] In 2019, 25-year-old Asia Levy was living on the south side of Jacksonville, Florida in an apartment that she shared with a boyfriend, Spencer. Asia and Spencer were in a relationship. They had been together for about eight months. They were always together. They got along great, never had any issues. You know, they were young people living their life day-to-day. Happy, happy, and where they were. Their apartment complex was located on the south side of town and an average normal middle-class area. But this is not an area known for high crime or violent activities. All accounts. Miss Levy was a tremendous person. She had a family of love there, friends of love there. I mean, no one had a negative word to say about her. She was just a helpful, kind person. A young person who was really beginning her door life. She was her uncle's first niece. She loved sushi. Spencer described her as the perfect girlfriend. Her family described her as caring, creative, a marvel fan and was always willing to help others. And that's why she and her boyfriend took Marcus Ishburn in because she said that he had been going through a hard time. According to Spencer and Marcus, they had known each other somewhere from the six to eight-year range, but were extremely close. They described each other as best friends and would do anything for each other. Mr. Ishburn was by that time drifter. He'd be kicked out of his dad's home because they had some kind of falling out and some kind of physical confrontation. So Marcus, he showed up unannounced at Asian Spencer's apartment. He waited on the steps for hours for them to get home and basically said, "I need a place to stay for a week until I can get back up north to my mom." They said, "Sure, you can stay here for a week, but you have to be out by the 21st." But before the 21st would come, something terrible happens. So Spencer tells us that he leaves for work every morning at seven o'clock, punctual. Today, he was running late. It was 7-0-5-7-10. But that when he left, Marcus was still sleeping. Asia was awake. She had made him breakfast as she does every morning. And he said we would often talk throughout the day between my calls. He started calling her continuously. Couldn't get a response. It's not like Asia to go Spencer for an entire day, which hasn't worried sick, so he immediately leaves work and heads home to check on her. There were a lot of red flags from Asia's boyfriend walked into the apartment. He immediately noticed something was wrong. And there was blood all about the apartment and there was a smelling, a smell, a strong smell of bleach in the apartment. So he immediately contacted a law enforcement and police came out to investigate the scene. My dog freaked out. My couch is all push. I had a weird [bleep] on all day. You know, she's not answering. I kind of got pissed off 'cause I'm like wanting you know, like what the [bleep] doing. You know, like I talked to Marcus earlier and I said, "Martin, where are you taking them?" Oh, she left a while ago. She was saying she was trying a little ways up. She was like, "Okay, I came here." And this [bleep] was your roommates? Would they prank you at all? It wasn't their roommate, it wasn't anything. It was literally one of my friends. Marcus, let's stay with you, okay? I told him you could stay for a week. He was supposed to leave tomorrow. Was this about like blood on the floor? Come on. Okay, let's go. Yeah, let's go take a look. So when police entered the actual apartment, it was a very odd and difficult scene for them. First off, the front door had an old, but Halloween decoration on it. It said, "Something like the effective enter if you dare." And we're talking about right before Christmas. So it was either a bit left up, but either way, it was an eerie start to their investigation, I'm sure. There were various pocket nice laying around. They did notice that there was a bloody hammer that was on a mantel piece. There were blood spatter around the carpet. They also, police pretty quickly identified some bleach spots that were on the carpet. When they lifted that carpet up, they found another large pool of blood that was there. Well, I looked around first to see if it was kind of a joke. You know what I mean? There's a. Like. I don't know if that's. We're working through it just for many hall. I don't know how to react to it. Based on what officer saw with the bleach, it tells us that there was a significant struggle of some type in the apartment and obviously efforts to hide that. I like saw that stuff on the ground, I smelled the bleach, but I thought that was coming from something clean and you know, or then I just bought some for it. I'm trying that out. I don't know. Somebody tell me it's a blood or not right now. That's what I need to know. Spencer was on a roller coaster of Emotions. There were times where he was very clearly scared. He was confused. There were times that he was emotional. All they know what to do. I don't know what to do after that. I'm going to f*** with him. I thought it was like scared. Like she looks scared. I still do it. So it doesn't happen. She'd be open to that. She had to make those doors. You know what she was wearing today? I don't. You got a. Recent picture over? Yeah. She can get like snapchat or nothing. We can't track. We're here. What? It doesn't say she's in a relationship with me anymore. What do I find that was like updated? This is it. Is that picture? Yeah. It's five months ago. Five months ago. That's the most recent. So her last photos was the sooner 16th, 827? No. It wasn't. Look. It's like I'm like. Did she block you? That's what I'm looking at. Or friends. So I'm supposed to say in a relationship with. What the fuck is going on, dude? Spencer never indicated that he thought Marcus maybe involved. What Spencer did tell us as soon as he found his apartment in the manner that he did. He immediately went to check to see if his firearm had been taken. Because he saw that Marcus was gone. All of Marcus is clothing and other property were gone. And when he noticed the firearm, he felt like Marcus could have taken that as well. There was a gun in the house. My gun was in my drawer. And it's gone. The Marcus know that you had a gun. Okay. There's always talks about weird stuff and like all this stuff flashing back to me about like what he says. I've always like someone's out of here. But nothing at that crime scene disturbs investigators more than what is sitting out in plain sight. There was a note on the living room table that he essentially said, "Asia and Marcus are dead. Keep your mouth shut or you and your daughter are next." And that immediately tells investigators that whoever's responsible for this knows all parties involved. After locating a threatening note on his coffee table, Spencer Smith Parker has serious concerns about the well-being of his girlfriend, Asia Levy and his friend Marcus Fishburn, both of whom are nowhere to be found. What stood out to me most in that note was Asia and Marcus would both have what I would consider unique spellings of their names. Whoever authored this note spelled Asia incorrectly, but Marcus was spelled correctly. At that point in time, they're going to be trying to determine whether the note is genuine, who wrote it. And they are certainly going to be wanting to locate Marcus, hopefully alive. We don't know what it is right now. We're airing on the side of caution. We're working to try to find out as much information. While detectives work to secure a warrant to do a more thorough search of the apartment, the officers can vis the green tree place complex to find out if anyone saw something useful.
- I like maintenance people. - I like people trying to talk to each other loud. - Yeah, it wasn't anything that, I don't know why I should go look or something. - Okay. - No, we're just like people talking out. - Talking loud. - Communicating loud. - Okay. - By early afternoon, police have a warrant in hand and they enter Spencer's apartment. And this time, they are accompanied by crime scene technicians. And this is when they make a discovery that changes everything. - Our crime scene detectives arrive, they begin searching room by room systematically for any evidence. In doing that, Detective Bidlick noticed a storage bin in the hallway closet that had quite a bit of material piled on top is stuck out to him. He asked if that had been looked at, they said no. So they went ahead and moved forward to that bin. And as they started taking things off the top of it, they quickly realized that there was a body wrapped up and shoved into the bin in the closet. It gives you goosebumps thinking about how Asia was found. People don't belong in plastic totes. - It's very shocking, especially coupled with everything else that we found at the apartment. And at that point, it goes to a homicide investigation. We now have a body. The decision was made in conjunction with the medical examiner's office to leave her as she was and to transport the bedding and the storage unit to the medical examiner's office. Which really comes into play later because we know she's deceased, but we have no idea by what means. - I think in most cases, we see like this, with such extreme injuries and such violence, a lot of times it indicates that it may be an individual who already knows the victim. - Which is exactly why investigators decide to do a formal interview with Spencer Smith Parker back at police headquarters. - Any homicide investigation oftentimes, the person closest to that individual is scrutinized. And this was no different. We have to eliminate Spencer. - What's your name? - Spencer. - Spencer. - When we went to the Silver Gound, I was all right, nice to meet you. - Spencer was frustrated that he was in an interview room without a phone and not getting any details, all of which were very reasonable emotions for him in that moment. - Anyway, give us a minute of your figures, Paul. - Thank you. - Hey, Tony, you can have your phone. - I'm going down right now. - Oh, right now. - And a little bit of your puncture, you can't. - All right. - Yeah, then the idea was, I don't know, they'll come and talk to you in a minute. - Everything about Spencer seemed to like a normal guy. He was still in his work uniform because he had just gotten home. - Before we talk to anybody, just because we don't know everything that's going on, we're gonna go over your rights, okay? This is just to protect both of us in our conversation. - I'm not like-- - No? - Okay. - No, so anytime this doesn't mean that you're going to jail, this doesn't mean anything like that. Just you need to know what your rights are before you talk to me, okay? - And again, he was on a roll of code survey emotions, but what he was throughout was unwavering in his account of details of what had occurred that day. - So I leave the house every morning. Leave the house seven o'clock. - Okay. - But I left it like a little bit, like seven to five, seven to ten this morning. I got to work seven, 30, you know? I'm like, I'm calling or like I normally talk to you like every morning. Like I call my daughter, and I talk to my daughter is down south, and I usually call her right after, and then I'll talk to her, and then I'll go do my rounds. And I'll call her again, talk to her. I call her like 20 times today, she's not answering. So I call him Marcus. I like 10 o'clock, something like that. And he answered the phone. I'm like, is Angelic? - Oh, she left a while ago, like really? Okay, if she's not answering the phone, he's like, she's fine. I'm like, he's like, when are you going to be home? - We're the A signs of forced entry into the apartment. - I mean, they look out of the room. None whatsoever, and I don't even think about it until the cops had something, but I always would just like go and automatically stick my key in. No, I don't try to see if it's open. Just 'cause like, I don't know. I'm always trying to catch somebody doing something. Like I always think, I don't, just the way my mind works, I've been cheated on. And also, I don't turn it, I open it, but it was really easy to open. So I think the door was left unlocked. I mean, there'd be no way for him to lock it anyway. So if you look. - It appeared that he was telling the truth, and he really did not know what happened to his girlfriend. - The police were able to eliminate Mr. Smith Parker as a suspect relatively quickly because Mr. Smith Parker went to work that day. - The owner of the long-care company that he worked for actually had a GPS tracker on the vehicle. So we were able to confirm when exactly he arrived to work, when he left via his time stamps on his card and track where his vehicle went throughout the day. - With Spencer officially rolled out, police set their sights on the one person in this equation who no one can find, Marcus Fishbur. - The note implies or says that Asia and Marcus are dead. However, Spencer is able to provide a phone number to Marcus' father, officer's contact him. He says, yeah, I've spoken to him. He called me, wanted a bus ticket, and my brother just went and picked him up. He should be at the bus, stop downtown. - Okay, and you said it was your brother that took him to the Greyhound station? - Yeah. - All right, we're gonna give you a call back if we need anything else from you, okay, sir? - Hi, thank you very much, sir. - According to Marcus' father, the two have reconciled from that earlier argument, and Marcus' bus is headed home to Indiana. In fact, his bus is scheduled to leave in just a few hours. So obviously, the clock is ticking at this point and police race downtown. - Hey, Merz, I'm gonna send you this guy's DL number. You should be able to pull up his DL pick, and we just gotta see if he's there at the Greyhound. Supposedly, he's gonna get on a bus at like 415, I believe. He got dropped off there, so he should still be there at the Greyhound. It's gonna be either like a, where we're gonna possible eight, possible 30, possible five, we're still trying to figure it out, but he was supposed to be here with our complainant's girlfriend, and all of a sudden, he went missing, the girlfriend went missing. Nobody's been able to get in contact with them, and we found out now that he supposedly is at the Greyhound station. So we're trying to figure out what happened with the girlfriend and why there's a large amount of blood and everything in the apartment. - As the officers enter the terminal, it doesn't take long for them to spot a man matching Marcus' description. - Hey, boy. Hey, what's your name? What's your name? - Marcus. You can't call me for a second, you know what? - We're gonna jump right back into this, but we have a sponsor that helps support what we do here at Prime Crime, and this is for anybody who manages a business, owns a business, look, you don't need me to tell you that running a business is tough enough, but why make things harder doing things manually or relying on dozens of apps that don't really talk to each other, right? (indistinct chatter) - Watch. - Give me a big, big, big, big, big. - Whoa, whoa, whoa. - Listen to me. Don't do anything stupid. (sounds of gunfire) (sounds of gunfire) - What did I do? (sounds of gunfire) - Relax, relax. Let's go over here to my police car. (sounds of gunfire) - Why am I here? - He's taking it. I got it. - I got a slush right in like an hour. - Heading to see my son in MDM. - Okay. (sounds of gunfire) - I asked you what's going on. - Yep. - I'll let you know shortly. (sounds of gunfire) - I got fireworks. (sounds of gunfire) - For your family. - Officers at the bus station were able to review surveillance video and locate him going into the bathroom where we then found a trash can full of property that had come out of the apartment to include Spencer's firearm that was stolen, which was later confirmed via serial number. When Marcus was taken into custody, he had a double bag, which he tells Officer Chronolic has fireworks or sparklers in it. Well, to us, that is an explosive item and would constitute us searching it for safety reasons. And in doing that, he located long women's hair and clothing that had bleached stains on it as well. - I'm confused as hell, man. (sounds of gunfire) (sounds of gunfire) - What can you see in this, that's good. - Hmm? - What's being the best, dude? - I have no idea. I was just told to take in a custody. That's all I know. I don't know anything else. - When Marcus was brought down to the interview room that bag was placed outside. - What Marcus doesn't know is that Spencer just wrapped up his interview with detectives in the neck.
room. And when he enters the hallway, he stops cold. Spencer immediately recognized the bag to be his mother's. It said coach Sarah on it. To us, I met nothing. And Spencer said, "That's my mom." This whole time, Marcus has maintained his innocence, saying he has no idea what any of this is about. In fact, when he's questioned about his living situation, he has trouble even remembering Asia's name. Who lives there? Spencer and his girlfriend. What is her name? Um, Asia, I think. Asia? I think there's two A's in that. I'm not sure. It's either A-S-I-A-A-S, I don't know, just something like that. When we took him into custody, he had a scratch under his, under his eye, which immediately stood out to us. When we got him into the interview room, I went in with Detective Travis Oliver. And it was very clear that we're not going to get along that they clashed. He was being disrespectful. When did you get your ticket to? Check it's actually the bag, I think. Did you buy it? You got it today when you got to the bus stop? My dad purchased it for me. Out of 4 or 10, can you kind of show some respect please? Well, some respect to what. I mean, we're talking. You're talking. All right, my under arrest. When we were placed Detective Oliver with Detective Gilquist, Marcus's whole demeanor changed when it was two females in the room. Hey, I'm just like to Gilquist. Our son is a little tired on this. Nice to meet you. Are you Marcus? Is that what I heard? Yes, ma'am. Okay. He began talking about how good of looking of a man he was, how Asia wanted him. He was literally in the interview room laughing and joking with us, complimenting handwriting. Complete 180 on demeanor. Fishworm. That's a very usual manner. Oh, thank you. S-H-B-U-R-N-E. It's about this number one handsome man in the world, but I really feel like sometimes he wants to be me. I think he was very arrogant and had a high opinion of himself. And he thought that two females in there were going to believe anything that he said. It almost has this perception of himself that he's like, God's gift to women a little bit. He's trying to suggest that. And I kind of had a feeling that he thought he could just talk it the way out of this. We're taking your clothes because you're okay with it. Does that make sense? Yeah, as long as you have, as long as I get a pair of clothes first. Yep. We will make sure that you have a change of clothes. How long are we going to take telling you my clothes back? We have to bring an evidence technician to take them. So that might be a little minute. Yeah. Yeah, but I will tell you this will speed it up. He starts the interview by saying, "Hey, please don't make me tell on him." He then tells us that Spencer is responsible for Asia's death, that he watched Spencer beat her to death. And the reason that he gives is that Spencer has found out that he and Asia are in an intimate relationship, and he's mad about it. Obviously, we're with the girl, but he's sure he ended up finding out. So he was always like, every time she's in a shower, some, you know, he'd be like, "Oh, you're probably in the shower with Mark." And he's always about that. Every time he thought something was up, he always took it out on her. He's been like that for a while. I mean, even before a slip of the girl, he always thought there was something, and he would take it out on her instead of talking to me about it. There was no evidence at all that Miss Levy had any type of romantic relationship with Mr. Fiercebrook. During his interview, Marcus tells us that Spencer and Asia fight every day. They always are arguing. However, on this particular day, it's even more volatile than normal. They always get nose and nose with each other. I mean, you always beat her like that, but like, you know, you know, do so much. He beat that girl up death, man. That's what I'm always leaving. Maybe he must have thought I was gone, because he knew I was leaving to go to Indiana. Do you know what they were arguing about? I was sleeping with the girl. I mean, it just kind of happened, dude. But when confronted with the fact of, if he's mad over the two of you being in an intimate relationship, why is he okay with you standing in the room? He's not taking it out on you. He's not having conversation with you. And he's just simply said, no, he didn't really have an explanation for that. But he tells us that he obtained the scratch under his eye because Spencer and Asia were fighting and he wanted to get between them. Where'd that come from? Breaking up the fight. Breaking up the fight between him. And them too. I honestly couldn't tell you who hit me. Okay. I definitely got it. So, okay. I mean, we're just standing in between somebody and you're like this. Sure. I mean, we've all got two people, two people, those four arms. Sure. And there's nothing against one, even a lot of women do slap, scratch, skin, punching. Ultimately, you just got so bad that he left, went for a walk called his mom. Mom said, you need to go back and get the rest of your stuff to which he does. And he says that's when he sees him beating her to death. And I came back to get the rest of my clothes. I don't know, man. I walked in. I was like, what? Everywhere. And I don't know. He's still kind of beating the girl up. I don't know. You know, you don't care about what I know. I do. I've never seen a like that in my life. Kind of just on top of her. I was blood everywhere. She was screaming help. I was telling you, if I was a college police right there, you'd probably be back with my head and you don't know him. If they're fighting about the fact that she's sleeping with you and you're there, there was no engagement between the two of you. He didn't care that you were there. He was only met her. I mean, yeah, I'm in between them. I was in between them. I mean, I'm getting smacked around a little bit. But no, I mean, what Marcus doesn't know is that detectives have already ruled Spencer out through GPS and phone records. When he's confronted with the fact that Spencer's alibi has been verified and that we know he wasn't at the apartment. He tries to tell us, well, no, Spencer did go to work, but this all happened before he left to go to work. Well, Spencer is not in this picture. You were the only one in that apartment when this went down. Okay, and we can prove that. So please explain why you're in the apartment with Asia. And now we have Asia did work on the parts one. I happened this morning before we went to work. I'm not going to sit here and tell you that I did that dirty because I did not do that dirty. That's inconsistent with everything that you have said. I understand. People's stories change and I'm sorry. It's changing because you're afraid. I'm not afraid of you. I've been plenty of time. It didn't happen this morning before he went to work. I did it. No, I didn't. He then admits to helping when when confronted with the the bleach and the property at the bus stop. He tells us that he had to help Spencer clean the scene afterwards. Why did your clothes on my bleach when they picked you up? Why did everything smell like bleach? Did you clean up? Did you help him clean up? What's the deal with that? I hope because I had to. So you did help clean up with bleach? No, the choice. So what happened? Marcus then completely changes gears and tells police that there was actually a tall African American man with dreads that had entered the apartment and had killed Asia and and he just fled. Okay, we'll tell us what happened then, man. So I don't know. Some guy always comes and sees Asia when Spencer's at work and this is before we started dating. I'm some real tall black guy with dreads. Okay, now you're just f***ing up. You've never making f*** up right now. You're making f*** up, seriously? Yes, you're lying. Because earlier your story was a Spencer filter. Marcus, the game is up. We know what time it is. Cause right now you're looking like f***ing killed Asia. The only way out of that is to tell us exactly what happened. When police stood in by Marcus Fishburn's story, he gave them another one saying that he was defending himself because Asia was attacking him. If she attacked you, she obviously at some point had to get up to go get the gun. Why didn't you leave when she got up to go get the gun? And when she was giving the gun. But if you're afraid for your life and she does attack you, why didn't you walk out of the apartment? What do you mean? I tried and f***ed strong, you know how f***ing good. The anatomical differences between Mr. Fishburn who's 6-1, he's a pretty strong individual and Miss Levy who was petite, she weighed 126 pounds. So for Mr. Fishburn, do you try to claim that Miss Levy overpowered him? I think he even described her as like a cat or had like cat like ability? It was absurd. She attacked me. She attacked you, okay. Jesus f***ing cries. Are you happy? No, I want the story out of you.
How was what happened? I was trying to leave Okay, yeah, she's trying to leave and she had mentioned that Her ex boyfriend shot somebody and she killed him two years ago, whatever She just had me like a monster and was like Like she wrapped around me and Picture a fire jumping on you wrap around you not letting go You can get the your line look off your face. Come on now. I'm what if that's a story then why wasn't that the story I was giving to me the first time so is that what she did to piss you off? I just know I was sitting on the couch and I got a tag While Marcus continues to spin all of these different stories the medical examiner has just wanted to tell Whoever killed Asia Levy didn't just want her dead. They wanted her to suffer She had multiple blunt force traumas to her body both to her head as well as to her neck She had I believe 11 stab wounds to her face and neck. She had been strangled She'd been bound the injuries were consistent with multiple different types of weapons both knives and and likely the hammer that they had already noticed that was on the metal piece one of the things that was pretty powerful is that The medical examiner could not actually say whether The stabbing of her of Miss Levy or the Ludging of Miss Levy calls her dad that either of them could any of them could have it was that severe We had the doctor perform a sexual assault kit on Asia Marcus's DNA was not recovered in that sexual assault kit which then disproved His story that they were in an intimate relationship. It also eliminated any question as to whether she had been sexually battered During the attack going to the the point of her defending herself We had a crime scene detective come in. We removed his top. He had numerous scratches and defensive wounds to his upper body We mentioned the one on the face. He had him to his arms to his chest in his back area So after the interview with Mr. Fishburn Police had a lot to go on one. They had a Suspect that it changes their story three times Additionally, and what was later found out was that Mr. Fishburn had actually called his mother after the incident had occurred and Told her that he had done something very bad and had to get out of town It is sometimes easier for us as an investigator to disprove the lies than it is to prove the facts and As long as he was going to sit there and talk to me and give me a version that I could disprove That may have been all I had to work with in that moment. So I was going to let him talk But it's not something Marcus says during his interrogation that cracks the case It's something the computer forensics team discovers on his phone They're going to be looking for text messages phone calls miss phone calls emails Because they want to see what exactly was the relationship between these parties and what would lead to a potential motive for an individual to do What was done to Asia Once we had the evidence from the cell phone With the Google searches and the video This became very clear that this rose to the level of the death penalty case A lot of homicide When we're doing phone downloads and we're looking at Google searches. It's how to get rid of this how to hide this That's not what these searches were at all. What they found was disturbing the night before Asia was murdered He had searched who's the best assassin and most wanted serial killers in 2019 a lot of these internet searches Glorified murder these were related to serial killers and anti-vigilante justice How to know if somebody's after you how to know if somebody once you did like these types of things Was he paranoid? I don't know. Was he planning to kill somebody for the thrill of it? I don't know the phone records and His internet searches told us that this was a premeditated crime That this is an individual mr. Fishburnt who had thought about torturing and killing somebody for quite some time So that of course is going to be very dimming in front of a jury But the searches are just the tip of the iceberg because at 8.50 a.m. on December 20th This is after Spencer already left for work Marcus Fishburnt opened the camera app on his phone and he pressed record Some of the most disturbing evidence was a video that was found on Marcus Fishburnt's phone Showing Asia right before she was killed the video shows his his levy was bound and Mr. Fishburnt is trying to get her to confess to a crime that she never Committed and confessed to sins. It was almost like she's trying to orchestrate something for the camera and the final Moments of the video he says I hope you realize you're going to hell. I don't think you realize you're already in it One of the interesting things about mr. Fishburnt's search history at the same time that he was searching serial killers is that he was making reference to the movie coach writer Which was a Nicholas Cage movie and I never saw a ghost writer So I don't know all of the details of the movie, but it has something to do with someone like taking souls and avenging deaths and almost like put you forth a hell on earth So it clearly entered into mr. Fishburnt's psyche. It was almost like he was trying to Live out this ghost writer on earth and he's murder misleading. I Can't imagine how scared she was in that moment, you know in his interview He said she fought like hell and I believe that I believe she did everything she could to defend herself Against him I kind of wondered to myself if Mr. Fishburnt may have killed someone else and I say that because he was very Detailed about what he wanted her to say and again I've no proof that he killed anybody else. I don't am not suggesting that that but it was just Erie that he wanted her to confess to killing someone Based on all of the evidence Investigators finally believe they have a clear picture of how Asia's killing unfold I think it's a real reasonable theory that he used the gun initially to get her to comply and then after she complied and he tied her up That's when he Used the hammer knife to ultimately beat her to death and stab her to death We just located numerous reports Where he had a history of being violent towards other individuals some of those came from Indiana some of them were here locally a Co-worker made a report that he punched her in the face after she refused to allow him to borrow her vehicle I talked to some of those victims on the phone one woman said that she literally thought that this could have been her He clearly is a Twisted individual and he's someone who took some kind of pleasure in Killing someone and making it as painful as he could and Also not just from a physical pain, but just a psychological pain It was just he wanted to torture someone and that's what he did this case And that's the other aspect of this case the cruelty that he showed not only Victim in this case miss levy, but also to mr. Smith Parker was astounding that he tried to blame him and then Almost tried to set it up that it was mr. Smith Parker who did this at one point it showed that the degrees of depravity that mr. Fritzbrook really bad In January of 2020 Marcus Fishburn is officially charged with first degree murder and kidnapping in the death of Asia Leaving so in Florida kidnapping also includes confining someone against it will and that's Essentially what happened in this case that she was tied up and she was unable to escape But the question remains will Marcus Fishburn face life or death What he does next inside a devile county jail cell that will decide Two and a half years after Asia Levy's death while Marcus Fishburn is awaiting trial He apparently gets into an altercation with a fellow inmate While he was in the detention facility he was charged with actually using some type of jail made Knife to stab another inmate and cut their throat Court records to scribe the weapon as a shank car from the Handle of a hairbrush with a razor blade attached to the end. It's just further solidified The state's position that this is a death on the case and if there ever was one this fit that criteria The reason why we chose to prosecute the aggravated battery before the Definitely cases really a couple reasons one of the reasons is that this Stabbing of the fellow inmate is aggravated battery Was another if we convicted him we were able to use that as an aggravating circumstance for the jury to consider in the death On January 6, 2023 Marcus Fishburn is convicted of aggravated battery for the attack in the detention facility This is a first degree felony. It's the following month when he goes on trial for the murder of Asia Levy
The fishbird case took four to five years, because it's with combination factors. Number one, it is a capital case, but number two, this was during COVID, so that completely slowed down the court's issue for the better part of a year and a half. So if COVID had not occurred, this case probably would have been tried maybe 2022. But Marcus Fishburn does something that shocks everyone. February 5th, we pick a jury and then we start the trial and we're basically almost the end of this trial. He decides that he wants to plead guilty. So we pretty much put on all the evidence in the case except some of the beautiful forensics and the only thing we had left to do. But it did shock me that he plead guilty because the jury's already seen so much of this. Marcus ultimately ends up admitting to stabbing her in the neck, hitting her in the head with the hammer and strangling her. He says this is strangling her that ultimately killed her. He admitted putting her in the bin to writing the note and even furthermore, then gives officers a location of where he dumped the knife, which was in the 9,100 block of bay meadows, about a 20 minute walk from the apartment. And inside of that pocket knife lay located DNA evidence in the form of hair that belonged to Asia. With a confession, Marcus admitted that he worked alone that Spencer had no part of this even asked us to apologize to Spencer on his behalf. I think Mr. Fishburn may have done this for two reasons. One was that he thought that well, if I had said responsibility, maybe the state would take death off the table and then maybe two, even if the state doesn't take death off the table that the jurors might have some degree of sympathy for him and it allowed his attorney to say, look, he ultimately took responsibility. That's a mitigator potentially. But to Fishburn's surprise, his plea doesn't change the state's mind about a sentence. This wasn't just a crime of passion that just occurred. This was something he had been thinking about. And that's in the law, we call that premeditation, you have the ability to think about your actions. What you were doing, what you were going to do and the consequences of those actions. And that could lead up all the way to the moment that he's standing over her with a hammer. He's thinking about what he's about to do. When you couple those actions on the day of the murder with the searches he had made the night before from his phone, it likely seemed very clear to investigators that this was a pre-planned thought about attack on Asia. There's a lot to Mr. Fishburn that at the end of the day, he may have had these problems, but it was apparent to me that he chose evil in this case. And whatever mitigators there were, you're not going to be able to overcome the evil that he exemplified. I mean, again, his last words are "I'm condemning you to hell" and he gave someone a living hell in the last moments of his life. In the end, a jury votes 10 to 2 in favor of death. In any death penalty case, after the jury renders an opinion of death, the case then goes with the judge and the judge can either accept or reject that opinion. So in this particular case, Judge Salvador accepted the jury's recommendation. This court finds that death is the appropriate penalty for the defendant given the highly religious nature of this crime. I think to me personally, one of the most frustrating aspects of this case is we never found out why. You took this young lady's life, we can see the Google searches, we can see your history, but why? What happened in that apartment that morning to get to where we ended? Everything about this case is disturbing. Just how premeditated it was with the video he took of Asia during her final moments and his internet searches, glorifying murder. It just makes you think, why would he want to do something like this? With any murder case, a jury verdict is not really a victory, it's not going to change the stark reality of what occurred, but what a jury verdict does do is it does give validation to the fundamental principles that we all live by that you can't harm your fellow man. I hope people remember Asia, not for this case, but who she was to her family and her friends. That she was her daddy's little girl, she was living her best life with her boyfriend, and again, we don't know why, but she paid a huge price.
