The Houseguest From Hell

In December 2019, 25-year-old Asia Levy was found murdered in her Jacksonville apartment, with blood, bleach, and a threatening note implicating her friend Marcus Fishburne. Despite initial claims of being a victim, Marcus’s inconsistent stories, lack of DNA in a sexual assault kit, and detailed video of her being tortured while forced to confess to crimes she didn’t commit exposed his guilt. Forensic evidence, including Google searches for serial killers and the film *Ghost Rider*, revealed premeditation and a motive rooted in psychological torment. A video of the attack showed Marcus binding and intimidating Asia, confirming a deliberate, violent act. He later confessed to stabbing, bludgeoning, and strangling her, as well as hiding her body. His prior violent history and a stabbing incident in prison further supported the prosecution’s case. After a lengthy trial delayed by the pandemic, a jury recommended the death penalty, which was upheld by the judge. The case stands as a chilling example of premeditated, psychologically driven murder, underscoring the brutality and intent behind the crime. While the exact motive remains unclear, the evidence points to Marcus Fishburne acting with deep malice, not just rage. The tragedy highlights how a young, kind person like Asia was taken from her life, and the enduring impact of such violence on victims’ families and society.

I just got home and my son's gone. Asia's not been answering me all day long. There's blood all over my apartment. Asia Levy was in the prime of her life. She was her daddy's little girl. She was living her best life with her boyfriend. But a week before Christmas, the happy couple opened their door to a friend in need. And Asia was never seen alive again. This case was chilling from the get-go. My dog's freaked out, my couch. When an intruder approaches a home, they expect a camera. What they don't expect. Stop. This is SimpliSafe. There was a note on the living room table that essentially said, keep your mouth shut or you and your daughter are next. I don't know what's going on. This young lady did nothing wrong. We don't know why, but she paid a huge price. He says something in fact of, nothing can help you now. And I'm going to condemn you to hell. It's something that you'd see in a horror movie. In 2019, 25-year-old Asia Levy was living on the south side of Jacksonville, Florida. Florida in an apartment that she shared with her boyfriend Spencer. Asia and Spencer were in a relationship. They had been together for about eight months. They were always together. They got along great, never had any issues. You know, they were young people living their life day to day, happy and where they were. Their apartment complex was located on the south side of town in an average, normal, middle-class area, but this is not an area known for high crime or violent activities. By all accounts, Ms. Levy was a tremendous person. She had a family that loved her, friends that loved her. I mean, no one had a negative word to say about her. She was just a helpful, kind person, a young person who was really beginning her adult life. She was her uncle's first niece. She loved sushi. Spencer described her as the perfect girlfriend. Her family described her as caring, creative, a Marvel fan, and was always willing to help others. And that's why she and her boyfriend took Marcus Fishburne in, because she said that he had been going through a hard time. According to Spencer and Marcus, they had known each other somewhere in the six to eight year range, but were extremely close. They described each other as best friends and would do anything for each other. Mr. Fishburne was by that time a drifter. He'd be kicked out of his dad's home because they had some kind of falling out and some kind of physical confrontation. So Marcus, he showed up unannounced at Asia and Spencer's apartment. He waited on the steps for hours for them to get home and basically said, I need a place to stay for a week until I can get back up north to my mom. They said, sure, you can stay here for a week, but you have to be out by the 21st. But before the 21st would come, something terrible happens. so spencer tells us that he leaves for work every morning at seven o'clock punctual today he was running late it was 705 710 but that when he left marcus was still sleeping asia was awake she had made him breakfast as she does every morning and he said we would often talk throughout the day between my calls. He started calling her, continuously couldn't get a response. It's not like Asia to ghost Spencer for an entire day, which has him worried sick. So he immediately leaves work and heads home to check on her. There were a lot of red flags when Asia's boyfriend walked into the apartment. He immediately noticed something was wrong. And there was blood all about the apartment. And there was a smelling, a smell, a strong smell of bleach in the apartment. So he immediately contacted law enforcement and police came out to investigate the scene. My dog's freaked out. My couch is all pushed. Like, I had a weird on all day. You know, she's not answering. I kind of got pissed off because I'm, like, wondering, you know, like, what the is she doing, you know? Like, I talked to Marcus earlier, and I said, Marcus, where's Asia? Oh, she left a while ago. She was saying she was running a little late, though. I was like, OK. I came here, and this s***. Were your roommates, would they prank you at all? It wasn't a roommate. It wasn't anything. It was literally one of my friends, Marcus, that I let stay with me, okay? I told him he could stay for a week. He was supposed to leave tomorrow. Was this about, like, blood on the floor? Okay, let's go take a look. So when police entered the actual apartment, it was a very odd and difficult scene for them. first off the front door had an old halloween decoration on it it said something to the effect of enter if you dare and you know we're talking about right before christmas so it was either a bit left up uh but either way it was it was an eerie start to their investigation i'm sure there were various pocket knives laying around they did notice that there was a bloody hammer that was on a mantelpiece there were blood spatter around the carpet they also police pretty quickly identified some bleach spots that were on the carpet when they lifted that carpet up they found another large uh pool of blood that was there well i looked around first to see if it was kind of a joke you know because uh like all right we're working through it just remaining calm i don't Based on what officers saw with the bleach, it tells us that there was a significant struggle of some type in the apartment and obviously efforts to hide that. I saw that stuff on the ground. I smelled the bleach, but I thought that was from somebody cleaning, you know? Then I just bought some for it. I'm trying to. Somebody tell me if this is blood or not right now. That's what I need to know. Spencer was on a roller coaster of emotions. There were times where he was very clearly scared. He was confused. There were times that he was emotional. I don't even know what to do. I don't know how to react. I don't know what to do. I feel like I'm being f***ed with. And again, my dog is, like, scared. Like, she looks scared. Like somebody was. Something happened. And she's yelping right now. I mean, she doesn't even make those noises. You know what she was wearing today? I don't. You got a recent picture of her? Yeah. She didn't get, like, Snapchat or anything? You can't track where she at? What? It doesn't say she's in a relationship with me anymore. When was the last time it was, like, updated? Dude, that's it. This is it. Is that a picture of her? Yeah. That's five months ago? Five months ago. That's the most recent. So her last post was December 16th, 827. No. It wasn't. Look. It's like I'm, like. Did she block you? That's what I'm looking at. We're friends. But I'm supposed to be. We're supposed to stay in a relationship with. What the f*** is going on, dude? Spencer never indicated that he thought Marcus may be involved. What Spencer did tell us is as soon as he found his apartment in the manner that he did, he immediately went to check to see if his firearm had been taken. Because he saw that Marcus was gone. All of Marcus' clothing and other property were gone. And. And. When he noticed the firearm, he felt like Marcus could have taken that as well. There was a gun in the house. My gun was in my drawer. Okay? And it's gone. Did Marcus know that you had a gun? I don't think so. I don't think so. He just always talks about weird stuff, man. And, like, all this stuff flashing back to me about, like, what he says. I've always, like, someone's had to get him. But nothing at that crime scene disturbs investigators more than what is sitting out there. There was a note on the living room table that essentially said. Starting a business can seem like a daunting task. Unless you have a partner like Shopify. They have the tools you need to start and grow your business. From designing a website to marketing to selling and beyond, Shopify can help with everything you need. There's a reason millions of companies like Mattel, Heinz, and Allbirds continue to trust and use them. With Shopify on your side, turn your big business idea into. Shopify. He's still on the couch. Astonishing. Asia and Marcus are dead. Keep your mouth shut or you and your daughter are next. And that immediately tells investigators that whoever's responsible for this knows all parties involved. After locating a threatening note on his coffee table, Spencer Smith Parker has serious concerns about the well-being of his girlfriend, Asia Levy, and his friend, Marcus Fishburne, both of whom are nowhere to be found. What stood out to me most in that note was Asia and Marcus would both have what I would consider unique spellings of their names. And whoever authored this note spelled Asia incorrectly, but Marcus was spelled correctly. At that point in time, they're going to be trying to determine whether the note is genuine, who wrote it, and they are certainly going to be wanting to locate Marcus, hopefully alive. We don't know what it is right now. We're erring on the side of caution. We're working to try to find out as much information. While detectives work to secure a warrant to do a more thorough search of the apartment, the officers canvass the Green Tree Place complex to find out if anyone saw something useful. This morning when you say you heard like people yelling, was it like they're just like screaming at each other? No, I didn't. I didn't think anything of it because, like I said, I just sounded like normal yelling like maintenance people or something. Oh, like people trying to talk to each other loudly or something? Yeah, it wasn't anything that was like, "Oh, I should go look," or something like that. Okay. No, it was just like people talking outside. Talking loud? Communicating loud, yeah. Okay. By early afternoon, police have a warrant in hand, and they enter Spencer's apartment. And this time, they are accompanied by crime scene technicians, and this is when they make a discovery that changes everything. Our crime scene detectives arrive. They begin searching room by room systematically for any evidence. In doing that, Detective Bidlick noticed a storage bin in the hallway closet that had quite a bit of material piled on top. It stuck out to him. He asked if that had been looked at. They said no, so they went ahead and moved forward to that bin. And as they started taking things off the top of it, they quickly realized that there was a body wrapped up and shoved into the bin in the closet. It gives you goosebumps thinking about how Asia was found. People don't belong in plastic totes. It's very shocking, especially coupled with everything else that we found at the apartment. And at that point, it goes to a homicide investigation. We now have a body. The decision was made in conjunction with the medical examiner's office to leave her as she was and to transport the bedding and the storage unit to the medical examiner's office, which really comes into play later because we know she's deceased, but we have no idea by what means. I think in most cases we see like this, with such extreme injuries and such violence, a lot of times it indicates that it may be an individual who already knows the victim. Which is exactly why investigators decide to do a formal interview with Spencer Smith-Parker back at police headquarters. Any homicide investigation, oftentimes the person closest to that individual is scrutinized. And this was no different. We have to eliminate Spencer. What's your name? Spencer. Spencer. We'll be with you as soon as we can. I'm Travis Oliver, okay? Nice to meet you. Spencer was frustrated that he was in an interview room without a phone and not getting any details, all of which were very reasonable emotions for him in that moment. Does anyone have my phone? Yeah, give us a minute before he gets a phone. Thank you. Hey, Tony, you can have your phone? Probably not right now. Not right now. In a little bit, I'm sure you can. Okay. Do you have any idea what's going on? They'll come and talk to you in a minute. Everything about Spencer seemed like a normal guy. He was still in his work uniform because he had just gotten home. Before we talk to anybody, just because we don't know everything that's going on, we're going to go over your rights, okay? This is just to protect both of us in our conversation. I'm not, like. No. Okay. No, so anytime this doesn't mean that you're going to jail, this doesn't mean anything like that, just you need to know what your rights are before you talk to me, okay? And again, he was on a rollercoaster of emotions. But what he was. Throughout was unwavering in his account of details of what had occurred that day. So I leave the house every morning, leave the house at seven o'clock. Okay. But I left at, like, a little bit, like, 7:05, 7:10 this morning. I got to work at 7:30, you know, and, like, I'm calling her, like, I normally talk to her, like, every morning. Like, I call my daughter, and I talk to my daughters down south, and I usually call her right after, and then I'll talk to her, and then I'll go do my rounds, and I'll call her again and talk to her. Okay. 20 times a day, she's not answering, so I call Marcus at, like, 10, 10 o'clock, or something like that, and he answers the phone. I'm like, "Hey, is Asia there?" "Oh, she left a while ago." Like, "Really?" "Okay, she's not answering her phone." He's like, "Oh, she's fine, haha." And I'm like, he's like, "When are you going to be home?" Were there any signs of forced entry into the apartment, or anything looked out of the norm? None whatsoever, and I didn't even think about it until the cops said something. But I always would just, like, go and automatically stick my key in. You know, I don't try to see if it's open, just 'cause, like, I don't know, I'm always trying to catch somebody doing something, like, I always think, like, I don't, I, just the way my mind works, I've been cheated on, I've been, you know, so, like, I'll turn it, I open it, but it was real easy to open, so I think the door was left unlocked. Because, I mean, there'd be no way for him to lock it anyways if he looked. It appeared that he was telling the truth, and he really did not know what happened to his girlfriend. The police were able to eliminate Mr. Smith-Parker as a suspect relatively quickly because Mr. Smith-Parker went to work that day. The owner of the lawn care company that he worked for actually had a GPS tracker on the vehicle, so we were able to confirm when exactly he arrived to work, when he left, via his time stamps on his card, and track where his vehicle went throughout the day. The note implies or says that Asia and Marcus are dead. However, Spencer is able to provide a phone number to Marcus's father. Officers contact him. He says, yeah, I've spoken to him. He called me, wanted a bus ticket, and my brother just went and picked him up. He should be at the bus stop downtown. Okay. And you said it was your brother that took him to the Greyhound station? Yeah. All right. Well, we're going to give you a call back if we need anything else from you. Okay, sir? All right. Yes, sir. Thank you. Thank you very much, sir. According to Marcus's father, the two have reconciled from that earlier argument, and Marcus's bus is headed home to Indiana. In fact, his bus is scheduled to leave in just a few hours. So, obviously, the clock is ticking at this point, and police race downtown. Hey, Mirza, I'm going to send you this guy's DL number. You should be able to pull up his DL. DL pick, and we just got to see if he's there at the Greyhound. Supposedly, he's going to get on a bus at, like, 415, I believe. He got dropped off there, so he should still be there at the Greyhound. It's going to be either, like, we're working a possible eight, possible 30, possible five. We're still trying to figure it out, but he was supposed to be here with our complainant's girlfriend, and all of a sudden, he went missing. The girlfriend went missing. Nobody's been able to get in contact with him, and we found out now that he supposedly is at the Greyhound station. So, we're trying to figure out what happened with the girlfriend and why there's a large amount of blood and everything in the apartment. As the officers enter the terminal, it doesn't take long for them to spot a man matching Marcus's description. Hey, bud. Hey, what's your name? What's your name? Marcus. Okay, hey, can I talk to you for a second? Yeah, no problem. Officers at the bus station were able to review surveillance video and locate him going into the bathroom where we then found a trash can full of property that had come out of the apartment to include Spencer's firearm that was stolen, which was later confirmed via serial number. When Marcus was taken into custody, he had a duffel bag, which he tells Officer Kronolik has fireworks or sparklers in it. Well, to us, that is an explosive item and would constitute us searching it for safety. And in doing that, he located long women's hair and clothing that had bleach stains on it as well. What's being investigated? I have no idea. I was just told to take you into custody. That's it. That's all I know. I don't know anything else. When Marcus was brought down to the interview room, that bag was placed outside. What Marcus doesn't know is that Spencer just wrapped up his interview with detectives in the next room. And when he enters the hallway, he stops cold. Spencer immediately recognized the bag to be his mother's. It said Coach Sarah on it. To us, that meant nothing, and Spencer said, that's my mom. This whole time, Marcus has maintained his innocence, saying he has no idea what any of this is about. In fact, when he's questioned about his living situation, he has trouble even remembering Asia's name. Who lives there? Spencer and his girlfriend. What is her name? Asia, I think. Asia. I think there's two A's in that. I'm not sure. It's either A-S-I-A or A-A-S. I don't know. Something like that. When we took him into custody, he had a scratch under his eye, which immediately stood out to us. When we got him into the interview room, I went in with Detective Travis Oliver. And it was very clear that they were not going to get along, that they clashed. He was being disrespectful. When did you get your ticket to? Ticket's actually in the bag, I think. Did you buy it? You bought it today when you got to the bus stop? My dad purchased it for me. Okay. Out of 410, is that what you're supposed to be doing? Can you kind of show some respect, please? Show some respect for what? I mean, we're talking. You're talking. Okay. All right. Am I under arrest? When we replaced Detective Oliver with Detective Gilquist, Marcus's whole demeanor changed when it was two females in the room. Hey, I'm Detective Gilquist. First name is Elizabeth. How are you doing? Nice to meet you. Are you Marcus? Is that what I heard? Yes, ma'am. Okay. He began talking about how good-looking of a man he was, how Asia wanted him. He was literally in the interview room laughing and joking with us, complimenting handwriting. Complete 180 on demeanor. Fishburn, F-I-S-H-B-U. Very beautiful handwriting. Oh, thank you. S-H-B-U-R-N-E. Sometimes I feel like, you know, I'm not this number one handsome man in the world, but I really feel like sometimes he wants to be me. - I think he was very arrogant and had a high opinion of himself. And he thought that two females in there weren't gonna believe anything that he said. - He almost has this perception of himself that he's like God's gift to women a little bit. He's trying to suggest that. And I kind of had a feeling that he thought he could just talk his way out of this. - We're taking your clothes because you're okay with it. Does that make sense? - Yeah, as long as I get a pair of clothes first. Yep. We will make sure that you have a change of clothes. How long are we going to take until I get my clothes back? We have to bring an evidence technician to take them. Oh, so that might be a little minute. Yeah. Yikes. Yeah, but I will tell you, this will speed it up. This is my favorite outfit. He starts the interview by saying, hey, please don't make me tell on him. He then tells us that Spencer is responsible for Asia's death, that he watched Spencer beat her to death. And the reason that he gives is that Spencer has found out that he and Asia are in an intimate relationship. And he's mad about it. I was sleeping with the girl. Pretty sure he ended up finding out. So he was always like, every time she's in the shower or something, he'd always be like, oh, you're probably in the shower with Mark or something like that. I know you're in the shower with Mark. It was always about that. Every time he thought something was up, he always took it out on her. It's been like that for a while. I mean, even before I slept with the girl, he always thought there was something up. And he would take it off of her instead of talking to me about it. There was no evidence at all that Ms. Levy had any type of romantic relationship with Mr. Fishburne. During his interview, Marcus tells us that Spencer and Asia fight every day. They always are arguing. However, on this particular day, it's even more volatile than normal. They always get nose-in-nose with each other. I mean, he always beats her and s*** like that, but I can only do so much. He beat that girl to death, man. Told him I was leaving. Maybe he must have thought I was gone because he knew I was leaving to go to Indiana. Do you know what they were arguing about? I mean, it just kind of happened, dude. But when confronted with the fact of if he's mad over the two of you being in an intimate relationship, why is he okay with you standing in the room? He's not taking it out on you. He's not having a conversation with you. And he just simply said, no. He didn't really have an explanation for that. But he tells us that he obtained the scratch under his eye because Spencer and Asia were fighting and he wanted to get between them. - Where'd that come from? - Breaking up the fight. - Breaking up the fight between who? - Them two. I honestly couldn't tell you who hit me. - Okay. - But definitely got hit, so. - Okay. - I mean, when you're standing in between somebody and you're like this. - Sure, I mean, we've all been in that situation. - Two people, that's four arms. - Sure. - And they're nothing against women. A lot of women do slap, scratch, punching. - Ultimately, it just got so bad that he left and went for a walk, called his mom. Mom said, "You need to go back and get the rest of your stuff." To which he does. And he says that's when he sees him beating her to death. - I came back to get the rest of my clothes and. I don't know, man. I walked in and there was blood everywhere. And I don't know, he was still kind of beating the girl up. I didn't, I don't know. Dude, I'm driven right now, dude. I've never seen like that in my life. Kind of just on top of her, there's blood everywhere. She was screaming help. I'm telling you, if I was to call the police right there, you'd probably bash my head in, dude, you don't know him. - If they're fighting about the fact that she's sleeping with you and you're there, was no engagement between the two of you he didn't care that you were there he was only mad at her like yeah i'm in between them i was in between them i mean i'm getting smacked around a little bit but no i mean what marcus doesn't know is that detectives have already ruled spencer out through When an intruder approaches a home, they expect a camera. He tries to tell us, well, no, Spencer did go to work, but this all happened before he left to go to work. Well, Spencer is not in this picture. You were the only one in that apartment when this went down. Okay, and we can prove that. So please explain why you're in the apartment with Asia, and now we have Asia dead in the apartment. It happened this morning before I went to work. I'm not going to sit here and tell you that I did that to her because I did not do that to her. That's inconsistent with everything that you have said. I understand. People's stories change, and I'm sorry. It's changing because you're afraid. I'm not afraid of you. I've been plenty of times. It didn't happen this morning before he went to work. It did. No, it didn't. He then admits to helping when confronted with the bleach in the property at the bus stop. He tells us that he had to help Spencer clean the scene afterwards. Why did your clothes smell like bleach when they picked you up? Why did everything smell like bleach? Did you clean up? Did you help him clean up? What's the deal with that? I helped because I had to. So you did help clean up with bleach? Okay. I didn't have a choice. So what happened? Marcus then completely changes gears and tells police that there was actually a tall African-American man with dreads that had entered the apartment and had killed Asia, and he just fled. Okay, well, tell us what happened then, man. I don't know. Some guy always comes and sees Asia when Spencer's at work. I don't know. I don't know. This is before we started dating. I'm some real tall black guy with dreads. Okay, now you're just making s**t up. You are making s**t up. Right now you are making s**t up. Seriously? Yes. You're lying. Because earlier your story was that Spencer killed her. Marcus. The game is up. We know what time it is. Because right now, you're looking like a s**t who killed Asia. The only way out of that is to tell us exactly what happened. When police still didn't buy Marcus Fishburne's story, he gave them another one saying that he was defending himself because Asia was attacking him. If she attacked you, she obviously at some point had to get up to go get the gun. Why didn't you leave when she got up to go get the gun? I didn't know she was getting the gun. But if you're afraid for your life and she just attacked you, why didn't you walk out of the apartment? What do you mean? I tried. That s**t. You don't have a f**king clue. The anatomical differences between Mr. Fishburne, who's 6'1", he's a pretty strong individual, and Ms. Levy, who's petite, she weighed 126 pounds. So for Mr. Fishburne to try to claim that Ms. Levy overpowered him, I think he even described her as a cat or had cat-like ability. It was absurd. She attacked me. She attacked you, okay. Jesus f**king Christ. Are you happy? Well, finish what happened. No way. I want the story out of you. Tell us what happened. I was trying to leave. Okay. Okay? Yeah. I was trying to leave, and she had mentioned that her ex-boyfriend shot somebody and she killed him two years ago. Whatever. She just f**king attacked me like a f**king monster. It was like. Like she wrapped around me and. Picture of a f**king spider jumping on you and wrapping around you and not letting go. You can get your lion look off your face. Come on now. Well, if that's the story, then why wasn't that the story that was given to me the first time? So is that what she did to piss you off? I just know I was sitting on the couch and I got attacked. While Marcus continues to spin all of these different stories, the medical examiner has just one thing to say. The medical examiner has just one thing to say. Whoever killed Asia Levy didn't just want her dead. They wanted her to suffer. She had multiple blunt force traumas to her body, both to her head as well as to her neck. She had, I believe, 11 stab wounds to her face and neck. She had been strangled. She had been bound. The injuries were consistent with multiple different types of weapons, both knives and likely the hammer that they had already noticed that was on the mantelpiece. One of the things that was pretty powerful was that the medical examiner could not actually say whether the stabbing of her, of Ms. Levy, or the bludgeoning of Ms. Levy caused her death. Either of them could have. Any of them could have. It was that severe. We had the doctor perform a sexual assault kit on Asia. Marcus's DNA was not recovered in that sexual assault kit, which then disproved his story that they were in an intimate relationship. It also eliminated. any question as to whether she had been sexually battered during the attack. Going to the point of her defending herself, we had a crime scene detective come in. We removed his top. He had numerous scratches and defensive wounds to his upper body. We mentioned the one on the face. He had them to his arms, to his chest, and his back area. So after the interview with Mr. Fishburne, police had a lot to go on. One, they had a suspect that had changed their story three times. Additionally, in what was likely to be a murder case, the only evidence that was found was that Mr. Fishburne had actually called his mother after the incident had occurred and told her that he had done something very bad and had to get out of town. It is sometimes easier for us as an investigator to disprove the lies than it is to prove the facts. And as long as he was going to sit there and talk to me and give me a version that I could disprove, that may have been all I had to work with in that moment. So I was going to let him talk. But it's not something Marcus says. It is during his interrogation that cracks the case. It's something the computer forensics team discovers on his phone. They're going to be looking for text messages, phone calls, missed phone calls, emails, because they want to see what exactly was the relationship between these parties and what would lead to a potential motive for an individual to do what was done to Asia. Once we had the evidence from the cell phone, with the Google searches and the video, it became very clear that this rose to the level of a death penalty case. A lot of homicides, when we're doing phone downloads and we're looking at Google searches, it's how to get rid of this, how to hide this. That's not what these searches were at all. What they found was disturbing. The night before Asia was murdered, he had searched, "Who's the best assassin?" and "Most wanted serial killers in 2019." A lot of these Internet searches glorified murder. These were related to serial killers and anti- Still waiting in line? Again? That's time you'll never get back. Save time and money with Stamps.com. Vigilante, justice, how to know if somebody's after you, how to know if somebody wants you dead, like these types of things. Was he paranoid? I don't know. Was he planning to kill somebody for the thrill of it? I don't know. The phone records and his internet searches told us that this was a premeditated crime. That this is an individual. Mr. Fishburne, who had thought about torturing and killing somebody for quite some time. So that, of course, is going to be very damning in front of a jury. But the searches are just the tip of the iceberg because at 8:50 a.m. on December 20th, this is after Spencer already left for work. Marcus Fishburne opened the camera app on his phone and he pressed record. Some of the most disturbing evidence was a video that was found on Marcus Fishburne's phone. Showing Aja right before she was killed. The video shows that Ms. Levy was bound. And Mr. Fishburne is trying to get her to confess to a crime that she never committed. And confess to sins. It was almost like she was trying to orchestrate something for the camera. In the final moments of the video, he says, "I hope you realize you're going to hell. I don't think you realize you're already in it." One of the interesting things about Mr. Fishburne's search at the same time that he was searching serial killers was that he was making reference to the movie Ghost Rider, which was a Nicolas Cage movie. And I never saw Ghost Rider, so I don't know all of the details of the movie, but it has something to do with someone like taking souls and avenging deaths and almost like putting forth a hell on earth. So it clearly entered into Mr. Fishburne's psyche. It was almost like he was trying to live out this Ghost Rider on earth and his murder of Miss Levy. I can't imagine how scared she was in that moment. You know, in his interview, he said she fought like hell. And I believe that. I believe she did everything she could to defend herself against him. I've kind of wondered to myself if Mr. Fishburne may have killed someone else. And I say that because he was very detailed about what he wanted her to say. And again, I have no proof that he killed anybody else. I don't, I'm not suggesting that, but it was just eerie that he wanted her to confess to someone else. And I think it's a reasonable theory that he used the gun initially to get her to comply. And then after she complied and he tied her up, that's when he used the hammer and knife to ultimately beat her to death and stab her to death. We just located numerous reports where he had a history of being violent towards other individuals. Some of those came from Indiana. Some of them were here locally. A coworker made a report that he punched her in the face after she refused to allow him to borrow her vehicle. I talked to some of those victims on the phone. One woman said that she literally thought that this could have been her. He clearly is a twisted individual and he's someone who took some kind of pleasure in killing someone and making it as painful as he could. And also not just from a physical pain, but just a psychological pain. It was just, he wanted to torture someone and that's what he did in this case. And that's the other aspect of this case. The cruelty that he showed, not only the victim in this case, Ms. Levy, but also to Mr. Smith Parker was astounding that he tried to blame him and then almost tried to set it up that it was Mr. Smith Parker who did it. And I think that's Parker who did this at one point. It showed that the degrees of depravity that Mr. Fishburne really had. In January of 2020, Marcus Fishburne is officially charged with first degree murder and kidnapping in the death of Asia Levy. So in Florida, kidnapping also includes confining someone against their will. And that's essentially what happened in this case, that she was tied up and she was unable to escape. But the question remains, will Marcus Fishburne face life or death? What he does next inside a Duval County jail cell, that will decide. Two and a half years after Asia Levy's death, while Marcus Fishburne is awaiting trial, he apparently gets into an altercation with a fellow inmate. While he was in the detention facility, he was charged with actually, using some type of gel-made knife to stab another inmate and cut their throat. Court records describe the weapon as a shank carved from the handle of a hairbrush with a razor blade attached to the end. This just further solidified the state's position that this is a death penalty case. And if there ever was one, this fit that criteria. The reason why we chose to prosecute the aggravated battery before the death penalty came into play was because it was a death penalty. It was a death penalty. One of the reasons is that this stabbing of the fellow inmate, this aggravated battery, was another, if we convicted him, we were able to use that as an aggravating circumstance for the jury to consider in the death penalty. On January 6, 2023, Marcus Fishburne is convicted of aggravated battery for the attack in the detention facility. This is a first-degree felony. It's the following month when he goes on trial for the murder of Asia Levy. The Fishburne case took four to five years because of two combination factors. Number one, it is a capital case, but number two, this was during COVID. So that completely slowed down the court system for the better part of a year and a half. So if COVID had not occurred, this case probably would have been tried maybe in 2022. But Marcus Fishburne does something that shocks everyone. February 5th, we pick a jury and then we start the trial. And we're basically at almost the end of this trial. He decides that he wants to plead guilty. So we pretty much put on all the evidence in the case, except some of the computer forensics. It's the only thing we had left to do. But it did shock me that he pled guilty because the jury's already seen so much of this. Marcus ultimately ends up admitting to stabbing her in the neck, hitting her on the head with the hammer and strangling her. He says this is strangling her that ultimately killed her. He admitted to putting her in the bin, to writing the note. And even furthermore, then gives officers a location of where he dumped the knife, which was in the 9100 block of Bay Meadows, about a 20 minute walk from the apartment. And inside of that pocket knife, they located DNA evidence in the form of hair that belonged to Asia. With a confession, Marcus admitted that he worked alone, that Spencer had no part of this, even ask us to apologize to Spencer on his behalf. I think Mr. Fishburne may have done this for two reasons. One was that he thought that, well, if I accept responsibility, maybe the state would take death off the table. And then maybe two, even if the state doesn't take death off the table, that the jurors might have some degree of sympathy for him. And it allowed his attorney to say, look, he ultimately took responsibility, and that's a mitigator, potentially. But to Fishburne's surprise, his plea doesn't change the state's mind about his sentence. This wasn't just a crime of passion that just occurred. This was something he had been thinking about. And that's, in the law, we call that premeditation. You have the ability to think about your actions, what you were doing, what you were going to do, and the consequences of those actions. And that could lead up all the way to the moment that he's standing over her with a hammer. He's thinking about what he's about to do. When you couple those actions on the day of the murder with the searches he had made the night before from his phone, it likely seemed very clear to investigators that this was a preplanned, thought-about attack on Asia. There was a lot to Mr. Fishburne that, at the end of the day, he may have had these problems, but it was apparent to me that he chose evil in this case. And whatever mitigators there were, you're not going to be able to overcome the evil that he exemplified. I mean, again, his last words are, "I'm condemning you to hell," and he gave someone a living hell in the last moments of his life. In the end, a jury votes 10 to 2 in favor of death. In any death penalty case, if the jury renders an opinion of death, the case then goes before the judge, and the judge can either accept or reject that opinion. So in this particular case, Judge Salvador accepted the jury's recommendation. This court finds that death is the appropriate penalty for the defendant, given the highly egregious nature of this crime. So, Mr. Fishburne, you have not only forfeited your right to live among us, but under the laws of the state of Florida, you have forfeited your right to life. I will now adjudge you guilty of murder in the first degree and sentence you to death. I think to me personally, one of the most frustrating aspects of this case is we never found out why. You took this young lady's life. We can see the Google searches. We can see your history. But why? What happened in that apartment that morning to get to where we ended? Everything about this case is disturbing. Just how premeditated it was with the video he took of Asia during her final moments and his internet searches glorifying murder. It just makes you think, why would he want to do something like this? With any murder case, a jury verdict is not really a victory. It's not going to change the stark reality of what occurred. But what a jury verdict does do is it does give validation to the fundamental principles that we all live by, that you can't harm your fellow man. I hope people remember Asia, not for this case, but who she was to her family and her friends. That she was her daddy's little girl. And again, we don't know why, but she paid a huge price. ♪ Music ♪ Prize picks packs are here. Rip digital packs and get real basketball, football, and Pokemon cards.
