In this episode, Dave and Rob explore a range of controversial political and social issues, beginning with a significant moment where Rob attempts to defend Donald Trump by clarifying that his comment about nuking Los Angeles was not a literal endorsement but a hyperbolic rhetorical device to justify war spending. Rob argues this misrepresents Trump’s actual message and reveals a dangerous, unrealistic political strategy. They then examine a viral clip of Ben Shapiro, criticizing his framing of Trump as a tool of Israel and his claim that Republican demoralization could cost the Senate—calling it a politically manipulative and intellectually shallow argument. The conversation shifts to a Cornell campus sexual assault case, where Rob challenges the widely circulated narrative of a seven-man gang rape, pointing out that key claims—like drug-luring or full consensual involvement—are unproven and likely exaggerated. He emphasizes that political figures, including a U.S. Congresswoman, should not prematurely label victims or accuse individuals without evidence, highlighting the risks of political overreach and misinformation. The discussion also delves into deeper societal issues around consent, gender dynamics, and risk-taking among young people, arguing that real-world situations require nuance rather than binary moral judgments. Ultimately, the episode calls for greater honesty in how trauma, consent, and personal agency are discussed—both in politics and in everyday culture—without resorting to oversimplification or trauma exploitation.
What's up? What's up? Good people. Welcome to a brand new episode of part of the problem. I'm Dave Smith and he is Robbie the fire Bernstein. Hi, doing, sir. Little bit more rested than we were last time we spoke. Yeah. Well, we're at eyes. We'll do that to you, but they're worth it. Looking forward to Texas this week and everybody come out live, published Scott Horton. I sold out Austin last year. So don't sleep on your tickets. It's not a giant property. And then a following week in Chicago, Milwaukee, Cleveland, and Fort Wayne, Indiana. So a lot of porch is coming up, porchdoor.com, porchtor.com. I'm off for a few weeks. This is your only action people. Go see Robbie the fire Bernstein. That's going to be a fun one. I'm really looking forward to watching you and Scott together. I enjoy those. I swear sometimes, like, if I didn't like have family and responsibilities and I wasn't already on a plane far too often, there are things like that. Like that's one that go, ooh, I want to go to that. Like I want to go. Why can't I ever just go? You know, that'd be fun. Okay. Anyway, I got, I got something pretty cool for today's show, Rob, which is that opening up off the top here. I think Rob Natalie, this big moment, I think I could defend Trump. I got something to defend Trump on. I'd, you know, people have been, it's been like, geez, man, I guess it's been a year and a half now. I don't know. Rob, sometimes you just start talking. You lose track of time. But like, for a year and a half, I've just been trashing Trump like every single day. And then people will say sometimes, this is kind of, this is the biggest criticism I get from the Trump supporters is they go, dude, the whole show's turned into bashing Trump. And I get where they're coming from, you know, but he just keeps making me. And then, you know, I will, I'll, I'll, if I'm being completely honest with you, Rob, it gets in my head a little bit. And like, I, I notice it. Like I just have like an internal counter where I'm like, shit, that's 12 times in a row. I've just bashed Trump. And I've said, you know, nothing else. So anyway, that's been going on for a year and a half. And I'm up to like 300,000 something. But I found one today that I think I can, I can actually defend him on this. I'm also going to have to immediately rip him on the whole context of the bigger thing because the whole thing is awful. But I'm one very narrow specific thing. And I think it's the charge, Rob, that he was saying it's okay for blue cities to get nuked. I don't think that's what he was saying. That's all I got. That's all I got. I'm sorry, Trump supporters. I worked so hard to find something. Yeah, a couple of kickers and I can see that one thing. So, but to your credit, that shows how hard you're working to try and defend him. I'm trying my best to sell these midterms for you guys. That's what I've been trying to do this whole time here. But anyway, this was what I found, I found something else more kind of interesting about this. Let's just play the clip and me and you can discuss. Here's Donald Trump at his ladies rally. I want to see a tremendous victory. You want to see a tremendous victory because it verifies all the things we did. And again, remember, with the words just artificial, it's a little bit high. It's a small price to pay for keeping the world safe, keeping our country safe. They can take out a city. Let them take, let them take out Los Angeles. Let them take out San Diego. That's, this is a very small price to pay. And it's going to be a very substantial amount of what and they might keep going a little long. You know, they don't say they have a big threshold for paying. They need it. Let me tell you, they need it. But it's going to end very soon. And it'll end one way or the other and you're gas and you're gasoline and all of the things. And don't I want to see it. Okay. So this is the clip. Now Rob, I got to say, a lot of the people attacking Donald Trump here and me and you are very sympathetic to a lot of people attacking Donald Trump these days because he deserves the attack. But what they're all saying here is that his statement was like, let him, nuke LA, let him nuke San Diego. Now it did seem like some of his crowd took what he was saying to me and that because they started cheering like, yeah, nuke the blue cities or whatever. And a lot of people on line are taking this like, look, it's Donald Trump. He's saying he doesn't care if America gets nuked. This is worse than what Hassan Piker said about us deserving 9/11 or what about the people who voted for you in California, which is the worst of all the arguments that you're only supposed to care about nuking your own voters and not the citizens who didn't vote for you. I would just say Rob, I don't think that's what Trump even said there at all. I don't think that's what he meant. He was saying he was saying you think this war is costing a lot. But if I hadn't fought this war, this cost would have been nuking LA. Let him do that. And then you'd see that the right, he wasn't actually saying let him do that. So people are being unfair. Okay, so let me just be clear. He wasn't saying let them nuke LA. I defend Donald Trump. What he was saying is that you think this war cost a lot. Well, it would have cost a lot more if they had nuke LA, which is simply just a lie to sell you on a disastrous war. He was just lying you into war. He wasn't saying no one's going to nuke you. The nukes are all made up guys. That's the lie. He knows they're not going to, he wasn't inviting them to use the nukes. They don't have that they can't deliver to LA. He was just lying you into a war. Most of the topics that come up on the show, I'm not an actual expert in, but in this case, I do speak fluent retard. And you could be, you could be subpoena decor to testify with as an expert witness. As an expert witness. And Donald Trump speaks in front sentence fragments or sometimes run ons when he wants to just tag what he's saying. And in this case, that's just sentence fragments that appeared to say like he was saying let them, but that's not, what he's saying. Right. That's not what he's saying. It is the more interesting takeaway about this, right? Is that this is again, forget you could even leave aside if you, if you like Trump or don't like Trump or whatever. This is maybe the worst midterm pitch I've ever heard. And it might be the case that the people who still show up to the Trump rally still clap about it. But like your pitch is essentially that like, I know things are bad, but you got to vote for us because they would have been even worse. And then when he says they're even worse, the only thing he goes to is this like fantastical scenario that like no one including him really believe. You know, like even if you're not even telling me they were going to nuke Israel, you're telling me Los Angeles. I mean, I, it just makes no sense whatsoever. No one thinks it's true. And that's your pitch. And then things are about to get much better Rob. You know, he ran on this like so much winning golden age nonsense. And now the pitch is actually that that golden age comes right after the midterms. I don't know Rob. This, that's the real issue with this. It's not that he said something about New King cities is that he's just going down with the most pathetic like sales pitch. All right, guys, let's take a moment and think our sponsor for today's show, which is my Patriot supply. Winter storms have a way of exposing how quickly normal life can stop. The power goes out, the furnace stops, roads become dangerous, stores get picked over. And once the storm is already on top of you, your options shrink pretty fast. Well, my friends over at my Patriot supply told me they saw this first hand last winter when major storms threatened their Vesta stove indoor heater and stove became one of the hottest preparedness items of the season. It sold out again and again as people rushed to prepare the last minute. That's exactly why they've created the winter prep bundle to help you get ahead of the storm this time. It includes 114 servings of emergency food with real meals you can count on the Vesta heater and stove that's safe to use indoors backup power with solar charging emergency lighting and thermal blankets. In other words, food, heat, power and light already in your home before you need them. And when you go to prepare like Dave.com, you can save almost $300 on the complete bundle. So don't wait until the forecast sends everyone scrambling again. Get ahead of it right now. Go to prepare like Dave.com. Get your winter prep bundle while it's still available. And then you get the peace of mind to knowing that you're all set no matter what weather roams in this winter. I know I'm going to do that. I highly recommend you do as well. My Patriots supply is the company. Prepare like Dave.com is the website. Go check them out there. Prepare like Dave.com. All right, let's get back on the show. Yeah. Well, this is his campaign strategy because he said something similar in Alabama where if it wasn't for what I had done, they would have nuked you guys. And so it's once again a kind of the bridge and power plant day where he's saying, hey, listen, I saved us from getting nuked by Iran. And I know that things look bad, but just they're holding out from the midterm. So you just got to wait. And once the midterms are over, they're either going to walk back to the table and we're going to get our great deal or I'm going to be nuking them into oblivion. Hey, I hasn't said nuking them into oblivion. But essentially I, uh, options are on the table and I will take care of it and it will be over. So you just got to stick with me two more months. And hey, guys, I'll get I can end you crane rush or warm one day. Just give me just got to hold out. It's um I almost wonder, you know, like even in like the the Fox news, watching Boomer, who just, you know, is watching Sean Hannity. That's his source on this, you know, it's Hannity and Levin.
And he goes, yep, these crazy Shiites, they chant death to America, they fund terrorism and kill them. But that time we're going to see them. You know, I got no problem. They've been a thorn on our side for 47 years, we're going to go take, take care of them. Well, like, one of, I just wanted, like when Trump says, also they were going to new gloss angeles, is that guy like, yep, he saved us from getting new? Like does anyone believe that or is even that guy like, well, that's Trump and his bluster? You know what I mean? I don't have a tough time buying that anyone believes this is it like we just, I don't know, we've, it's not like we didn't have in Ayatollah there before Donald Trump was there. No other president made the decision to launch a war against them. None of this had happened, but somehow if Trump hadn't done it right now, who's buying that? I don't know, I generally, I really don't think anyone is, but I guess I could be wrong. Sometimes the black pill is not recognizing how stupid our fellow citizens actually are. And if they're showing up to a Trump rally in Alabama or actually under the belief that I ran had the capability to strike us with nuclear warheads if it hadn't been for the actions of Trump. It's crazy. Cause like if that is the case, you're like, man, we're just having such a different conversation. And you know, it's like, dude, it's hard to even know what to say then. That's where you're at. Oh, man, they were going to use the imaginable weapons. Do you imagine weapons, they were going to, they had them, they were deliverable and they were here. Okay. All right. That is something. Okay. Let's, let's move on to this other clip, which was also going viral. I found this to be really something. I don't even think I can give this an introduction. Here is Ben Shapiro's latest pre midterm cope. Here you go. They're very, very, very close races. And when you spend your days, demoralizing Republicans and telling them all is for naught. To democratic demoralization that the Lcy ads or the Mondani's, that is demoralization with the system. And so you get Democrats to go vote for it because again, they are the ones who are outside the system. But if you're a Republican, supposedly, like supposedly Tucker is and you're spending all day just ramming down this idea that you were betrayed 80 years ago and everything is gone wrong since. And Donald Trump is the tool of Israel and all the rest of this kind of stuff. If you say all of that and you drive down on the polling numbers, you could cost Republicans the Senate. All of these are very, very, very close races. And when you spend your days, demoralizing Republicans and all of that. All right. That's it. All right. I just, I listen, man. I don't know what to say. I don't say. I mean, this was the easiest prediction ever. It was the easiest prediction ever. I thought Tucker Carlson doesn't matter, but you told us that the lesson of mega still supporting Donald Trump's war was that turns out Tucker Carlson doesn't matter. Now how is it in the most predictable transformation ever that we've gone from? He doesn't matter to he's now going to cost us the Senate and how is he going to cost us the Senate by saying that Donald Trump's controlled by Israel? That's the issue, Rob. If you point that out and like, don't get me wrong, there is, it's the most ridiculous kind of circular argument. It's a truism. So of course, there's some truth to it, but it's like, yeah, if you point out the failures of this administration, that probably won't rally people around this administration. Okay, not the best argument to not point out the failures. Yeah. That's cold. Let's talk right there. Can't ask the questions. He can't pull out the point out the truth because then people are going to lose faith in our health administrations. Well, if the administration is not giving you good health advice, then you shouldn't be trusting them. That doesn't actually help you. And in this case, he's saying the direct inverse of what we were saying six months ago, which is, you promised us no new wars. You're flirting with an absolute quagmire. You're going to lose the support of all of us because we can't be here. And you're going to end up with the Democrats back and they go, nope, we don't need your support. And this thing is too important. And you guys decided that we did not matter. We were not a part of the winning coalition. You were not going to represent us. And now with six months later, you're going, oh, shit, we lost our winning coalition here. And the Democrats are going to come back and it's your guys's fault. No, you abandoned us. All said, man, yeah, dude, I mean, I don't know. I can't really add much to it. That was it. That's the clip right there. I mean, I used to, this little satiard told us told us the spit on us. You don't matter. Get out of here. We don't need you. We're pursuing the policy that we promised we wouldn't. Okay, there were costs to that. Those aren't ours. Those are costs you incurred. You know, of course, what's always shocking about these things in a way is just like, I don't know. There's just very little intellectual depth to this argument because Rob, obviously, it's a bit of a situational, right? Like if, let's just say if there was like a really, really good candidate, but not perfect, running up against a terrible candidate. And we focused on the stuff that wasn't perfect. You could understand where there'd be an argument to be like, hey, you're focusing on this. You're kind of hurting this guy. Why don't you talk about some of the fair stuff and not get something worse than him. There's an argument to that, right? But then there's also an argument that like you have to control for two problems, not just one. Because the other problem is that someone gets in there on your side and you won't criticize them even when they're fucking up on everything just for the sake of denying the other side. You know, take that to its conclusion and what does that make you Ben Shapiro? Oh yeah, a complete fraud, sell out, hack, who won't talk about anything bad about the Republicans because we just got to beat the Democrats. That's a problem too. Also, there is this presumption built into what Ben Shapiro's saying where then, you know, Tucker Carlson, who's presumably a Republican, should be trying to help the Republicans. What type of presumption is this about the nature of politics? If I'm a Democrat or a Republican or a libertarian or an independent, your member of the green party or the forward party or whatever, I think it stands to reason that you're a member of this political party because you believe in something and you feel that this party represents whatever you believe in. It's not just for the sake of this party. You don't join the Democrats because you love the letter D and you just want to see more people with the letter D next to their name no matter what, the goal isn't to get more Republicans. The goal is to get the policy that you think is the right one. You know, so like, like the goal for me is liberty. The goal isn't any party, including the libertarian party. You know, like, it's not like if the libertarian party, I used to use this example all the time, but if like, if Joseph Stalin ran on the libertarian party, you don't vote for him. Because it doesn't matter that it says libertarian next to his name, he's not one. And likewise, if Donald Trump is out there saying no new wars and then Tucker Carlson gives the keynote address at the Republican National Convention and endorses the guy promising no new wars, it's not as if because Tucker is Republican, therefore, when that guy launches wars, the assumption is that you still want that guy to succeed. Why would it be no, the presumption would be that he wants new Republicans who oppose the war to come in, right? Why would the assumption be you're just there for the sake of the party? Yeah. Well, they're desperate and they're trying to shame us all to get back in line and fear the Democrats, but, you know, I don't know, we're, we're kind of the, uh, the big thing. That was the one that, uh, you get people to walk away if you did and they did it. Yeah. Yeah. I mean, just, just terrible, like, like, you know, political malpractice in a sense and they committed the malpractice so they could get their war. It was the only way they could really get it and that meant more to them. But no, if you cared about winning the midterms, if you cared about the coalition, then you couldn't launch this war. There's not a coalition big enough, people hate this too much. And so that's that. And now, you know, it's essentially over, um, in terms of the domestic agenda, or at least it seems to me. I mean, perhaps the only hope here really is that the, uh, the Democrats will, what, you know, what's the old saying snatch, uh, defeat from the jaws of, of victory. I mean, they're trying. Um, I really am, uh, I got to say I did want to talk about this a bit, Rob, I was fairly surprised by the reaction to this, um, this Princeton scandal, um, where this, uh, young woman is suing. I'm Princeton Cornell. I'm sorry. I'm sorry. Not Princeton. Cornell. I'm a mistake. Confused those Ivy leagues. Um, this Cornell scandal where, um, this, this girl is suing the school and one of the fraternities there as well as several, uh, former students, I believe, um, I gotta say I first heard about this story. And I did not think it was going to blow up into the, the national story that it did, um, it was, I gotta say, it was, it was an interesting little sociological experiment because it was kind of almost like, it was almost like you ran the duke lacrosse case, but with Twitter, uh, and, man, does that change?
lot about the nature of it, the information that you get out right away. Also, I will say the cruelty on all sides, you know, is also pretty harsh. Although, I suppose there was no shortage of cruelty in the Duke lacrosse case toward the boys. Anyway, I guess I was a little bit surprised, you know, seeing Rob is how woke 1.0 was crazy. I was a little bit surprised that so many people essentially just ran the Duke lacrosse. You know, so many people in the corporate media literally just did the exact same thing. We are just going to treat this without asking any questions. We are just going to treat this as if it's obviously if she said something, then they tortured this girl and gang raped her for over the period of multiple hours. And that's just a given. I was really shocked in some ways that they're still just the fact that they wouldn't have gone like, I don't know if we can get away with this anymore. This might look really bad. I was surprised they didn't. All right, guys, let's take a moment to take our sponsor for today's show, which is Body Brain Coffee. Testosterone levels have been declining for decades. We're more stressed. We don't sleep well. We sit around all day. And that is the reason why I have a couple of Body Brain Coffee every day. Body Brain is real premium, freeze-dried, Colombian coffee. It's packed with functional ingredients that have been linked to testosterone support, stress management, focus, and brain function. They've got tongue cat Allie, Ashiwagandha, the two ingredients that have been studied for their potential to support healthy testosterone levels, stress and performance. They have lion's mane for cognitive support, L-theanine, which works alongside the caffeine for smooth, focused energy. And the thing that I love about Body Brain unlike a lot of these other products out there, it actually tastes like a delicious cup of coffee. I've tried some of those mushroom coffees and I can't drink this stuff, but Body Brain is delicious. And of course, it is the brainchild of the great Lewis J Gomez. Make sure you support this company and boost your testosterone levels. I'm telling you, I've been drinking this stuff for a while now and it does. It makes me feel much better. So I swear by it, you should too, BodyBrainCoffee.com, Dave 20, that is the promo code will get you 20% off your entire purchase. Once again, BodyBrainCoffee.com, promo code Dave 20 for 20% off. I will agree with you on that that I think it's I don't know all the details of this case, but I think saying it's a little bit too early to come to a firm conclusion and particularly to group all of the men in the incident together as being rapist or that they have lured her to the fraternity and that there was no action tape. That's not it. And I think everyone's behavior, it's just wrong here. I don't think it makes sense to go over to a fraternity to be doing ketamine, to be wanting to have sex with multiple men. I'm not telling you that you can't do it. I just don't think that's probably what you should be doing. And I also think if you're a dude in a fraternity, hopping on the opportunity of, hey, there's a available person here and we're doing ketamine for the night is probably not. And I'm not the most conservative of individuals, but I did I did not do these kind of things in college and it's a little shocking to me that kids in better schools than where I went are engaging in this kind of behavior. With all that said, I'm not I think it sounds like two people were certainly consensual and some of the later individuals are more in question. I don't really know how those rape cases will play out. And I'd like to see more of the case to find out how definitively it was one way or the other. And there's just too much chickening mixed in right now. It's like after that female killing, there's a lot of conversation about feminism and shirking responsibility. But then also if a lady clearly said no to later men, then I guess that that is rape. But well, of course, listen, man, I mean, that's the kind of the interesting thing about. Well, I'll say this, Rob, do you remember this was a thing? You remember I got this was one of my controversies from from years ago. I guess it was a thing I said back in like 2017. And then in like 2020, someone like unearthed our this group unearthed it, you know, and posted it. And then I just posted the full version of it to just be like, Hey, here, yeah, here it is. I'll share it from my much better. I always by the way, very interesting thing when people try to use a clip of a podcast I'm on as like a got you like, I said it into a microphone. I was trying to get people to hear it. I wasn't. No, so I had said this back in 2017, when this was like the, you know, that feminist period was one of the conversations. But there was this topic about the consent and and drunk sex. And there's always this tremendous amount of conflation that goes on like they'll use the word drugged. You know, they drugged her or something and you're like, Hey, hey, hey, dude, when you say you drugged someone, that means you against their will gave them drugs, right? Or trick them or trick them and then slip them a drug. That is total. But two people doing drugs is not one of them drugging the other ones. So let's get clear about that. And I made it very clear that they were I go, look, the only question is like, did you voluntarily take the drug? Did you voluntarily take the drink? Now, what will happen is people will act like you're saying, which is clearly not what you're saying. They'll act like you're saying, Oh, so if she says no after that, then it's that you've consented to no. Of course, anyone can be forced in any state, you know what I'm saying? But the point is that they'll say that no matter what after that, there's no consent. And I mean, that's completely ridiculous. This just completely ridiculous standard. It infantilizes women. It makes no sense. It's just not and it's not true. It's an insult to people who actually are victimized. So that's one thing that gets in there too. It's a very weird thing where it almost in a way, Rob, it almost calls feminists bullshit because feminists want to pretend like men and women are equal. There is there are no inherent differences between the two of them and that there's no reason why boys and girls can't both be in this environment like this. But then at the same time, there's a clear double standard, which every anti-feminist loves to point out, which is that, well, you never say when the guy's drunk therefore he didn't consent. If you're saying once there's drinking and drugs involved, you can't consent, then everybody is equally predator and prey in this situation. They clearly still look at the men as predators and the women as prey. And I think, Rob, there's actually a reason for that. That kind of makes sense. They don't want to admit it because it contradicts their whole worldview. But the actual truth is that men and women, in this case, I suppose you could say boys and girls debating on how you want to draw that line. It's not the same thing. It's not, you know, I don't think there's anything, I don't think anything criminal happened in this case. And I'm much more certain that you won't be able to prove anything criminal happened in this case. But those boys did something to that girl that was wrong. It was evil. You should not do that. And that is because there are differences between boys and girls, differences between men and women. It's not the case that if seven girls did that to a boy, it would be evil and wrong. It is the case that if seven guys do that to a girl, it's evil and wrong. And the feminist mind has absolutely no way to like grapple with that. That these are just different things. Also, by the way, Rob, you're never going to hear the story where seven girls did that to a guy or very rarely get to hear that because there's differences, you know. Yeah, dude, I lived a very debauchery lifestyle, but I never did that. And I got to say it is, I agree with you. It's crazy that this is happening on college campuses. That's kind of the bigger story here. And look, I'm really not trying to be too prudish about this. It's, look, Rob, if a, you know, dude, there's married couples, you know, who swing and do stuff like that. Not my deal. I have a, I'm very happy with my sex life. It involves just me and my wife. And we don't, you know, we're quite happy that way. But there's people who have orgies and swing and stuff like that. And I do not, it's not my cup of tea. I don't, I don't think it's, it's good for like long term stability overall. But I really don't judge people who do that. And I don't necessarily think that like, if two 30 year olds want to go do something, you know what I'm saying? Like, I'm not, but the idea, and I got to say as, as, you know, having kids looking at the world differently, the idea that we just accept that like 18 year olds are going to school and like this type of stuff is normal. Not, okay, this is not normal, let's say. This is an extreme example, but the environment that led to this is kind of just normal. It is, I cannot explain to you how bizarre that is to me. And there's a lot of things, a lot, I know this guy talked to a lot of, you know, anecdotally, but I talked to a lot of, you know, like, people around my age who have kids around my age. And it's a big generational thing. I'll say, Rob, where a lot of us are like taking these things that we took for granted. Many of us lived through this, you know, but now as we reassess it for our kids, it's like, dude, we don't have to sleepovers, but the idea of sending your kids off to these colleges, like all this stuff is just out, man, it's just, it's so crazy that this, essentially Rob, a story like this comes up, the feminist come up and yet believe all women, blah, blah, blah, this and that, the anti-feminists slap down all the [BLANK_AUDIO]
feminist nonsense. And then we all go away with no broader conversation about what the hell is going on with our kids? This isn't an Ivy League institution. - Well, I guess the, or at least one of the schools is Ivy League. And I'm sorry, go ahead. - The part that just, I mean, listen, there's a lot about this, this is wild. But, you know, I've, I've drinking too much in my life and I've smoked too much weed in my life. And luckily, basically avoided all hard drugs. And you could count on my two hands how many times I've interacted with some of the harder drugs. And a lot of my college drink, well, the early days or the smoking weed was like loser shit of like, you know, video game playing. And like, you know, I was not out banging out with women being cool. And then the later drinking was being a weirdo at open mics and talking to nobody and kind of drinking my way through open mics. Like, almost like as a 40-year-old, 24-year-old. - I mentioned, I mentioned fell in love with that, Rob. - Exactly. But I was, I was not doing the, what this college parting is. But it, it's just amazing. Maybe there's just other individuals who actually handle their drugs better than I do. And I actually think I handle my shit pretty well. All things considered. I don't know how you casually do ketamine on the fucking weekend. And then you're showing up to your classes on Monday and are doing well. Like, I just don't know how people seem to get this about debaucherous and then end up with jobs and lies. But I guess they do it, you know, I guess, maybe just the Ivy League kids are actually smarter than I am. And party, by the way, I'm not saying that what they did is, is or is this not a comment on the rape that occurred? This is, or did not occur? - Well, it's not a comment. - This is a comment on just, I'm almost marvel, I guess the way that people, other people seem to rebound from their drug use or that there's less of a conversation of how like guys don't be doing shit like this. - I always, while I agree with that, I also gotta say, I've always been kind of surprised at the level of risk that these girls take, you know? Like it's, and I do think it's indicative of the fact that we generally are just really not honest with young girls. It's unbelievable. I mean, they just like, we don't prepare them at all for the reality of these situations in many ways, in many ways in life, we're like that with young girls. Society really has like, I think, failed young girls in a lot of ways. And one of them is this, a major one is this, but it's always wild to me. Look, like, okay, any time, if you go out and meet someone and get drunk, someone you just met, you have one night stand with them, let's say. The guy's taken a little bit of a, like if you go to her house, she could have people waiting there to rob you or whatever, dude, you don't know. By the way, that's not the worst scam ever, right? Send a check out to go talk to guys at the bar, bring them back, like, I don't know. Like, there'd be, it's somewhat of a risk, but dude, the risk that women take when they go home with a guy that they just met, like, I just mean you're, the physical risk to you, you are in almost all situations. You are like, totally vulnerable to this guy. You know, you're, and I mean, the level of vulnerability that, like, young girls in this situation put themselves in is kind of, it's startling to me. And I think it's part of it is that they're not like, I don't know, they're, the ideology seems to tell them that they have no responsibility, you know? Like, it's, and in fact, it's victim blaming or something like that, even when it's not entirely clear who a victim is. I mean, she's a victim of something. It's not exactly a, I don't know. It's just a very strange dynamic where it's just kind of like, oh, like, I mean, the idea of like a, you know, a 19 20 year old girl, like going to a pre-party, having six or seven drinks, then going to the frat party, then going to the after party, then being in a situation, then going, I'm going to go into a room with a guy and get naked and hook up with him, but I only want it to go to here, not here. I mean, look, I'm not removing any culpability from the man in that situation. I would absolutely have the expectation of my son that he'd be nowhere near any situation like that. I'd be like, absolutely, like, I cannot even begin to say how disappointed I would be. But like, I'm sorry, that is a crazy situation for that girl to put herself in. And it's wild that we can't like talk about that. Anyway, look, man, the details of this case, of course, as they come out, they're one of these things that are like, it's obviously very murky. Any time you get into a situation like this, it's very murky, but I also do think that like, we got to be honest with women, and we got to be honest about like, look, you put yourself in a situation like this. Like, let's just say, 'cause here's essentially, or some of the details of what happened, right? Essentially what seems to have happened here is that she's still texting with the guy. There's one guy in the group who she seems to be kind of into, and she agreed to a threesome with him and one other guy. More people got involved. She then wants to do it again. She wants to have another threesome with just those guys, but she's like, not the other five billion, ha ha. Let's do it again with just us. I'll say, this is a thing again. We don't teach boys about this. If a girl's willing to do that, you still shouldn't do it. It's not criminal if you do, but you're still kind of taking advantage of her if you do. Generally speaking, girls don't really want that. And if they do, it's kind of 'cause they're broken and they think they want that, but they're quite possibly not gonna like it on the other side of it, you're better off just staying away from stuff like that, man. It's just not good for you. It's not good for your soul. It's not good for the person you're doing it to. It's a bad way to live. That being said, if we're gonna be honest with young girls here, if you're talking about trying to prove a crime, it's already gonna be nearly impossible when you go into a private room, and it's gonna come out to be a, he said she said, type of situation, it's gonna be very difficult to ever prove a crime. And then on top of that, man, if you continue talking to those people and you continue trying to hang out with them and you continue trying to have sexual interactions with them and you continue, it's going to, at the very least, blow open the reasonable doubt question. It look, I'll tell you Rob, this is an area that I think maybe I grew a little bit on, that actually maybe some women kinda convinced me. I used to think like, if, you know, when you'd find out these stories that a girl accused a man of assaulting her in some way, but then you find out that they were hanging out five days later, then you find out that they went out drinking, they were still friends and you go, oh, that totally destroys your story. Clearly, it didn't happen. Okay, that wasn't really fair of me. It was a very male reaction. And maybe that's not entirely fair, you know? Women could, there could be a real situation that even I would consider an absolute, hey, she said no and you did it anyway. That is absolutely, you know, you violated her. That was criminal. And maybe that girl doesn't want to admit it to herself. Maybe she feels pressure. Maybe she feels embarrassed. So she still goes back and hangs out with the guy. But then later, she's like, now I've figured it out of my mind and I've worked at the courage. I want to talk about this, that could happen. In fact, that probably does happen. But I think, Rob, is this reasonable to say we also can tell those girls that like look man at that point, unfortunately, it's going to be impossible to prove criminality. You just destroyed the reasonable doubt of this story. And I know that sounds kind of harsh because in some situations, you'll be saying that to a victim and you're not going to get justice for being victimized in this way. But this is true with every crime no matter how heinous the crime is, no matter how bad the victim is. We simply can't just believe all women. You can't believe all accusers. That's not how a society with any semblance of freedom works, you know? Like you just kind of got to understand that if a crime happens to you, especially a crime like that, the only way you're ever going to get justice is if you go to the police right away. And you know what I'm saying? Because if we're not being honest with that, what is the workable system, Rob? There is none. All right, let's get back into the show. - Yeah, you have that problem in other ones. Like if you get into a car crash and sometimes like you have an adrenaline dump, so you think you're fine and you don't go to the hospital immediately and build that case. It's just you're not, you're probably not getting the damages. Like you can wake up a week later.
and find out like a disc is out of place in your back. But if you didn't go, or at least from what I understand, if you didn't instantly go to the hospital to indicate that it was clearly from that, it becomes a pretty hard case to build. Yeah. Now, I mean, that's, yeah, I understand where, and look, I mean, if, um, if you were, if you were mugged and beat up and then you went and hung out with those guys a bunch after I'm sure that would make it harder to claim, you know, but then also just to remind the audience saying that a case is hard to prove criminally does not endorse behavior. Well, of course not. Of course not. No, look, man, no one should be like anywhere near this situation. But at the same time, you get, look, this is the difficult reality that we all face. And nobody, by the way, in the issue, no one wants to have nuanced conversations about this. Everyone wants to be on one side or the other. But the truth is that there is no, you, if you are going to have an environment where people where 18, 19, 20 year olds are getting blackout drunk, regularly having casual sex and casual hookups and they're all partying in these environments. You are going to get both of the following things, both of the following things. You are going to get boys who group women do things to women. There will be times where they say, no, and don't want it. And they do it anyway. That is criminal. And even though it happened in the context of this crazy environment, that person should be prosecuted for doing it because adults are responsible for their actions. Adults in this case being used loosely, but still will treat them like adults for legal purposes. So you will get instances where something, okay, because broadly speaking, broadly speaking, girls tend to not just want to get railed at the frat party. They want boyfriends. Some of them don't admit this, broadly speaking, this is the truth. When you have this environment where girls are just hooking up, what is happening often? Now, you know, if you do this at scale very, very often, not necessarily always, but often girls are giving it up in hopes that them being so cool and being this chick will actually make the guy ultimately like them and want to spend time. Oh, she's the coolest. Oh, she's the best. Okay, so it's kind of that. Then guys, on the other hand, generally are not just looking for a girlfriend. 18, 19 year old guys are driven by trying to get laid. This is physiologically the truth. And so they don't end up giving that girl the thing that the girl kind of wanted after that. And then those girls, given this backdrop of modern feminism, will be, will be convinced by other girls that they were the victim of a crime when, in fact, no crime was committed. And the girl is just lying and saying that it was a crime. When, in fact, it was consensual, she agreed to it, she just wanted something more and didn't get it later. Both those things happen a lot. Both of them happen a lot. Both of them ought to be criminal. The one case, what the guy did is criminal. In the second case, what the woman is doing should be criminal. You can't try to deprive someone of liberty, try to get their life ruined and have them thrown in a cage when they didn't do it. That's evil also. And so when we have both of these problems, we can't automatically know which case you're in. There's got to be some process of figuring out which one one, you know what I'm saying? In one scenario, someone is victimized. And the other scenario, someone's accused of victimizing someone and didn't. So when you have a scenario like this, look, it comes out that, did you, did you read the part that the frat president basically did the right thing and put the caboch to the whole thing and said, she can't come over anymore. And you guys can't do this here anymore because this is too risky. This is good. This is not OK. And then that's where it seems to have really popped off. When she was still being allowed back in, it didn't seem to be a problem. And so just that right there, you go, look, we have no way, we have you on record saying this was consensual. We then have you attempting to hang out with the guys again. And then at a later date, you change your mind and determine that this was an assault. I think it's very reasonable to say, the only way to have liberty is to say that if we're going to punish someone of a crime, we have to prove that that crime committed and we can no longer prove this crime was committed. And I think we should be really honest about that with women, you know, and tell them that like, yo, don't put yourself in this situation. You're not even going to have any recourse if you do. I don't see what else is the is the answer, Rob? Yeah, I'm going to wait for more details to come out in court. Yeah. No, that's not bad. Well, here's who's not waiting for more details to come out. Let's let's check in with AOC immediately. Of course, just jumps on top of this. Seven men drugged and gang raped a 20 year old woman. They lured her in to a fraternity house. They drugged her with ketamine. They then posted to a group chat that she was incapacitated. And seven men took turns gang raping her for seven hours. Seven. Okay, I let's pause it right there. I this is really Rob, not one of those statements is true. Dude, not a one and nobody including her is claiming that a one of those statements is true. Nobody is claiming they lured her there. We have the text messages. They didn't lure her there. Nobody is claiming she didn't consume the drugs voluntarily. She has admitted to this. This is not even an in question. Nobody, well, I guess she is now saying nobody is actually saying it was all seven. Initially, she said it wasn't. Now she's saying she doesn't remember it might have been, but it's certainly no one is like conclusively. It was all seven. I believe the claim is that initially there were two that were consensual, but now they're wrapped up in the claim because they might have partaken in activities after the next two that were were that she was then a no too. Right. But the idea that someone had given her drugs and she passed out and then seven people just had sex with her is definitely not the claim. That is not true. Also, the message that they posted did not say she was incapacitated. That is a huge deal, man. Like they intentionally try to like kind of, you know, like slip these things together, but it's not, that's not right, Rob, that's not at all what happened. I mean, objectively. And so I don't know. I mean, I'd say I don't know if I ever, I don't know if I ever have said this before. Maybe I have. I'm really not a litigious person, Rob. Like I hope they sue the shit out of AOC for this. Didn't they be, I mean, this is like a crazy thing for a sitting Congresswoman to say about something that happened in her, you know, well, I guess, I don't know, whatever. It's not, I don't know if it's in her district or fine, but whatever. She's a, she's a Congresswoman of the state in question here. And it's like, you're just going to say you're just saying these boys committed this horrific crime when it's not even clear they committed a crime at all. Like this is like, I don't know. There's something about like this reminds me in a way of like the Covington Catholic schoolboy thing, although I get that guy was a complete innocent, so I shouldn't lump him in with them. But the way that they'll just like go after like ruining a young person's life, you know, who's like, is a citizen. However, you feel about them is entitled to like a fair trial of some sort before the like and not only that, but she's just getting it wrong. She's not even giving like the most dramatic version of the alleged victims story here. Just right. Just make up whatever you want. Make it the most fanciful thing. I do got to say, man, this is the Democrats going into win here. This is that's why I prefaced it like that at the beginning. Like it does do it. This is a thing that could backfire and turn a lot of people off, man. People are over this shit. All right, guys, let's take a moment to think our sponsor for today's show, which is Bub's natural. Do you feel like your strength or muscle tone is harder to maintain than it used to be? Does recovery from workouts run sports or even just a long day take a little bit longer than it used to? Maybe much longer. Do you feel like you need more support staying focused, energized, mentally sharp? Well, if you've noticed that once you hit your 30s or 40s or beyond that, your body just doesn't bounce back the same way it used to in your 20s, you might think there's nothing you can do about that, but you would be wrong. So let's talk about creatine for a second. It's not just for bodybuilders. Creatine is one of the most research supplements in the world. It helps your body produce quick energy during high intensity effort, which means it can support strength, power, lean muscle growth and recovery, whether you're lifting, running, playing sports, or just trying to stay active. Creatine works to power your workouts and recovery by replenishing your body's natural energy currency, ATP. And beyond the gym, creatine also fuels the brain by supporting focus clarity and cognitive performance, especially when you're stressed, tired, or running on fumes. And Bubs does creatine the right way. Bubs creatine mono hydrate is made with with Creapure, the goal of the game.
standard for pure creatine monohydrate. It's sourced from the world's most trusted creatine manufacturer and made under strict quality controls. So live your life better, longer, and for a limited time, our listeners can also get 20% off at Bubs Naturals by using the promo code Problem at checkout. Just head to BubsNaturals.com. That's B-U-B-S, Naturals.com, and use the promo code Problem for 20% off your order. >> Yeah, I think it's way too early to hop on to the story of this lady was clearly right by seven men. I think that's a false narrative, which is not to say that something didn't take place later. I'm waiting for more details on the story, but just for AOC to hop on right away and go, you know, all of these individuals at the frat were clearly, I mean, if you want more of a moral conversation of what's going on in our society that people are ending up in these situations or culturally we got to make changes, but that's a different conversation than a New York rape laws and whether or not seven men raped this one person. >> Yeah, yeah. Here, let's do the mom Donnie's tweet. As mom Donnie, of course, had to post about this. Do we have, did I, I thought I sent that to you, but I could be wrong actually about that. Not only sorry, just as I said that across my mind that maybe I didn't send it. Oh, I did. Okay, there we have it. Okay. The allegations in the Cornell sexual assault case are deeply disturbing and gut wrenching. Cornell University has failed this survivor. I fully support Governor Hockel's decision to name Attorney General James a special prosecutor in this case and look forward to more of the complete and extensive investigation that is to come. Accountability and justice cannot simply be values. They must also be delivered. And look, okay, not as egregious as AOC, but I'm sorry, like when you call her a survivor, you're calling them guilty. Like that is implicit that she was the victim of this crime and if she was, then they're guilty of the crime. This is, this is wild. You should be ashamed of yourself to be a political leader and weigh into something like this. Again, there are two errors that we have to control for here, not just one. It is true, Rob, that if this woman was, if something criminal did happen, then that's horrible and people should be held accountable. But it's also the case that we got to be concerned about saying people who weren't criminal were. And I got to say, man, in this case, the evidence points in the direction that nothing criminal happened here. So this is crazy to have politicians leading the charge like this. Yeah, and I think maybe Natalie can look this up, but I think Latita James already made a pretty, a common along lines of not pursuing justice and investigating the case and more, you know, making sure that the people are being held accountable. It's just a, yeah, it's, there's something really disturbing about like politics leading like prosecutions in this manner. Just, just not the way it should be done. Let's play. I just sent the clip over from CBS this morning. They, I thought this was a fairly interesting. Let's, let's check out their coverage. I heard the D.A. say that he wants to see if anything was omitted. If it was in fact omitted, does that give him, does that clear him of how he's handled this case? No, not in my opinion. Look, we can sit here and parse her words at infinitum. The fact is, I thought we were in a place post me to where we understood that this trope of the perfect victim doesn't exist. We now really do understand that in the wake of trauma, a victim can behave in ways that, you know, aren't necessarily, don't necessarily make sense to us. We know from Harvey Weinstein, victims can text their, you know, accusers are, you're there, excuse me, their rapists, after the fact they can engage in safe flattering things to them. Absolutely. To try to reconcile what potentially happened. And frankly, she may not be the one in the best position to decide whether or not what happened was illegal. I mean, the, D.A. has sort of, you know, in my opinion thrown her end of the bus in ways, you know, saying, well, she can't come to those legal conclusions. Okay, well, this statement of what she thinks constitutes criminality. Well, that's a legal conclusion as well. And the point is, we're not sitting here rushing to judgment about what took place. We're not, we shouldn't, we really shouldn't, we should let the grand jury sort that out. But at the, at the heart of it is how this investigation was handled. Gone are the days when distributaries are only inditing stranger rape cases in the back alley, right? We have a nuanced understanding of really a picture of what a sexual assault looks like on, for example, a college campus. And there should have been more investigation period in this case. I mean, you said, you know, Gone are the, the me two times. There's no perfect victim. But there are text messages between this alleged victim and some of the, you know, alleged rapist. And one of them even says, I'm going to quote here, she said none of the sexual stuff with illegal. She said that, you know, she would be open to doing something with them in the future, except not with the five billion men and some ketamine. How does that impact the potential prosecution? And one of the one of the accusers appears to be apologizing. Look, I'm sorry that that went down that way. Right. It's not apologizing for nothing. Exactly. And again, you don't go to the police. You think nothing happened. Yeah. Again, parsing her words. Look, we don't know if what happened was illegal. It's, it's, it's an issue of what actually happened. You know, this volunteering toxication. Again, some of those statements, she doesn't remember what happened, right? And this idea again, which I would say is, is, is sort of this 1950s idea of, okay, if you voluntarily take drugs and alcohol, but that's sort of an invitation for carte blanche for the rest of the evening. Yes, maybe she wanted to, and I think it looks like she did want to have some sort of sexual encounter that evening. The issue is that's not a blanket consent for everything that happened there. That's the point. I mean, I just go, look, dude, it's, it's, first of all, it's obviously a straw man. Nobody ever has made the argument that once you take a drug, you've get sent into anything that happens for the rest of the night. The point is that once you take the drug, you're responsible for what you do consent to for the rest of the night. That's the only position that I think is reasonable here. But Rob, don't you find it kind of interesting. And again, I'm not saying there's nothing to what this woman said. I'm sure after people are traumatized, they can have different sorts of reactions. But literally, just think about how much you have to be bending over backward here. That she, the woman, as she's sitting here saying, look, after me too, we have to believe these women, not every woman's going to fall into the perfect victim model. Obviously, rapes can happen in these ways that aren't just the ski mask in the alley or whatever. But then she's confronted with the piece of information that the woman in question said in her own words, it was consensual. And then she goes, yeah, but you don't go to the cops if you don't think something happened. Rob, one of those things is evidence and the other one is not. You going to the cops is not evidence. I'm sorry. That's not how that works. You can't go to trial and go, first thing, exhibit A, I want to present, this is how you know this guy did it. She says so. She went to the cops. That's not a piece of evidence. However, her saying nothing illegal happened is. Sorry, that just is. Right? You can, you can spend a big fancy like story around that, but that is just, I'm sorry. That's kind of what it looks like. It's funny. As a society, we should just do legal consent video and form documents before casual sexual encounters. And the funny part about that is that women would hate it. They would ruin it for them. They would absolutely hate it. And it doesn't really, I don't know. Does it even like help it anyway? I mean, I think that you're, you know, I think one of the reasons why this is, this is getting a lot of pushback. Okay. There's a couple things that are going on here. Number one, I think that there's been a history of this happening, whether it was with even with Trayvon Martin or Michael Brown or, you know, the Duke LaCrosse case or just a million different wanna brawley type hate crime hoaxes and all this stuff. There's this thing where, essentially, a story gets told to you, the way AOC told you that story. This very sensationalized, crazy victim, you know, story. Then you find out the real story is not at all that. In fact, they were just lying to you about it. And the story is totally different and totally more complicated and more nuance than what you thought. That's one thing. And then the second thing is like, and I do think you mentioned this earlier, Rob, when you pointed to the, the Clancy situation. I do think there's this feeling that like, there's this like, no matter what, the men are wrong. And the women are excused, no matter what the behavior is, no matter what the situation is. You know, it reminds me in the Duke LaCrosse case, Rob. It was like a case study. There was people, you know, people on the left love to talk about like white male privilege. What's more white?
What's more male and what's more privileged than a duke lacrosse team? The woman involved was a black hooker Pretty marginalized, you know like The face of privilege and the face of a marginalized, you know person and yet everybody rushed to to agree with her and Totally just pellery the boys I don't know there's something kind of interesting about that and in a case like this I just think like if we're gonna If we're gonna take this attitude that this girl was a horrible victim and these boys are these horrific criminals Then I think we got to have a much much bigger conversation about college hook-up culture and you know It's I don't know Rob. Isn't it a little bit crazy to Let's see this if there was an incident of racism On a on an Ivy League campus. It would be cracked down on a media play But a story like this will not put an end to drunk hook-up culture even in campus related You know like sanctioned fraternities and stuff like that and parents will pay $30,000 a semester for this privilege Maybe more than that. I don't know what what Princeton cost these days. That seems very very strange to me All right, sorry go ahead. Yeah, that's a weird thought I get what you're saying where it's like if I if you were let's say a woke parent and there was a racist incident on a campus and The conversation was just around the legal legality of holding those the people engaged in and let's say criminal racist behavior accountable without some sort of a college effort to make the campus less racist Woke parents sending their kids to Berkeley will be it might just be like this is not the right campus for me And culturally speaking people hear about behavior like this and they don't go well this is This is what I view as depravity And so my kid should not be on a campus where such a behavior which I guess speaks to that culturally and socially People are not that concerned with you know that people are having sex outside of relationships Yeah, well, it is let's say it's it is a dangerous environment, I think And I do think it's kind of tragic when like young girls get used and hurt in this way I just also don't think it's fair to like listen man I Can expect a lot out of Out of different groups of people But like the expectation that like college guys are going to drunk college guys are going to be perfect gentleman is one that you should not have And is that is not a good one to have and I think it's wild for people Particularly, you know like I said before in my position of like thinking about like oh kids like having kids now having you know Inherited this crazy culture and it's interesting that a lot of people I think are are rejecting it But you know, this is this is going to be one of those things to rob that I think over all things like this do have the effect of Really really just not making like it's not good for the young boys and it's not good for the young girls I don't think this makes any of them happier and I don't think this makes any of the better and and situations like this It becomes like the way they're encouraged to kind of like Like meat is like through hookup culture and then this is like a land mine fields where people are like worried about like assault or assault allegations or things like this and it It just seems To be like if you just looked at it on paper you'd go oh this is just evidence of a society that's lost its mind Um, and this is how it's manifesting. I'm sure it seems that way to make anyway curious on your thoughts catch you guys next time Don't forget to go see rob on the road next couple of weeks porch tour.com Check out run your mouth as well, and that's all for today catch you next time peace

Summary:
FAQs
No, Donald Trump did not say it's okay to nuke cities like Los Angeles or San Diego. He used a hypothetical scenario to argue that a war would have been even more costly than the current one, suggesting that if he hadn't intervened, a nuclear strike might have been considered. This was not a literal endorsement of nuking cities.
Dave Smith argues that Trump's statement was a rhetorical device to justify war by suggesting that a nuclear strike would have been a worse alternative. He emphasizes that Trump never said or meant that cities would be nuked, and that the claim is a misrepresentation of his actual words.
Dave Smith believes the criticism is unfair because it misinterprets Trump's fragmented speech as a literal endorsement of nuclear war. He points out that Trump's statement was a metaphorical comparison to show the cost of war, not a call to action for nuking cities.
Dave Smith criticizes Ben Shapiro for implying that Trump is controlled by Israel, arguing that this is a dishonest and damaging argument that undermines the Republican party and fails to address real policy issues.
The controversy centers on claims that seven men drugged and raped a woman at a fraternity party, but Dave Smith and others argue that the claims are exaggerated or misrepresentative of the evidence, noting that the woman admitted to consuming ketamine voluntarily and there's no proof of a full-scale rape.
No, Dave Smith believes the allegations are not proven and that the narrative is being oversimplified. He emphasizes that the evidence, including text messages, shows the woman was open to consensual activities and that the situation is complex and not clearly criminal.
