Smoke Boy Andrew Wilson Crushed Again; Smokehouse Rumor Lives Another Day - Ep 168

Bob, just getting back from an Icelandic sea fishing trip. Oh, I'm sorry. That's the wrong show. No, I just got back from a wedding, guys. I got back from a wedding, and it was absolutely beautiful. A beachside wedding and family and a lot of fun. So I appreciate you guys bearing with me for a few days while I was out. I forgot how to podcast. Everything sounds weird in my ears. Took me forever to get everything lined up. So if I was a minute or two late, I do apologize, ladies and gentlemen. I do apologize. I had everything broken down before I left, and now I am back. Now I'm back. Yeah, I did get a little sun. You can see that. I got a little sun. It was blazing hot. I was in Southern California in the La Jolla, California area, and it was blazing hot. I mean, blazing hot. I was on Pacific time, not God's time. And let me tell you about Pacific time. It sucks. Everything's too early. But it did come in handy because the night after the wedding, got back to the hotel. It was still early because everything happens early. In California, everything's over by normal times. And I settled in just in time to hear Diligent Denizen absolutely dismantle Smokeboy. It wasn't even close. It was a systematic destruction. We'll go through some of it tonight. A systematic destruction of Smokeboy and his. Let me turn this delay up just a little bit. Smokeboy and his. There we go. I don't know if that's going to help or not. It might make it worse. A systematic. A systematic destruction of Smokeboy and his ludicrous decision to try to make Candace Owens somehow responsible for what everybody on Earth believes. I don't understand where it's coming from. I don't understand what the methodology behind it is. I don't understand where he's headed with it. But we will explore it. I did lose my voice a little bit. Airplanes tend to do that to me. And it was a couple of long flights. So I apologize. But I will do my best to stay. Focused and engaged, ladies and gentlemen. Focused and engaged, even though nothing's in the right spot in this room. I'm going to go through a bit of an opening, but it's a little different than an opening. It's not going to be a prescripted opening. It's more top of mind. Just on a thought I had on the airplane on the way back after listening to Smokeboy v. Diligent Denizen. You know, after you watch somebody. I actually watched that two times. I started watching it a third time today. After you watch a systematic destruction of another human being, it causes reflection in life. It causes reflection in life. And it's hard to sit back and watch somebody manhandled and not have some moment of reflection. And that's exactly what happened today. I had a moment of. Actually, on the way back on the airport last night, I had a moment of reflection. I started thinking about where this case is, what it is that people are trying to accomplish. Is there any sort of. Well, let me get into it. Let me get into it. Because this is kind of how I wanted to open. Again, I don't have any prepared script. This is all top of mind. But I find this case unusual. I find this case unusual. I've watched a lot of true crime stuff in the course of my life. I've watched the O.J. Simpson trial. I was in high school during the O.J. Simpson trial. There were very strong opinions on both sides of the O.J. Simpson issue. We had people who were convinced O.J. Simpson was guilty and still to this day remain convinced O.J. Simpson was guilty and he killed Ron Goldman and Nicole Brown. And he got away with it. Now, O.J. has since passed away. He did serve a little bit of time for stealing his own Heisman Trophy back from somebody in Las Vegas. But there are a lot of people who are upset with that verdict. A lot of people disagreed with it. They saw O.J. as sort of emblematic of a jury run amok. In this case, instead of a jury run amok convicting an innocent man, a jury run amok setting free a guilty man. I actually fall on the other side of that. I don't think O.J. did it. I think he was covering for someone he knew and loved dearly who he loved. He thinks may have done it and who I think may have done it. But if you're saying you think someone else was involved in a murder, they should sue you. Well, that's kind of what this feels like right now. It feels like there's a legal landmine being set up for everybody. The deployment of Andrew Wilson, a.k.a. Smoke Boy, a.k.a. Pickles, a.k.a. Small Forearms and Little Bitty Hands. The deployment of Andrew Wilson into this entire case really has uncapped. What it looks like to me is some sort of a legal strategy to try to trap people through debate or conversation or provocation into saying certain things that could cause them legal harm down the road. I don't understand the thought process behind that. We have a proud history in this country of news and commentary covering controversial topics. And largely, when the commentary covers those controversial topics, people give them sort of free reign to speculate, free reign to speculate. Now, if you guys remember the Nick Sandman case, do you remember that case? It was a 16-ish-year-old kid. I don't know if he was 15 or 16 or 17. Looked like he was middle high school age. He was on a class trip or some sort of trip from Kentucky. And he was visiting Washington, D.C. And while he was there, they happened upon a protest. The protest sort of spilled out of control, and it had a lot of racial overtones to it. It was back in 2020 during the Black Lives Matter, summer or somewhere near there. I don't know if it was 2020 or a couple years before that or a couple years afterwards. But there was sort of during Trump won this aura that every protest had to have a racial element. You couldn't have a protest unless it was, well, the feminist element as well, unless it was women or it was some sort of minority protest, immigrants or black people or religious minorities. Everybody had to protest Donald Trump in their own way. And every protest had to devolve into a protest against Donald Trump in some way. And so Nick Sandman, and his classmates from, I think they were from Covington, Kentucky, they happened upon some protesters or some people that were there protesting. One of them was banging a drum. And there was some, some footage that showed up. I did an opening on this, so I don't want to go too deep into it, but I did an opening on this several months ago. But the, the protesters started banging a drum. And when you watch the expanded video footage, it looked like he was sort of being the aggressor in the confrontation. Sandman did not want to get involved. He just kind of stood there and smiled. And the news media ran wild with it. They started saying he was racist, that he was the provocateur, the provocateur, whatever that means. He was the one provoking it. They started saying he was, I mean, they said all kinds of horrible, awful things about this kid. He was a private citizen, somebody who's not in the public eye, who was in high school. And all of a sudden he is sort of the face of the racist right, so to speak. And he's filed a lawsuit. And I think he got some pretty good settlements. I don't know that any of them actually went to trial. I think a lot of them settled out, settled out of court. And I think it was in the eight figure range, if I'm not mistaken, very high settlements. And a lot of people looked at that and said, that's great. Including your humble host. I thought that was, was relatively justified in that case. Here you have a private citizen who's being labeled a racist, not hinted at that. He was a racist, not asking, could this have been racially motivated? What really happened here? Are there expanded clips? Are there more video footage? Is there audio? Uh, have we talked to anyone at the scene? What do they have to say? Nothing? Nothing like that. There was no investigation to it. It was just conclusion. He's a racist. And, and so I thought in that situation, when you're a 16 year old kid and you're being branded a racist in front of the entire world, well, that's harmful to your employment prospects is harmful to your friendship prospects. Frankly, who wants to be friends with an avowed racist? Um, it's harmful to your dating prospects who wants to date or marry an avowed racist. I mean, it, it, it definitely harms your life. It, it sort of begins shrinking the available social and employment pool available to you for the rest of your life. Uh, the internet's forever. Don't forget. And so in that situation, I looked at it and thought, well, that's probably right. He should be compensated for that. They should apologize and he should be compensated, but OJ Simpson was different. OJ Simpson. A lot of people have called him a murderer. A lot of people have joked online, uh, that he's a murderer. Um, a lot of people have done comedy routines. Dave Chappelle famously did a comedy routine about the three times he met OJ Simpson. Uh, and it was hilarious by the way, Dave is, is a master of, in his, in his prime, Dave is, is one of the top, probably three to five comedians on the, on the planet right now. And it was hilarious, but the entire premise of the joke is that OJ did it, right? I mean, that, that was the premise of the joke, um, and that he's crazy and he got away with it and, and how it affected Dave Chappelle when he was in his presence on those three occasions. So did OJ Simpson run around suing everybody for suggesting he did it? No, no. Why? OJ is a public figure. Hey, it's a, it's a very high burden if you're a public figure to file a lawsuit against Dave Chappelle. I mean, he's a public figure. and I'll agree that there's a degree of problem in her life here, but how will the jury find that? And if the jury finds that she's not ultimately criminally responsible for taking their lives, does she have a cause of action against everybody who says she is? Well, I mean, would she even pursue that? I don't know. I don't know. I don't think so. I don't think so. I don't think Clancy versus Colvette or Clancy versus Sneff would be a very sexy lawsuit. I think it would be legally problematic, and beyond that, I think it would be socially problematic because it undermines the great American tradition of commenting on public crimes. It's no different than the Karen Reid trial. A lot of people said she was guilty, and then the jury found she wasn't. A lot of people wonder, does she have a cause of action against all these people? I mean, maybe, maybe. And I think that's what's happening here in this case. with Charlie Kirk, but it's taking on a little different spin because the people who are threatening to sue or talking about suing are not Tyler Robinson. Tyler Robinson, for his part, has said nothing about anything, nor has his family. They've been very quiet, very mum behind the scenes and in public. Rather, it's the hangers-on. It's the people around. It's the people that you would have never heard of but for Charlie Kirk. It's the Andrew Colvettes, the Blake Neffs, the Erica Kirks, and frankly, Erica, despite your desire to be famous your entire life, nobody knew who you were until he died. Not very many people. Maybe a few people that knew Charlie and just knew who his wife was, just like people who know me personally and know who my wife is. But my wife is very much not a public figure. She doesn't come on camera. She doesn't have a blog. She doesn't have social media. She's private. She raises her kids. And, you know, for better or worse, that's what she does. And it's those people. It's those hangers-on. It's the people in the periphery. And the question becomes, do we have the right to speculate? Do we have the right to ask any questions? Or is any question at all become a grounds for a cause of action? Take the Brian Harpoel versus Candace Owens suit. I mean, it's pretty cut and dry that if you're hired to protect somebody and they die, you necessarily failed in your duty to protect them. Now, whether the duty was your fault, legal fault, or whether your duty was some sort of moral fault, that's to be determined by somebody else, but simply stating the fact that you were hired, I always mentioned the barbecue guy. If I hire a guy to do barbecue and he doesn't show up at my house with barbecue, he necessarily failed. Now, he might've gotten a car accident. Someone may have stolen the barbecue. The barbecue may have burned. Maybe his barbecue shed burned down the night before. But the reality is I hired him for one job and he failed. He did not deliver barbecue. That's kind of the situation with the security team and Charlie Kirk. They had one job. Their job was to keep Charlie Kirk very much alive. And that job didn't happen. They didn't keep him alive. He did not leave the arena alive or the, uh, the menorah, whatever it was. He didn't leave alive. So what about the other people? What about other people whose names tangentially come up in this investigation? I'm thinking of, um, obviously the, the owners of smokehouse barbecue or the, the servers at smokehouse barbecue. There's been a lot of discussion and we'll talk about it tonight. Whether or not Tyler Robinson was in Penguich or, uh, or, uh, Penguich, Utah. Was he in Penguich, Utah? Between 18 and 19. I think 45 and, or 8:55 and 9:47 PM on, um, on September 10th, obviously if he was, that's problematic to the state's timeline. If he wasn't, it really doesn't have any impact on the guilt or innocence of Tyler Robinson at all. It doesn't add a fact or detract a fact. It doesn't tend to make him more guilty. It doesn't tend to make him more innocent. If it can be proven, he actually wasn't there at all. He was somewhere else entirely. And so why is everyone getting all been out of shape about this issue? Um, I'm going to play. A lot of clips tonight from a debate he had with diligent denizen a couple of nights ago. And in that, I didn't count the number, but, but I think Andrew Wilson used the words official timeline, like 4,000 times or something, it was some obscene number of times, not really, it's probably a hundred times. Um, but what is it about this official timeline? Why does anyone care what Candace Owens has in her private file and what it's titled, whether it's titled official timeline or unofficial timeline or potential timeline or probable timeline. Why did, why does anyone care what the dadgum timeline is scheduled, uh, is, is titled? Well, the reason they care is because, um, I think because someone wants to get lawsuit happy, the best way to shut somebody up is to make them poor, poor people don't have as loud of a voice, uh, Candace Owens has done very well for herself as a commentator. She's accumulated a lot of resources. She makes a lot of money and she should, she's very good at her job, but if you take that money away from her. All the money that advertisers have given her all the money that, um, that people have donated to the cause. If you take that away and you transfer it over to some other entity, some other organization, it will necessarily lessen her ability to continue producing quality content, to continue investigating things. She's not only investigated the Charlie Kirk case, her public life. She's investigated a whole lot of things and she's done a pretty darn good, a pretty darn good job at it. So that's kind of number one, it seems like they want to, to side silence people. Seems like they want to quiet the crowd either through lawsuit or threat of lawsuit, but it's interesting to me, which items they key in on, which items they key in on. They're very much keyed in right now on this Penguich smokehouse visit, the, the cowboy smokehouse visit. There's a, there's very much a key point of contention right now. Well, the reason may be because they know he wasn't there. And so this is an easy victory. You know, we have proof he wasn't there. Let's let's make a big deal out of it so that when it turns out, he wasn't there. Everybody looks foolish. They have egg on their face. Okay. That's kind of number one. But number two is it could be because it absolutely matters because if Tyler Robinson was there and they don't know whether he was there, but if he was there, it creates a real problem for their timeline. That's an option as well. Both options are on the table because right now we don't know. We have an eyewitness who says he was there. And we have a lot of people who through no eyewitness testimony at all think he had to be somewhere else. Okay. Well, let's let the chips fall where they may. Let's wait until the evidence comes out. Let's see what happened. So that's one thing they've keyed in on, but they've keyed in on a few other things. If you notice very early on in this investigation or several months ago, many, many months ago, there was a question about whether Erica, where Erica Kirk was on the night of September 8th, night of September 8th, we had an eyewitness who places her in Southern Arizona near Fort Huachuca. Well, if she's at Fort Huachuca on September 8th, that's problematic because she's denied being at Fort Huachuca on September 8th. So again, now it's an issue, but they've keyed in on it. They attempted to provide some photographic evidence, but it turns out that photography was from the next morning, or at least it was dated the next morning. So it didn't really answer the question of where were you on September 8th. I think through a lawyer, maybe she said in a letter to Project Constitution, if I recall correctly, one of her lawyers, either a male or a female, I don't remember the name of the lawyer, we'll call it a she because I don't remember, but she said that Erica absolutely was not there and was not anywhere near there at that time. Okay. That's a data point. Fair point. But that's another thing they'd keyed in on. Another thing they keyed in on was where was Andrew Colvette at the moment of the Big Bang? Was he in his house like he claimed, or was he on an airport tarmac in Santa Barbara getting ready to leave to go to Scottsdale instead of Provo? His official story is he flew directly to Provo with his wife on a later flight. But there was that mysterious earlier flight, and it doesn't seem to have any reason for being in Santa Barbara and then going to Scottsdale. Why was he on that earlier flight? Who was on that flight? Why did that flight exist? It obviously took TPSA people from Scottsdale up to Provo in the morning, and then it went Provo to Santa Barbara, Santa Barbara back to Scottsdale just in time to catch another flight from Scottsdale to Provo. So it raised the question, and that's another thing they chose to address. There's been a whole lot of things in this case they've not chosen to address. They haven't talked about it at all. Where's the Rode microphone? No one's talked about where the Rode microphone is. That's not something they want to discuss. Where's the audio? They don't want to answer the question, where's the audio? Did Terrell Farnsworth alter or somehow change the photography that was in the camera behind Charlie Kirkwood? They haven't talked about that. They haven't talked about that at all. Where was Blake Neff that morning? He said he doesn't know, and they've never mentioned it again. So there are a lot of things they haven't talked about. These are serious questions. A lot of people have raised these questions. They've asked these questions, and they've not been discussed. It's the ones that they key in on. It's the ones that they provide some sort of an explanation to that raise my suspicion. Primarily because in each instance, each of these things I've named, the September 8th whereabouts of Erica Kirk, the September 10th whereabouts of Andrew Colvette, whether or not Tyler Robinson was at the Penguin Smokehouse, and finally, one more that they raised. What was it? It was one more thing they raised. Oh, the text messages the night before Charlie Kirk passed away. Allegedly, he has sent some text messages saying he was scared the left was going to kill him. Well, each of these things that they've addressed, they've chosen not to address themselves. They've gotten it out through third parties, and that's important. That's an important part of this analysis. Why would you put something out through a third party when you could just release it yourself? Andrew Colvette has a very active X feed. He's the press person for TPSA. He could easily put out a press release. They do that all the time. They put press releases out. They put stuff up on their website. They put stuff out on X. Why would he put it out? put it out through a home improvement blog. blogger or some failed podcaster or some failed debater? Why would you put stuff out through these people instead of just releasing it yourself? Well, you're creating a buffer between you and the information. I've got the information here. Now I'm putting a third party in between the release of that information and me. You guys are out here. You'll get the information, but it won't come directly from us. It's going to come through a home improvement blogger for some reason. It's going to come through some failed debate strategist for some reason. That some reason has my mind absolutely reeling. I've never seen this before in practice. I'm not familiar with this game. I can't ascribe any kind of motive or strategy behind it. It doesn't make sense to me. The only thing I can say is because it's so unusual, it makes me wonder if there's something nefarious to it. That's an opinion. That's an opinion. In this country, we still have a right to an opinion for right now. We're allowed to state opinions. I'm allowed to state an opinion that I find Erica Kirk a pretty dishonest individual when you look at her biography, her statements, what I think are demonstrably false statements. So I have a basis for saying that I think she's dishonest, but I find her to be a dishonest person. That's an opinion. Am I calling her a liar? Well, I mean, even if I'm calling her a liar, it's my opinion that she's a liar. Okay. Well, I have an opinion that there was an airplane that flew from San Francisco. I don't know if it's a plane. I don't know who was on it. And I also know that Andrew Colvette had a prerecord for the second hour of the Charlie Kirk show that day. So he would have been available to be on that plane. I think it's reasonable to ask if he was on that plane, particularly in light of Candace Owens saying that Andrew Colvette told her, Andrew Colvette told Candace Owens that he had a hug on a tarmac with Erica Kirk. Now, maybe Candace is lying. Maybe Candace is mistaken. I don't believe that's the case. I have faith in what she says. So I believe he said that to her. And I believe she accurately relayed that to us. And if so, that's the only time I could put them on a tarmac together. I can't put them on a tarmac anywhere else. So was he on that earlier flight? Well, I have an opinion he might have been. Does that mean I'm stating that Andrew Colvette was in on a murder? No, no. It means I'm raising the suspicion that he could be. He could be. a lot of people could be, right? We've asked this question about a lot of people. Could they have been ahead of the game? Could they have known something was coming? Well, is that calling someone a criminal? No. No, it's not. I've never said that anyone has been in on this. I haven't claimed that the military was in on it. I haven't claimed that the federal government was in on it. I haven't claimed anybody's in on it. I've asked a lot of questions, some of them very hard questions, and some of them have a lot of factual basis for me to want to ask the question. I think the question should be answered. But I'm intrigued by this new strategy of release stuff through failed podcasters, release stuff through failed home improvement bloggers, release stuff through failed debate strategists, in order to try to counter the narrative. Well, color me shocked if I don't believe this stuff. I'm not saying these people are lying, but, I mean, I don't believe that the story is as simple, cut and dry on its face if it was, stand behind it and say it with your chest. Release the statement yourself. We'll look at a legal letter tonight that was sent from some health care company stating that Erica and her mom were together at this place. Okay, great. You know, that's fine. I have no issues with the letter at all. My issue is why did it come through a failed debate strategist who purportedly does not work for TPSA? He claims he doesn't. So what's he doing? What's he doing with his letter? And why is he the one that was chosen to release it? So I want to get into some of this stuff. I want to run through some of these failed debate tactics in trying to dispute the Penguich narrative. And I also want to run through some of these. I want to run through the letter. But first, tomorrow we have a big hearing. The big hearing tomorrow. It's the finality of the hearing. The preliminary hearing will come to a close tomorrow. I don't expect there to be any new. I don't expect there to be any new evidence. I think that would be shocking. Now, it's possible we'll get a line or two, maybe an additional text that has been submitted in evidence but has not yet been released to the public and it will come out in the summation. That's possible. It's possible we could get a line or two, new line from the medical autopsy, the examination that took place after Charlie passed. It's possible we'll hear something from that. But the likelihood is we've already heard all the evidence or the vast majority of the evidence. I don't rule out that we could get some new stuff tomorrow. We'll have to listen carefully as it's going on. It's scheduled to start tomorrow at 10, 10, 8, excuse me, 11 a.m. God's time, 10 a.m. Mountain Time, 9 Pacific and 1 p.m. Eastern Time. That's when it's scheduled to start. Excuse me, 12 p.m. Eastern Time. Don't worry about the time. Just let's go on God's time, 11 a.m. God's time. I think each side gets a couple hours. I think it would be overkill if they took the whole two hours, but they get it. You know, it's their time. So assuming they get, two hours and a break and two hours, you're probably looking somewhere in the neighborhood of four and a half or five hours total. So if it starts at 11 a.m. God's time, you're probably looking for 3.30, 4 o'clock it would end in time for the evening podcast to sort of pick it apart. So I'll be watching it closely tomorrow to see what happens and if there's anything new that comes out and if there's anything that just has to be discussed. I'm not going to do some live commentary all day tomorrow. I don't think that's a valuable use of my time during the day when I'm trying to put a show together for tomorrow night. The timing is interesting. Erica Kirk's lawyer several months ago, a month or two ago, filed a notice with the judge or filed a motion with the judge saying, I want you to rule on September 1st. At the time, we didn't know what to make of that. That was a very strange request. Who are you? You're not a party. You're a victim representative. You represent the victim who's passed away and you're the wife. So, you know, under Utah law, we give you a say in what's going on. But why are you ordering the judge around? And it was, it was very, very Kirk, very to the point. At the time, I didn't know what to make of it, but now it makes perfect sense. We have the one-year anniversary coming up on September 10th. That's 10 days or 11 days from today. TPSA has morbidly chosen to go celebrate this event at UVU, the site of the crime, not in the menorah itself. They're going to be in the basketball arena next door, but that's where they've chosen to go celebrate the one-year anniversary. I think Glenn Beck is scheduled to be there. I don't know. I don't know who else is scheduled to speak. But it makes sense to me that they want a ruling in advance of that. Because once you get that ruling, you can pretty much take the heat off of, of this notion that he's innocent until proven guilty. They're going to just come out at that point. I think everybody is and be like, well, the judge found he did it. Well, that's not exactly the case. Very low bar to a preliminary hearing. Very low bar, all evidence viewed in light, most favorable to the state. Certainly not the standard at trial. The jury is free to draw inferences in favor of either party at trial. They don't have to draw inferences in favor of the state. They don't have to draw inferences in favor of the defendant. They can draw inferences in favor of either side. Not so at the preliminary hearing. All evidence must be viewed in light, most favorable to the state. And so it's a low bar. It's a low bar. I think it would be shocking, frankly, if Judge Graff did not bind this over to a trial. I think it would truly shock me. I do think the state, I think the state met their burden, frankly. I had a lot of questions about a lot of the evidence, but these are questions that would go towards weight, not sufficiency. The weight of the evidence, not the sufficiency of the evidence. And weight is determined by a trier fact. It's going to be determined by the jury. So that, I think the suspense is already taken out of it. I think the state probably met their burden. I think the judge probably in all likelihood will bind it over for trial. The question is, how is that going to be spun in the media? And you know it will be spun. Any organization who put influencers in that courtroom on the fifth day of the preliminary hearing and watched them go out and, in my opinion, misrepresent what they saw on the screen is probably an organization that's planning to sort of spin the results of the judge binding this over for trial. At that point, it'll take, I don't know, 12, 18, 24 months to actually get to trial. At that point, though, I think Tyler Robinson's in really grave danger, really grave danger. Something happens to Tyler between now and tomorrow. The world will never know whether the judge would have bounded over trial or not. Preliminary hearing is not over. After tomorrow, we'll know or probably know after a few days, we'll probably know. The judge in all likelihood will bind it over for trial. And in a lot of people's minds, that's equivalent of a conviction. It's equivalent of a conviction. And so we will see how they play this, I anticipate them going really hard on the Tyler did it narrative after you think they've gone hard on it so far. Friends, friends, wait, wait, wait. They absolutely. They absolutely will go even harder. But other than that, I don't expect many fireworks. I think it'll be pretty straightforward. I don't think it'll be particularly, particularly crazy. Now, let's go to Penguich real quick. I want to spend some time on this Penguich issue, the cowboy smokehouse issue, and I want to do it in the context of the the pending lawsuits, the threatened lawsuits, and smoke. Smoke Boy's absolute crash out the other night. It was embarrassing. You'll see what I'm talking about. So cringeworthy. So cringeworthy, him talking about this official narrative, this official timeline. And keep in mind, I did not mark every single piece of use of the word official timeline. No, I kept a lot of this out on the sidelines. So let's go to the first use of this here because you'll get a taste of what this entire interaction was about. You'll get a real taste of why it was that I think Andrew Wilson came into this space trying to have a debate or a conversation with Diligent Denison. All right, let me get this pulled up. Would it be a part of an official timeline? Are you going to let me answer your question or not? They answer the question I asked you. Why would it be part of an official timeline? The question is about Candace's use of the word official timeline to describe her sort of, you know, sequence of events that she's investigating. One of the things on that sequence of events is did Tyler Robinson go to Panguitch, Utah at 847 or 855 PM to 947 PM to enjoy a delicious steak at the, a well-respected establishment like Cowboy Smokehouse? That's the question. Did he go? If so, why? And what, what effect does that have on the case? Smokeboy is asking this question. Why would it be on an official timeline? In other words, it's disputed. Whether or not he went. And if it's disputed, whether or not he went, why would you put it on an official timeline? Well, who, you know, who cares what she calls it? Who cares what she calls it? I'm going to make that a little smaller since there's no actual video you have to watch. Here is the second little exchange on this very same topic. Let's try this again. If it's the case that that's unconfirmed, which it is, why is it that that would be a part of an official timeline diligent? Please answer the question. Of course there's evidence. He just admitted. If a witness swears that they 100% ID Tyler Robinson, not only visually, but mostly by his voice, right? Is that evidence or no? In a court case? And so out of all of the evidence or out of all of the Tyler Robinson cases, as a matter of fact, is there any individuals, any eyewitnesses that say they 100% ID Tyler Robinson that day at all? Um, that we're aware of like, you mean on the, we had five days of hearings, right? Five days of hearings. Yeah. Yeah. Is there, is there, was there one person who testified that they a hundred percent ID Tyler Robinson? Just one in the, no, in the hearings? No, no. Okay. So what you're, what you just admitted was, is that, uh, I, I, you know, diligent denizen, uh, with the help of Candace Owens providing the lead have provided the only witness who says that they. ID Tyler Robinson, 100%. And that's a fact. That's a fact. Only one person in this entire case has 100% identified Tyler Robinson, not even Tyler Robinson's roommate. 100% ID Tyler Robinson as being in Orem, Utah. So the only 100% identification that anybody's willing to stand by anyone's willing to put their reputation on the line is a, I, I server at Cowboys smokehouse. 100%. 100% promise. I believe with all my heart that I saw Tyler Robinson. He's the only one who claims with 100% certainty. He saw Tyler Robinson, every single other person hedged the police officer, hedged officer, whole officer Bagley. They all hedged. Well, I'm not sure it looks like him. We believe it's him. We think it's him. Even his own roommate was like, well, he wears jeans. That guy's wearing jeans. He has shoes. That guy's wearing shoes. He's. He's got an affinity for sunglasses. That guy's wearing sunglasses. He wears hats. He's a big hat guy. See him in pictures all the time. He's wearing hats. That guy's wearing a hat. Yeah. I'd say it's him. I think at least in those last two pictures, it looks like, well, what about the other four? There were six pictures. Only two of them kind of look like him and solely based on his accoutrements. Come on, come on. So we have evidence that Tyler Robinson was in Penguich, Orem, uh, Penguich, Utah, a hundred percent evidence. Or at least a guy who 100% IDed him, is that enough? Is that enough to include on an official timeline? Well, let's go back to smoke boy. We'll find out. For the court to decide. Yeah. I'm asking you, do you agree with me that it's unverified? Of course. Yeah. Not that it's unverified, then if it's unverified, why would that be a part of an official timeline? Knowing that it's unverified. Can you answer that question? In other words, just because there's a human being who interacted with this guy for an hour and 100% believes the person he interacted with was Tyler Robinson. Why would Candace Owens put this in her notes? I mean, that's the best I can make of this discussion. I have no, I mean, it's, it's unreal how fixated he is on this official timeline jargon. It's unreal, but it's telling, it's telling why? Because why? Why would he be doing this, but for trying to set up some sort of a lawsuit? now was 14 hours long it ended at like 4 a.m on sunday morning i listened to a lot of it and got up the next morning went to mass on three and a half hours of sleep i figured i'll sleep on the plane i was keyed in i was listening i do this a lot i listen to a lot of these spaces i listen anonymously guys you don't know i'm in there and i hear you bad mouthing me from time to time that's okay no tyler wasn't there that night that's that's that's nonsense i cannot imagine a scenario where that would be permitted now maybe some judge somewhere would let that in but i think that would be so improper in fact witnesses are not there to testify about their opinion that's an objection to the court's decision they're there to opine on what they believe they're there to opine on what they saw heard felt tasted smelled that's what they're there to testify about that's it that's all they're there to testify about they're not there to opine well and based on the fact that i called the fbi and they didn't call me back but and at one point he goes in on this and i'll play a little bit of it this this this other server who isn't a hundred percent sure that it was tyler robinson kind of 50 50 i'm not really sure if it was him or not he said well he could testify about what she said well no that's not at all the case that she would testify about what she said if somebody wants to call her and say were you confident it was tyler robinson she's like i don't know it could have been couldn't have been i don't know i mean it'd be a waste of the court's time but they're welcome to put her up to say that but you can't get the hearsay of of the owner saying well i heard her say that she wasn't sure that's that's that's nonsense that's not how it works all right now i want to back up um sense of why people think israel's involved we don't nobody has made the claim that is israelis there were also you know made the claim well joe kent who i i think would uh have the right to assert it not trying to litigate this issue i'm using this for purely pedagogical purposes the question is is that sufficient to probe are you allowed to form an opinion based on the fact that these things are weird that you're noticing a lot of things that you're not aware of and you're not aware of the lot of weirdnesses and inconsistencies that's what she's saying is i have questions about whether our greatest ally was involved because of these five or eight things however many things she named listen to how he responds uh but we cannot say for certainty that israel called the shots and this is how it happened but it is definitively i think a thread that a lot of us would like to say there's no positive evidence so there's no positive evidence i whatever you want to say are we positive negative however you want to say it like positive evidence would have a conversation material evidence and other evidences which what we've said is on our show is what we said which is we this feels like a No positive evidence that France is involved in anything. No positive evidence TPUSA is involved in anything. No positive evidence that Erica Kirk is involved in anything. What's your best? So positive evidence is a good thing. Well, what is positive evidence? Well, positive evidence would be an eyewitness testifying that Tyler Robinson was at the Penguin Smokehouse or the Cowboy Smokehouse. That's positive evidence. That's the definition of positive evidence. An eyewitness asserting it. Well, what about Smokeboy? Is he a hypocrite or does he hold himself to this same very. very high standard of positive evidence? Well, let's find out here. Let's go to 119. 119.05. Let's listen to what Smokeboy thinks about positive evidence now when it doesn't. when it cuts against him. Oh, but I would never play it without showing it to you. That would be ludicrous. Why would I do such a thing? Why would I ever do such a thing? I would never play a video without showing it to you. Nope. So what evidence is he drawing his belief from? The he there is the owner who now claims he is not sure whether Tyler Robinson was there. The fact that there is no corroborating evidence for this eyewitness. So he's drawing a collusion from a lack of evidence? Not just that. Not just that. He's also saying that the positive evidence that he had sent off, he heard nothing back. So there's a good chance that this was investigated, which is a reasonable inference, and there just wasn't anything there. So he's drawing a collusion from a lack of evidence, correct? No, that would be a collusion from positive evidence. What positive evidence? You said that there's a lack. Yeah, well, no, there's a negation and there's a positive. There's a lack of a response from the FBI. There's a lack of surveillance footage. There's a lack of a name on the receipt. Yeah, but negative evidence. There's a lack of him being there. You see what he's doing? He's holding himself to the same standard. That's negative evidence. There's nothing there. This lack of being able to prove he was there. Yeah. This lack of being able to prove he was there means he wasn't there. No, that's called negative evidence, smoke boy. Do you have any positive evidence? Do I need to play the montage again? Do we need to montage him up? Bro, do you want me to answer it or no? So the way that this ended up happening, the positive evidence, which would be the receipt. You see what had happened was. This was sent. Yeah, this was sent off. And if he gets no response back, that's a reasonable inference. A reasonable inference based on negative evidence. He'd never heard back. Therefore, he infers that it was investigated thoroughly and found he wasn't there. Smoke boy. If Tyler Robinson didn't do it, there's a reasonable inference that there's a multi-agency cover-up. If the evidence that Tyler Robinson was at the smokehouse would undercut or expose the multi-agency cover-up, are they going to get back and say, you know what? As a matter of fact, he was there. We checked this out. That was his card. His cell phone pinged to you. Your cell phone. Your parking lot. At these times. In fact, we do believe that was him. No. No, that's ludicrous. That's ludicrous to suggest that. It's either Tyler Robinson or it is a multi-agency cover-up. That multi-agency cover-up would include the FBI. Now, are you suggesting the FBI is covering this up? No, I'm suggesting it's one or the other. It's either Tyler Robinson or it's a multi-agency cover-up. Those are your options on the table before you today. It's one of those two. And if it's a multi-agency cover-up, one of those agencies is the agency tasked with investigating whether Tyler Robinson was at the Panguitch smokehouse. That's the fact. And so you can't draw a conclusion based on the fact that they didn't confirm he was there if the confirmation that he was there would expose the plot. That would undercut. That would destroy the whole thing. We had people set up. We had high technology in place. We had novel weaponry. We had decoys in maroon shirts. We had insiders at TPUSA. We had a George Zinn lined up ready to take credit. We had a guy going hospital to hospital so we could gaffle the footage. We had all this stuff in place. But doggone it, the guy at Panguitch smokehouse asked us to investigate if that was Tyler Robinson or if that was Tyler Robinson. And we had all this stuff in place. But doggone it, the guy at Panguitch smokehouse asked us to investigate if that was Tyler Robinson or if that was Tyler Robinson or if that was Tyler Robinson. And it was. So I guess we're just going to have to tell the truth and expose the whole plot. No. Now, that was just me speculating. I was not suggesting that's fact. That was opinion. Not even opinion. That was a thought exercise. But if it's a multi-agency cover-up, the agency leading the multi-agency cover-up is not going to expose the plot. And so therefore, any negative evidence from them cannot be drawn a reasonable inference. Not the way it works. Corby had, when he got a call asking about whether or not he had the information related to a full day or I'm not sure if you're familiar with the story, he gave them the information, right? Like when the FBI reached out to him or law enforcement or whatever, I think it was the ATF actually, he never heard back from them. Do you know if it's regular practice for the FBI to contact people who are not directly involved in a case to update them or give them information? Do you know if it's regular practice for the FBI to contact people who are not directly involved in a case to update them or give them information about their investigations? Probably not, generally. That's an omission. That they probably would not get back in touch with the owner to let them know whether Tyler Robinson was there. If they were truly investigating whether Tyler Robinson was there and they concluded he was or wasn't, updating him, updating the owner of the Penguin Smokehouse or the Cowboy Smokehouse in Penguin probably isn't high on the priority list and may not even be proper is kind of what Andrew just agreed to. Does that mean that you can draw a conclusion from a lack of that communication since it's a general practice? You can draw an inference. That's not what I asked. An inference is a conclusion. That you look at evidence and then you conclude what that evidence might mean. That's an inference. That's the definite, I mean, you're just playing word games at this point, Smokeboy. Yeah, so then, yeah, it wouldn't be a conclusion. Okay, so an inference, but we can agree that inferences aren't conclusions. Right? Correct. I disagree. Correct. Okay, so then with no degree of certainty, which is what a conclusion is, the owner is saying that Tyler Robinson wasn't there. Well, a conclusion doesn't mean with no degree of uncertainty or something. That's not what I said. Necessarily, yeah. Inference is not a certainty. What did you say? What did I miss? You disagreed. You can have certainty with an inference, yes. Okay. But not always. So he doesn't have any evidence that Tyler Robinson wasn't there. He's just saying he doesn't believe it because of a lack of response from the FBI. No, it's the opposite. There's no good reason to believe Tyler Robinson was there. So then you're saying that there's no. Except for the eyewitness. I mean, that's what I'm saying. This is such a dishonest actor. He is not being honest. He's twisting the English language. Oh, you could draw an inference based on this, and then the inference itself becomes positive evidence, even though it's an inference based on negative. What? What are you talking about? There's no reason to believe he was there, except somebody said they saw him with 100% degree of certainty. Other than that, yeah, maybe not. No good reason to believe his own employee. Yeah, and there's no good reason to believe that you weren't there. There's no good reason to believe Candace Owens wasn't there. There's no good reason. If you have no good reason to believe. I mean, I talked to him. I mean, you know that. So did I. So did I for a long time. I mean, I was actually at the restaurant. Did he go there? He has no. Do I need to go there? Yeah. I'm muting for a second because they say a foul word. Go there. Try Cowboys brisket. Highly recommend it. Why is it. But if there's no good evidence to believe that he was there, that's a reasonable. Okay, so I mean, that's. And on top of that, why would you add this in to your official timeline? So he said that. He said that his. Wait, I'm just curious. In your back and forth with him, did he say that his server that I interviewed, did he say that that was not good evidence? Yeah, he said that there was no good evidence to believe that Tyler Robinson was there. So he said that he didn't believe his server. This, again, this is a dishonest attempt. One of the fundamentals of debate is both sides have to be honest. The reason the court system works is because we swear people in and make them tell the truth. Now, can they still get up there and lie? Sure. But we have a jury there who's able to look in and say, "I don't think they're being honest." And they can disregard. If they find they're dishonest about anything, they can disregard everything. But the idea is that they raise the right hand, do you swear, affirm, you'll tell the truth, the whole truth, and nothing but the truth to help God? I do. That's it. That's the basis. But when you have somebody who's engaged in these debates and they're just fundamentally dishonest, there's no evidence to believe he's there, no good reason to believe he's there, except the eyewitness, the most assertive eyewitness in this entire investigation, the only person in the entire investigation who 100% certifies that he is 100% confident he saw Tyler Robinson is this server. Nobody in Orem, nobody at UVU, nobody anywhere. The only person 100% certain that they saw Tyler Robinson is this servant. But there's no good reason to believe he was at the steakhouse, even though we have that. But there's good reason to believe he shot and killed Charlie Kirk based on people who are less than 100% certain they saw him. That seems fundamentally dishonest. This is a long clip, and it's getting late. I don't want to play the whole clip. Trust me, the rest of this was a disaster. He started saying that somebody saying, I don't know if Tyler Robinson was there, negates someone saying they were confident they saw Tyler Robinson, as if a neutral statement somehow negates a positive statement. That's nonsense. No logic dictates that you must believe that. No common sense, reasonable person would say, oh, well, he said he didn't know. Therefore, I can't believe. This person. And what Diligent adeptly pointed out was, if you say someone said, I am confident it was not Tyler Robinson, and somebody says, I don't know, does that somehow negate this person? In other words, the I don't know becomes positive or negative based on the certainty of yes or no on this side. And it's ludicrous. It's an absolutely ludicrous proposition. But I don't want to keep going because I'm going to run out of time, and I want to pull up this letter from En Vida. From En Vida. Actually, this is a better version. Let me pull this up. Oh, not that one. Hold on. That's the one I didn't want to. This one right here, Daisy, is the one I did not want to show. I want to show the other one. Can you drop that in there? I want to pull up this letter from En Vida. For those that don't know, En Vida is a natural medical clinic. I'm sure they do great work. I have no issue at all with the work En Vida does. I have no reason to doubt. Anything anyone says there. I want to clarify that because obviously they're setting this up for some sort of defamatory claim. So I want to be on the record that as I look at this letter in just a second, there's a letter we're going to show from En Vida. No, yeah, this is correct. Maybe I clicked the wrong one. You're right. As I show this letter from En Vida, I want to be very clear that I am not defaming anyone, Smokeboy. Smokeboy put this out on his podcast the other day. I don't know what day it was. Again, putting information out, not directly, but through third parties. In this instance, a discredited podcaster who's now 0 for 2 on the big stage. This letter is from En Vida, from the health care center where Erica Kirk's mother is believed to be getting treatment. And I'll just read it. It says, En Vida. En Vida. En Vida Medical Centers independently confirms Erica Kirk and her mother were present at its facility in Scottsdale, Arizona at the time Charlie Kirk was shot. Erica was accompanying and supporting her mother while she received treatment. Charlie Kirk had encouraged Erica's mother to seek care at En Vida, which specializes in precision oncology, the treatment of chronic illness and Lyme disease. All three are terrible conditions. All three, if you have them, I encourage you to seek treatment. And all three of them, I bet. I bet En Vida does the best treatment around. I don't know. I don't know. En Vida is providing this confirmation publicly at the request of Erica and her mother. Well, if Erica and her mother are requesting it, why are Erica and her mother not releasing it? That's my only question. That's one of my only questions here. Why would Smokeboy be releasing it? This whole middle paragraph right here. So if they get it, the request from Erica and her mother, En Vida is providing this confirmation publicly at the request of Erica and her mother. How does it end up in Smokeboy's hands if he's not working with them? He claims to not be working with them. To protect patient privacy and medical confidentiality, En Vida will not disclose or comment on any diagnosis, treatment, medical records, or other protected health information beyond the limited information authorized for release. Question. Can En Vida Medical Center independently confirm anything? Or would En Vida Medical Center independently confirm anything? He released this letter on the personal confirmation of a single individual that they saw or knew Erica Kirk was there. And it's accompanied by a letter that says, you must believe this testimony or you're impugning the character of the person who's making it, who's giving it. Now, think about what we just listened to an hour of smoke boys saying that just because someone is 100% certain they saw Tyler Robinson, there's no good evidence he was there. I want to repeat it because I don't want this point getting lost on anybody. I'll even pull this down because I want you to, I want you to look in my eyes and make sure you understand what I'm saying here, because the irony is not lost on your humble host. We just listened to an hour of a conversation of smoke boys saying, yes, I'm aware the guy at Penguin Smokehouse said he saw Tyler Robinson, but that does not mean there's any good evidence he was there. Even though he went on the record and said, I saw it, I'm 100% confident he was there. Or he kind of went on the record. He didn't show his face and he didn't give his name, but he was standing in the smokehouse and he claimed to be an employee. And Diligent swears that, that the guy was an employee and he's the one that he talked to. And smoke boy says no good evidence he was there. Now, is that defaming that man? Is that defaming the server who said he was 100% sure he was there? I don't think so. Because I think smoke boy's right. You are free to believe or disbelieve anything someone says. But in this case, with Invita, those rules are out. You are required to believe this eyewitness testimony. You are required to believe that Erica Kirk was at Invita. You're required. There's a lawyer's statement that accompanies this that he also released. I'm not going to show it. I got my reasons for not showing it. I'm not going to show the lawyer's letter. But in the letter, the lawyer says, essentially, if you don't believe this, you are defaming his character. I'll leave that up for you to decide whether that's true or not. I'll leave that up for you to decide whether you believe this guy or not. I'm not stating one way or the other whether I believe this guy. I'm covering this to point out the irony that smoke boy would spend an hour of his time at one or two in the morning debating diligent denizen and saying there's no good evidence. Tyler Robinson was at the Cowboy Smokehouse in Panguitch, despite eyewitness testimony saying he was there. And on the very same weekend, release a letter from Invita. That says Erica was there and you must believe it or you're defaming the person who made the statement. Do you see why I find smoke boy to be a fundamentally dishonest character? If it weren't for double standards, the man would have no standards at all. None. You can't have it both ways. Smoke boy. If we're free to disbelieve the server because people get things wrong, then why aren't we free to disbelieve? The person. The person from Invita. I'm not saying whether I believe either one of them. I'm not saying whether I disbelieve either one of them. I'm covering this merely to point out smoke boy's hypocrisy. Making no claims whatsoever about Panguitch, the smokehouse, Cowboy Smokehouse. Making no claims whatsoever about Ralph, the co-owner. I'm making no claims whatsoever about the server there. I'm making no claims whatsoever about Invita. I'm making no claims whatsoever about the employee of Invita. The lawyer who sent the letter. I'm only pointing out smoke boy's hypocrisy. That he's the vessel through which they chose to release this statement. That you must believe Erica Kirk was there. And if you choose not to believe it, then you are defaming the character of the person who placed her there. While at the exact same time saying there's no good evidence he was at the smokehouse. Am I the only one picking up on this dishonesty? Does smoke boy himself not understand the predicament he's put himself in within a 24-hour window? it's pretty obvious, guys, it's pretty obvious that he's trying to have his cake and eat it too. Was Erica at Invita? I have no idea. Was Tyler at Penguins Smokehouse? I have no idea. Are both facts vitally important to the case? Yeah, I think so. Honestly, I do. I think both of these cases could end up being dispositive on different issues. One would be dispositive on prior knowledge that Charlie Kirk was going to die. Why else would you lie about where you were? I don't know whether she lied. That's not my point. My point is, if it turns out she wasn't there, it's pretty dispositive on whether or not she had good motives that day, I think. And if it turns out Tyler Robinson was at the Cowboys Smokehouse in Penguins, it's pretty dispositive on whether he was sending those text messages, because the text messages said he was in Orem watching police dog sniffers. So it becomes pretty dispositive. Both of these issues become pretty dispositive, which is why I think they're addressing both of these issues. They only seem to address certain issues. They don't address everything that's come up. There have been a lot of questions that have come up that they've looked the other way, and they've chosen not to respond to at all. But on this particular issue, the Penguins Smokehouse, they've invested a lot. They've got Smokeboy out there doing battle at 2 a.m. on the phone, in public, and on the event, in VEDA issue. Now they have lawyers and CEOs and other people saying very threatening things if you don't believe the story or if you speak out against the story. So I think they're both pretty important. But on the one hand, Smokeboy says this is bulletproof evidence. That's where she was. At 12.23 and 34 seconds, Erica Kirk was at, and VEDA in Scottsdale, Arizona. That's Smokeboy's interpretation of this letter. That's the lawyer's interpretation of this letter. Why do we know that? Because someone said so. Okay. And at 8.55 to 9.47 p.m., they say absolutely not. Tyler Robinson was not at Cowboy Smokehouse. There's no good evidence. And the people who think, why did they think he was there? Why did they think he was there? It's the exact same scenario. Someone said they saw you there. And I just have to marvel. Your humble host has too much integrity to pull something like this off. And I've speculated about a lot of things. Those things may turn out to be right. They may turn out to be wrong. But I've always given you the reason I've speculated. One of the most famous might be that I speculated the fact that I was at Cowboy Smokehouse that Tyler Robinson might have turned himself in before 6.25 p.m. on September 11th. And that he might have been Mirandized. For those of you not in America, Mirandized means you were given your rights to remain silent and to get an attorney. We have a timestamp of 6.25 p.m., but we don't have a date. We don't have a date. So I looked for contact clues. I looked at those contact clues and came up with an independent determination that the contact clues tend to tell me he was in custody being Mirandized at 6.25 p.m. on September 11th. If that turns out not to be true, who cares? Who cares? It does not tend to show that Tyler Robinson did or did not commit a murder. But if it turns out he was not there, it does tend to show he did not commit a murder. And so it is an important issue. If he was there, it's very important to the case. If he was not there, it doesn't have any bearing on the case whatsoever. And so I speculate, I guess. But I told you, I believe that, but I can't state it with certainty. I don't know. And if good evidence comes out, if there's an eyewitness who 100% puts Tyler Robinson somewhere else at 6.25 p.m. on September 11th, I'll reevaluate. Is it on my official timeline? No, Smokeboy. It's on my unofficial timeline. It's on my personal opinion timeline. But I cannot possibly let the irony go without mention. Cannot possibly let the irony go without mention. Now, let me address a couple things. There are a lot of people who think this is a fake letter. This is not true. And here's, let me address a couple of those things. One basis is they say this is a HIPAA violation. To suggest that this is a HIPAA violation, that Erica's mother was there, that Erica was there, some sort of HIPAA violation. That's nonsense. That's nonsense. HIPAA can be waived. And the waiver was implied in the statement, if not stated explicitly in the statement. I am providing this at the request of Erica and her mother. Her mother's the patient. Erica's not the patient. So her mother is the one that would waive it. Erica's presence at the clinic is not a HIPAA violation at all. Erica's mother's presence at the clinic could be. But if she waives the protections, the privacy protections implied or explicitly stated in HIPAA, if she waives those privacy protections, then anyone's free to talk about it. You know, when you go to the doctor, a lot of times one of the many forms you sign is a HIPAA waiver. And it'll say in there, you know, do you want us talking about your treatment with someone else? And I always put Mrs. Coleman's name down there and Mrs. Coleman's email address and Mrs. Coleman's phone number. And that way, if something happens to me and I'm incapacitated or they can't reach me and they need to give me some sort of important time-sensitive results and I'm not available, they can call her. Hey, your husband has a raging sinus infection. He needs to get treatment right away. You know, every second counts. Okay. Well, I'm doing a show. I can't answer the phone. They can call her. They can talk to her because I've waived that privacy. If I don't waive it, they can't call her. They can only talk to me. The HIPAA waiver is implied or maybe even explicitly stated in that statement. My guess is they have it written down somewhere to protect themselves. There's probably a letter to the clinic saying from Lori, from Erica's mother, saying, I waive my protections. I waive my privacy. Please tell them where I was and that my daughter was with me. So it's not a HIPAA violation. So stop saying that. Number two, the misspelling of the name. Oh, it's not Erica. Erica's name is spelled with a K. This letter spelled her name with a C. Stop it. Stop it. The purpose of communication is to be understood. Is there anyone who didn't know who they were talking about? Is there another Erica with a C who would have accompanied Lori to a medical appointment? No. No, that's nonsense. That's foolishness. Foolishness. Does it show that the letter was maybe quickly prepared without being double-checked? Yeah, probably. But that's okay. That's allowed. That's allowed. These are busy places. Do I think the letter. Do I think the letter's real? I don't know. I don't have an opinion on that. I'm not required to have an opinion on that. I'm not saying it's fake. I'm not saying it's real. I'm not required to stake out an opinion on whether the letter is true, whether the letter is real, or whether the contents of the letter are accurate. I have no. Just because you tell me that I'm required to believe this does not mean I'm required to believe this. I don't. I don't know what to believe. I have no idea what to believe. Part of the problem is there are different people saying she might have been in different places around town. And I have to weigh all that evidence. So I don't know where Erica was. But bam, bam, bam, bam. Are you calling that guy a liar? He said she was there. No, I'm saying I've yet to formulate a belief one way or the other. I don't believe she was there. I don't disbelieve she was there. That's part of the problem here is waiting 11 and a half months to address these issues. And so you can't come out and say the letter's fake. There's no. There's no positive evidence that the letter's fake. But you also, in my opinion, can't come out and say, well, that settles it. It's over. No, because if it's over there, then it's over that he was at Panguitch. If we're required to believe she was in Scottsdale, then we should be required to believe Tyler was in Panguitch. And I don't know what to believe about either one of them. I've got it on my timeline in yellow, meaning maybe, maybe not. Follow up on. Something to check on. The final thing I'll say, and then we'll get into some of your comments. I know we've gone late today. There's been a lot made of the volume of discovery, and maybe tomorrow we'll look at some of it. There's been a lot said about the volume of discovery this week. It's. It's. It cuts both ways. I've seen a lot of people on social media saying, oh, they've got 26,000 data points for cell phone pings. Okay. Fine. Even if every one of those pings pings to a device purporting to be Tyler Robinson's, can you put the device in Tyler Robinson's hand beyond a reasonable doubt? I mean, first you've got to put him somewhere beyond a reasonable doubt. Then you have to put the phone in his hand be on a reasonable doubt. That's two very big hurdles. so if you're going to use that as some sort of element of the crime that he was at the facility he was there he was on the roof how do we know he was on the roof his phone pinged on the roof okay i could i could see this example hey we're going to commit a crime everybody throw their phones in this lunchbox we'll get your phones back afterwards we don't want your phone pinging where you are all afternoon okay here's my phone put it in the lunchbox okay great and then if you're going to frame tyler robinson you would pull his phone out and stick it in the hands of the guy who's walking all over town who gets up on the roof i mean is that far-fetched i don't think it's really that far-fetched again if you're going to frame somebody you're going to frame them if i'm going to frame somebody being on the roof i've got to have something up there putting them on the roof a screwdriver with some dna and a phone would go a long way now maybe tyler robinson was on the roof and his screwdriver fell out of his pants and his phone was in his pocket it seems kind of foolish to me though if you're trying to get away with a crime that you intend to take to your grave to take a locating device tied to your home and your name to the scene of the crime that seems a little a little bit like you overlooked a key component to getting away with a crime that seems like a key component second where's his phone where's his phone you can turn over all the points of data on a sheet you want you can turn over all the the zeros and ones in a computer drive you want has anyone seen his phone does the defense seen his phone has that been listed of the things that turned over no as a matter of fact i don't believe it has i don't believe his phone's been turned over which means his phone is still in federal custody at the fbi the one that has not gotten back to panguich about whether to turn over his phone or tyler was there that fbi that fbi and where's the gun you can't kill someone without a gun not if you're supposed to have shot them with the gun i can't shoot you with a gun that that i don't have no where's the gun has the defense had an opportunity to look at it has it been turned over has has any independent investigator gotten a hold of this thing is no no it's still at the fbi as well that's still at the fbi as well and so the very government that might be potentially involved in a multi-agency cover-up has possession of all the good evidence so don't tell me they turned everything over hey they haven't we're still getting notes that there's stuff that hadn't been turned over but you can't turn everything over if you don't if you don't have access to any of the actual evidence to evaluate and review to get an independent analysis let's take a look at the bullet fragments the gun the cell phone key components of the gun that might be potentially involved in a multi-agency No. The good stuff is buried in mountains of stuff that's irrelevant or may not matter. Or it may matter because you may see some sort of cover-up taking place, but you can't find it because you've got all this stuff to sift through. Hundreds of thousands of hours of video footage from all over campus. Tens of thousands of phone pings from all over the state of Utah. So we don't really know what the defense has. We don't know what they make of it. We don't know where the key evidence is. We think we know where it is, and we think the defense doesn't have it. And so this notion that the defense has everything and still has no defense is nonsensical. It's nonsensical. It doesn't add up. It doesn't make sense. So I just wanted to mention that just because it's a talking point, and sometimes people don't know how to respond. That's just a fact. It's just a fact. A couple things. One, hit the like button.
