O montante extra é de débitos classificados como extraconcursais, dívidas que, por lei, não são sujeitas a pedidos de recuperação judicial. Para especialistas, o fato de se tratar de um montante expressivo torna a tentativa de reestruturação da companhia mais complexa. Na lista fora do alcance da recuperação, há dívidas como a de R$ 4 bilhões devidos ao Bradesco, R$ 2 bilhões a serem pagos ao Banco do Brasil e outros R$ 140 milhões a fabricante Atlas. Não há detalhes sobre as faturas em aberto e sobre os contratos entre os credores e as Casas Bahia, mas o que a lei autoriza é que fiquem de fora da recuperação, dívidas garantidas por sessão fiduciária de recebíveis.
