'Charmed by the Energy': Cornell Student Justifies Doing Ketamine Off a Woman’s Body

The transcript details a complex and conflicting investigation into alleged sexual misconduct at a Cornell fraternity house on October 19th. Two fraternity members, Scott Norris and Scott Kay, enter the alumni room to check on a friend, Diego, after seeing a Snapchat message with "free pussy" — which they initially dismiss as a joke or prank. Inside, they find Jane Doe engaged in conversation, not incapacitated, and report no drug use. Despite their concerns, the panel finds them guilty of sexual exploitation, not assault, because their motivation to see someone naked without consent violates social norms. Multiple accounts, including from Winston Lee, describe divergent experiences: Jane Doe claims she was drugged, coerced, and trapped in a small room with men, while others report a lively social atmosphere and no drugs. Key inconsistencies include the sudden appearance of an unconscious person, contradictory memories of ketamine use, and conflicting timelines. The case is further complicated by ambiguous messages, selective memories, and the influence of intoxication, which blurs lines of consent and perception. The investigation underscores how personal biases, group dynamics, and narrative gaps lead to a fragmented and often contradictory understanding of events. Despite months of analysis, no definitive conclusion has been reached, and the case remains a subject of ongoing public debate.

in a separate room in the fraternity house that night like i said there are three people scott norris scott kretschmar and diego cerabia diego at one point just like leaves the two scotts scott k's vape dies he wants to borrow someone else's and scott k apparently knows that jonathan in the alumni room has got a vape so he's like i'm gonna go and i'm gonna check it out scott k is like hey scott norris you want to come check it out with me and also remember that snapchat message that we saw and like also diego was kind of drunk and he left abruptly so like we should check up on him because where did he go i love how the reason for them of going is number one get a vape pen number two check out their friends number three by the way there's a text there's a snapchat it's like a afterthought yeah it's a yeah let's see what that is all about about the whole snapchat you know who i believe to be scott norris says we saw that text and we were somewhat concerned but thought it could just be crude humor in a later follow-up who i believe to be scott norris says i thought at that point it was just kind of an absurd joke no one really thought i was being serious like when we went in there i thought at the time like thinking it was kind of a joke an attention-seeking joke kind of like to get people to come to the alumni room and my concerns that it wasn't kind of alleviated because people are just hanging out in there so on his way to the alumni room he's having a lot of thoughts i guess right i don't know how big this fraternity house is but he's on a fucking journey and he's just thinking oh maybe it's a joke maybe it's not a joke maybe it is a joke it's kind of weird let's go check it out my friend's in their vape pen oh but also like maybe it's not a joke then that's very scary if it's not a joke but then he opens the door and he's like oh everyone seems to be just hanging out so good thing i feel better about this like that's the vibe it gives so he's saying like there is a part of his brain thinking something really bad is going on in there it's kind of like i don't know yeah my concern is i'm worried but he also felt like could be something bad right like that part i think they get tripped up i this is my opinion this is my opinion i think they get tripped up because they're like we wanted to check up on diego our friend because we were worried about him why are you worried about him if it's just a joke so then it's like well then a part of me is like i don't think it's that's what is he worried about exactly exactly everything is like there's so many ways of yes explaining a situation that we all are understanding what all everyone's going there trying to do and in the past decision in the John Doe lawsuit, it seems to hint at the fact that the panel acknowledges that the two Scots don't typically hang out in the alumni room. So like I said, they're further removed from the group of people, the group of the seven. It seems like their link is Diego in this Snapchat group. But he emphasizes later, we seriously, I'll emphasize seriously, did not think there was anything going on. We thought it was a joke. So then one of the Scots, I think it's Scott Norris, but I could be wrong, is asked by the panel, okay, well, you think it's a joke, but like, how do you interpret the words free pussy? And he responds, it's just that there's a free girl in the room. But again, no one took that literally as meaning there's a free girl in the room. It's just that there's a free girl in the room. And this investigation spans months, and they couldn't even think of a better, a better statement than that. It stated that perhaps Scott Norris and Scott Kay go to investigate. And Scott Norris says, and also, it sounds kind of silly, but Scott Kay's vape had died. And he knew Jonathan Newell had a vape in there. So that's just another reason, right, that they're going to the alumni room. And they were probably in there for maybe five minutes. And while they were in there, they say that Jane Doe was laughing and talking with the others. She did not seem incapacitated. She they did not observe any drug usage from Jane or anybody else. Nobody was doing cocaine or ketamine off of Jane or whatever. Nothing. Scott Kay also has a similar story. And he says, yes, it was because of his vape. And he says, I was hitting a nicotine vape at that point. And it was almost dead. And this is where I will say it gets very confusing. So when they open that Snapchat message, when I was interpreting these snippets, and obviously, these are snippets, so I don't have the full story. But at some point, I was under the understanding that the two Scots are in the room, Diego leaves, and then they open the Snapchat together. And they're like, what happened, right? But then later, one of them was like, I was in the foyer area when I opened it. And then I went to go up to the room where Scott Kay was. So it I was getting confused. Now, I don't know if that's the fault of there only being snippets in the John Doe lawsuit, or if it's the fault of my reading comprehension, though, I would hope that it's not or if it's just unclear. What is exactly would be the difference? The difference would be that everyone's pointing out small discrepancies in Jane Doe's story. But there are also parts of these random snippets of the Title IX investigation where I go, wait, I feel like that's not what was said earlier. You just feel like there's inconsistency with the account. Like, yes, did you see this in the beginning? Or did you see it later in the room? Yes. Now to everybody's defense, including Jane Doe and the seven accused, just because there are discrepancies does not mean that anyone was committing a crime. I mean, everybody was drunk and high at some point in the night. So it could just be that. But I was just noticing if everyone's pointing out Jane Doe's small inconsistencies, there are other inconsistencies out there. What are they pointing out in Jane Doe's inconsistency so far? Or is it later? This one has to do with the fact that in these reports, the six page report, the transcripts and in earlier statements, even in much of the Title IX investigation, it seems that Jane Doe reports that the very first sexual encounter with Matthew and Jonathan, she was pretty okay with it. Then her lawsuit in 2026 states that that was an instance of rape. Scott Kay says he's hitting his nicotine vape at that point and it's almost dead. Then Scott Norris gets there and they talk for about two minutes. Diego leaves the room. They don't know why. They don't know why. They don't know why. So now it's just two Scots and a dead vape. After about 10 or 15 minutes with Diego still being gone, I checked my phone in the actives group and there was a text message that said free pussy and alumni. I had no idea what that text meant. I was kind of befuddled. These are the words. So me and Scott talked about it. And the person that sent the message, he lived in that room. Jonathan lives in the alumni room. And I knew he had a vape. Oh, yeah. This is when they connect. Jonathan has a vape. It's after they see the text message. After they see the Snapchat, Jonathan apparently has other things in that room. Hey, but no, you're like, I need the vape. And he says, and my vape had just died. And we also speculated that maybe this is where redacted, I think Diego, had just got up and left. And us not knowing the nature of if this was a joke or what was going on in the alumni room, me and Scott Norris decided to go into that room. When asked about his specific motivations of going into the alumni room, he says, by no means were we going there to get free pussy. That was not our intention at all. We were just checking out to see if everything was OK. They get to the alumni room and it's reported that they see Jane in bed with people underneath the covers. And they say we didn't even see her nude, that she was just engaging in conversations. Everybody was talking coherently, that Jane at some point laughed because the two Scots had the same first name, but they were probably in there for like five minutes. They're pushed. The two Scots are pushed about this even more because, again, like I said, some of the fraternity brothers, they have a reason to be in there because they live in there or they have friends in there. The two Scots are a little bit more removed. And this vape excuse is bizarre. So they're pushed. And one of the friends says the text could have meant anything. There was a lot of things going on through my head. I didn't know if there was a lot of girls in there or what was going on. But again, free pussy just seems like someone could be in danger, could have been in danger. It's just free. What does free mean? Again, I don't know. That's why it could have meant anything. They elaborate because if someone's having sex with someone in the room, they're not going to send that text out. So again, I just didn't know what was really happening in the room. I just didn't think it was real. Then Scott Kaye is asked, well, then why did you respond in the Snapchat group? Because he responds, the alumni shit is not a bit firsthand POV, not a bit. So you're saying you went in there like free pussy. This could be dangerous. You went in there, vape, Diego, free pussy. Oh, no. Do I need to save someone? And then you're like, no, I don't need to save anyone because everyone's having a good time. But you text the alumni shit is not a bit firsthand POV, not a bit. Exactly. That's addicting. Yeah, it doesn't make any sense. And he's like, you know, it's crazy. It's crazy. But I sent that text message before I went into the alumni room. So I'm outside the alumni room and people are chitter chattering about what's happening inside. And like, I guess the indicate like the insinuation is like, oh, people are saying some crazy things like, oh, my God, they're like having an orgy in there. And he got so excited. He texted back into the Snapchat group. But he's like, that was before I went into the alumni room. He says, quote, I found out from someone passing by as I was walking into the alumni room that there was a girl in there. So I was just saying, like, I mean, firsthand from somebody else that was, you know, there was a girl in that room and it's a joke. Yeah. Again, these are Cornell students. I don't know how the fuck they got in. But again, he says it was immature and dumb, kind of just following along with what everybody else was saying in there. I shouldn't have said it. And it was immature and a stupid message for sure. However, one thing I will note is that the two Scots, their their parents and all of this is confusing compared to the others. Jane Doe in multiple reports says that the two Scots were more like voyeurs in the situation. Oh, so they were not maybe necessarily involved in a lot of the acts. At some point, it seemed like it was alleged that the two Scots had taken ketamine off of Jane Doe's body. However, one of them submitted a hair follicle test that came back negative for ketamine. And this was just like a month after. And ketamine usually stays in the hair quite a bit. So there's a lot of debate. And in other reports, Jane Doe states that the two Scots, they were comforting her to some degree because she was trying to get up and she was very dizzy and nauseous. And they were just telling her, like, take all the time you need. So the Scots involved involvement, I guess, is a little more unclear for netizens. Should they have gone to the alumni room? No. And I think that's what the panel is saying. But the panel did not find the two Scots guilty by the panel standard of sexual assault. So they found the two Scots guilty of sexual exploitation, meaning they walked into the alumni room wanting to see someone naked who probably would not consent to being seen naked by them because they don't even hang out in the alumni room. So you went out of your way to go to the alumni room. So they didn't believe the whole vape Diego and like, let me just check it out excuse. And the Scots, they don't like the panel decision. You know, they're like, no, we literally did nothing wrong. Then Giglio walks back in, according to Jane Doe. OK, so Giglio, he's the one that was in the room making out with Jane Doe, according to Jane Doe, and engaged in the sexual activity with Jane Doe and Jonathan. Giglio apparently walks back in and is like, we're shutting down whatever the fuck this is. And Jane Doe's statement reflects a lot of netizen confusion. Her report that lands on the DA's desk, it reads, I found this strange because Giglio was acting as if he hadn't been in the room with me earlier that night. I think I even said something along the lines of like, wait, didn't this guy just fuck me? When Giglio and redacted said they were shutting it down, the group of men all began to scatter. I attempted to get up off the bed, but became very dizzy due to my pots, as well as the fact that I had consumed the extra bump of ketamine. I remember one of the, I believe the Scots had his hand on my back. I was like, I'm not going to do this. I'm not going to do this. And he encouraged me to stay seated for as long as I needed to. He even told the other men to give me a second so that I could gather myself. Eventually, I was able to stand up from the bed and someone was able to get my dress and bring it to me. I then put my dress on, but I had to sit down again due to how dizzy I was. At this point, she says that she's ushered upstairs to the Fofis by Matthew and Winston Lee. So this is when Winston Lee finally showed up. Well, he's in the alumni room. He's accused of doing ketamine off of Jane Doe's body. Oh, so he came in way much earlier. He's just been. Around, okay. Yes. So he's been around and now he is allegedly taking Jane Doe upstairs with Matthew. And this is who I believe to be Winston Lee in the redacted Title IX snippets of the John Doe lawsuit. And most of the context is pulled from the fact that he's upstairs in the Fofis. So Winston is very, like he has distinct markers that I think indicate it's Winston, even though his name is redacted. Because he's the only other party in the Fofis. Matthew was not interviewed by Title IX. Ah, so this is this person's account. Upstairs. Yes. So it seems to me, again, I can't say with certainty because it's redacted, but it seems to me to be Winston. Winston says that he met Jane Doe a week before the incident. They had some casual conversations, but Winston wasn't really like bonding with Jane Doe. So it seems like Jane Doe had come to Chi Phi a week prior. Winston meets her. He's not really engaged. He said that he was on his phone playing poker most of the time. The night in question, though, when he gets to the alumni room, he says this is not odd for him. The alumni room is a social room. This is where the alumni room is. Which usually in a fraternity, you're the closest to your pledge class. These are the people that you went through initiation and hazing with, typically. So he says, you know, this is our pledge class. It's the social room. And I go at least like once a day in that room. So he walks into the alumni room again on October 19th. He recalls three people under the sheets in one of the beds and he walks in. So this seems to be Jane, Matthew and Jonathan. So after Jillio leaves, it's Winston, I believe to be Winston. Now he's talking to some of the other people in the room. And while everyone's talking, he says he remembers Jane Doe took off the covers. And I think at one point she was flexing. OK. Right. So this is like when she maybe is upset at Diego. I love how, you know, these accounts are. It could be a similar incident, but the focal point is always different for everybody's POV. For his POV, it's just like, oh, yeah, she's out naked and posing. Yeah. She just like took off the covers. Yeah. There's no context. There's no why. It's just. See, that's that's. That's what happened. Like a bodybuilder. Right. Yeah. He later says in a different interview that when Jane Doe did this by default, the covers fell off. Right. And that is when he also discovered that Jonathan was unclothed as well. So he seems it seems like maybe Winston is expressing shock that not only is Jane unclothed, but. So like now I'm looking at this other guy that's like, what's happening? What's going on under the covers? He's like, I wasn't expecting to see that. That's the vibe. In a later interview, he says that an alarm bell rang in his head when he first realized Jane Doe is nude. But, quote, it kind of quickly dissipated when she spoke and she seemed like she was having fun. He says that he recalls Jane Doe joking about an attempted threesome that failed. And then they start doing the ketamine off of Jane Doe's body. And maybe Winston says, and I asked her, Jane, is this OK? And to which she said that I could take ketamine. Off of her body. So given that I had consent, he says he took the ketamine that was laid out for him around Jane Doe's stomach, around her belly button area. And, quote, while I was taking the ketamine off of Jane Doe's body, she was actually pulling down my pants, like tugging down my pants and kind of like in a sexual way. I kind of flinched and I kind of took a step back because I didn't want to engage in anything like sex. But he says that after he snorts the ketamine off of Jane Doe's body, he starts feeling the effects. And again, I think this is Winston. I don't. I don't think it's Diego. I think it's Winston. Right. But I remember talking to them. Then the ketamine started to hit harder, maybe like five, seven minutes later. And I decided to lay down on the bed where Jane Doe was sitting on. And I just lied there for like 30 minutes unconscious. Remember how the Scots walk in? No one said they saw a dude that's unconscious. Everybody's talking. Everybody's having a good time. Everybody's coherent. But now suddenly we got a man that's unconscious. OK. Yeah. He goes on to elaborate. Yeah. When I was unconscious, I remember people coming and going into the alumni room, but I did not know who they were. And then when I woke up, everyone had left the alumni room. How do you know that if you're unconscious? Unconscious has a pretty firm definition. I'm sorry. Like, are you guys not students at Cornell University, one of the most prestigious, oldest institutions of high academia? Like, it's so odd. I guess he ends up clarifying to the panel, the Title IX panel. When I said I was unconscious in the alumni room, what I was trying to say is that I was out of it. I was looking at the ceiling. The entire time, closing my eyes and going into a lapse of just was sleeping, I guess, and waking up and blinking and then closing my eyes again. I was very much concerned more about my sense of being in my own consciousness, which seems to be a very lengthy way to describe being fucking conscious to some degree, right? Rather than unconscious. I mean, this one is really putting his Ivy League education to fucking use. I'm not saying that his version of events isn't true. And it honestly could be true that that is what he felt he experienced, because that is the effect of ketamine. A lot of netizens are arguing. So it does sound on par with ketamine usage of like, you're there, but you're not really there. Like, you can see people coming and going, but you're kind of out of it. Yeah, but you're not unconscious. I mean, that's a very limited definition. It's not a vague definition by any means, but it's a disorienting experience. Sure. But one thing that is odd is nobody reports seeing a guy that's unconscious or it's semi-conscious or semi-unconscious. Who knows? One of them I even asked because the panel is like, OK, well, now now we know someone's unconscious. Let's go ask everybody else. What do you guys do about the unconscious guy? No way. Yeah. And one of the Scots responds, no, if when I walked in, someone was sleeping, I would have been like, is he OK or that kind of thing? So I know that no one was sleeping. Everyone was pretty lively and awake. Oh, so who's lying? Exactly. I mean, I guess you could argue that perhaps timelines are not matching up, but that doesn't seem. To be the case. I see. Maybe he awoke and was suddenly just so full of energy. Another one of the accused stated that everyone was awake the whole time. So kind of weird. Yeah. So then the panel goes back to this individual who I believe to be Winston, but I could be wrong. Just judging by the timeline, it seems like it's Winston. But again, and they ask, well, did you like were you engaging with other people when you were unconscious? Not unconscious, laying there for 30 minutes? What were you doing? And they respond, I was very much concerned more about my sense of being in my own consciousness. It could be possible, but I would doubt it. Perhaps I was. I'm not completely sure. He explains why he even participated in snorting ketamine off of Jane Doe. And he goes on to explain, I think when I first entered the alumni room, I was first of all greeted by three people who seemed to be having a lot of fun and who seemed not to mind the fact that ketamine. Was active in that room, but also I feel maybe I was charmed by their energy and the fact that they were having fun and I wanted to have fun as well, which is a very strange description, even in my most dramatic of days where I believed I was a character in vampire diaries, just journaling away. I have never uttered the words written down the words I was charmed by the energy. If someone wrote this in a book, book talk would flame them because it's so what are you even talking about? Right now, what are you saying? I was charmed by the energy, the energy being a fraternity room and atmosphere. It's so far removed from the word usage. It doesn't even remotely register in my brain. If I just read that, I would never imagine it's a fraternity room. Yeah, yeah, yeah, yeah, yeah. Like maybe a pep rally. I don't even know. But strange. But that's why they did the ketamine. And they say, you know, in hindsight, the act of consuming substance off of someone's body is. Ludicrous in hindsight. Now, this next statement, it's kind of hard to decipher whether it's Winston or Diego it is redacted but this is talking about doing ketamine off of Jane's body another one of the accused states in the title nine panel when I was first uncomfortable I kind of felt overridden by how positive everyone was in the room maybe I'm the one that's being weird if everyone around me is looking so joyous and happy to be talking to one another and yeah eventually after redacted did the action of ketamine off of her body he said something to the effect of I should do it as well and since being in this positive atmosphere I eventually asked as well crazy joyous happy positive charmed yeah what's happening yeah like I think it would have been better if they were just like hey I was getting fucked up like a frat bro yeah because that's what I do because I'm a brainless frat bro and everyone would say that actually makes a little more sense yeah this individual becomes more conscious around 3 15 a.m where he walks to the pence the president's room which this is why I think this is Winston Lee's statement right because this is upstairs now so and Matthew was not interviewed by the panel where they say that they go into the president's room and they see the president which is Orazio Petito and he is named in Jane Doe's lawsuit they also see Orazio Petito's date and Matthew Jane Doe and Winston they're all in the president's room now now I will president has a date in there too yeah okay like a girlfriend date I don't know right probably not a girlfriend I don't know if these guys have girlfriends I don't know but this girl was later interviewed by the panel and she said that Jane Doe seemed not disoriented she did not seem incapacitated okay this individual claims that they were all up there for an hour having lively nice conversations in the president's room and Jane specifically mentions something along the lines of quote it's weird but I don't think I can feel the effects of ketamine who I believe to be Winston says his reaction was just surprised he says for me I was like oh so you're taking ketamine in the alumni room I was shocked so he's saying like he didn't see Jane do ketamine all night so he's like oh I didn't even know you were you did ketamine it seems to be Winston because the previous week there was conversations about ketamine when they met and he seems to be one of the people that met her the previous anyway he states that there were people outside the president's room just lingering listening and already started coming out that quote some weird sexual activities were happening in the alumni room but later he adds I did not know there were rumors going around that night he's like I didn't know there were rumors okay which is kind of weird because if this is Winston he did respond in the snapchat group so if there were rumors going around that night it would be pretty easy in his mind to piece two and two together of what the rumors were and why they were starting and why people are lingering outside the room but he's just describing that people are lurking he doesn't know what he's talking about he's just describing that people are lurking outside the president's room and this individual who may be Winston I think it's Winston but again right they're just saying that they know people are lurking because quote you could hear the whispers and a little fidgeting of them walking and Jane was telling us about it and we were like yeah we should probably go somewhere that's more private right so we went to the room that's actually right next to Matthew's room which is called the Fofis okay this is I can tell you're confused president's room is up stairs there's a Fofis connected it's like a closet office Matthew also has a room upstairs Matthew Ingalls the friend that invited her to the fraternity house he does not live in the alumni room okay so this Fofis is like in between the president's room and Matthew's room somewhere on the third floor and they want to go there because I believe Jane told us that she was uncomfortable with these random people in the other corner of the house listening to our conversations there's mentions that rumors are circulating but everyone seems confused why there would be rumors even though there's some weird snapchat messages being sent into the 57 person group snapchat and most of these individuals are in the fucking fraternity house but this individual is like I mean I don't know what rumors are going around it seems like Jane knew about the rumors why would Jane know about the rumors she's not in that snapchat group but it's just weird does that make sense it's just weird yeah yeah yeah so they're like we had to move to the Fofis because Jane is like I want to go somewhere private because all these people are lurking and they're listening to our conversations and I think at this point rumors were already circulating about something going on it's just everything is weird yeah it's really odd very strange very strange right so and again if this snapchat group was out of the question and maybe Jane is sitting there like oh I think people are talking about me and everything that's happened in the alumni room because people saw or people witnessed or people heard then that must mean it was loud enough that more people should have been concerned like it's just weird the whole thing is just puzzling they go into the Fofis and Jane Doe when she's confronted with this information she tells title nine panel she's like I don't know what any of this is she's like I went upstairs with Matthew and Winston I was in the president's room for like two seconds and then I was taken into a Fofis like what do you mean I was having a conversation with one of the accused saying I don't even feel the ketamine she's like this never freaking happened she says the ketamine made her feel like quote it made my eyes feel like they were spinning in opposite directions I remember feeling extremely high and trying to close my eyes to stop them from spinning she also says if I had gone to the president's room like I wish I was there not the Fofis because I would have just fallen asleep on his couch and called it a day I was so tired but instead she says that she's taken into the Fofis and there Matthew and Winston are sitting in front of the door so that she can't leave she feels like there's no escape it's a situation where she's like I don't know what to do I don't know what to do small claustrophobic room it's like a tiny closet office with a desk and some chairs and she's just sitting on the ground and she says I don't remember how it started but she says that she was given some ketamine she doesn't really have a recollection of how she took the ketamine but she thinks it was lined up on a chair because she recalls some sort of hard surface of her snorting the ketamine and she says she has no recollection of how the threesome and the Fofis even started she says I remember being totally disgusted at the situation I felt very tired and intoxicated I would say that my level of sleep was very low and I was like I don't know what to do my level of overall intoxication was an 8 out of 10 of intoxicated I would say that it was the most intoxicated that I've ever been in my life I felt like I was unable to form any decisions because of how intoxicated I was meanwhile who I believe to be Winston from the John Doe lawsuit and the little snippets of the title 9 panel he says that they were in the Fofis for like an hour and a half just conversing having deep conversations listening to music he says the conversations were really deep but he doesn't remember a lot of the deep conversations but he remembers Jane holding eye contact with who I believe to be Matthew and looking at him and he states that he remembers thinking oh wow this girl like really likes Matthew oh that's it he's didn't uh he's saying there's nothing else that happened he says that there was no ketamine in the Fofis but they eventually do have sexual interactions but it's like after an hour and a half of talking he says this is we were talking in the president's room then we came into the Fofis and everyone was like oh my god I don't know what to do I don't know what to do and I thought that she just really liked Matthew and because everyone's talking so much I just assumed like all of us are pretty sober at this point so if this is Winston the story would be they go into the president's room Jane Doe's like I don't feel ketamine Winston's like you're on ketamine I don't even see you do ketamine then they go into the Fofis and everyone's talking for an hour and a half and so he's like oh like everyone's sobering up it's getting really late or really early in the morning everyone's chill and then all of a sudden they're like oh my god all of a sudden it seems Matthew brings up the topic of redemption because remember the very first threesome that he asked for he could not perform because he was yeah and again who I believe to be Winston claims to title nine but something I specifically remember Matthew had asked Jane if we could have a threesome and I had specifically stated I said Jane by the way if you're uncomfortable and you don't want to do this that's perfectly okay we can just call it a night but the statement continues he says you know I think we were all feeling a little bit tired at that time I didn't know if she wanted to have another sexual activity so close to the prior failed threesome I myself was reluctant to have a threesome but I guess shit just happens right even if you're reluctant he's who I believe to be Winston says I asked Jane if I could have oral sex when she was giving me oral sex I was sitting on the chair I struggled to get an erection and I was perfectly fine and no one would judge me and she gave me oral sex for about two minutes he says that then she turned and gave the other party I believe Matthew oral sex and then tried to swap back in Matthew is now having penetrative sex quote after that Matthew inserted his penis into Jane Doe's vagina and Jane Doe gave me oral sex he says that his interaction with Jane Doe at that point lasted about two to three minutes okay so I don't know why it stops I don't know he doesn't at least from the snippets I read it doesn't seem he gives a reaction of was it I don't know right but when he's asked about the sexual activity continuing for the other parties because the panel is like okay well if it stopped for you in two to three minutes what about Jane Doe and who I believe to be Matthew like what happened to that he responds I'm sorry but from that night I remember things about what happened with me so I don't remember oh yeah oh wow wow whatever that it's not even like a, I don't remember, it's just like, hey, So I have very selective memory. And if I was not involved in the experience, I don't fucking remember. Wow. That's so interesting. Wow. Yeah. He denies ketamine being used in the fofus. He says, no, no, there was no drugs. There was no alcohol in the fofus. Now, there are lots of gaps and omissions in this individual's statements, who, again, I believe to be Winston, but I could be entirely wrong. I could literally be a bozo trying to decipher this lawsuit, right? Go decipher it yourself. But when the panel asks him about it, he responds, there are a lot of, I believe, gaps in my memory that I recollected. And after receiving a notice of the formal complaint charges, I was trying to rationalize in my head how it was false and providing an explanation. That I figured out and I thought was reasonable as to why those things were false. I'm sorry, what are we saying? He continues, for that reason, I was feeling very defensive about some of the accusations that were being pointed at me because of that. I think I left a lot of parts that I remembered from that night out that didn't have to do with the things that I was directly being accused of. I put myself in a very defensive position. Obviously, there are differences between his story and Jane Doe's story. She also says that they kept asking for a threesome and she just kept saying no and no in the sense of she kept giving the excuse that she was tired. She said that, I also felt that my eyes, it felt like one was going in one direction and the other one was going in another direction. She claims that Winston and Matthew were in front of the door, the only exit to the fofus, and she further elaborates that she was given more ketamine. She says, I don't know how much they poured. I don't know where I took it from. I don't know where it came from. I don't know where it came from or how it got in my system. I'm pretty sure it was that kind of final bump that made my eyes do the weird eye jerking thing, which again, a lot of ketamine users say is on par with heavy ketamine usage. So they're saying we don't, it's unclear how many times she did ketamine. It seems like the, everyone, even these seven accused seem to agree that maybe it was one time, right? But a lot of ketamine users are like the amount to have your eyes like jerk around. They said that's a very prominent feeling. And you're usually deep in like a K hole. That is not, Ooh, I took a little ketamine. That is, you have been doing ketamine all night. I mean, of course everybody's tolerance is different, but they're just saying this is not, this is not a once type of thing. And she's very honest about things that she doesn't remember, which I think a lot of netizens believe add to her credibility. She says, I just remember ketamine was done because I had my nose on something. It's kind of like, I want to say my nose was on a table. But it could have been that my nose was actually on a chair. That's all I remember from that. I don't know. It's just been a long time at that point. There's a lot of time that elapsed in the focus or whatever that I have no memory of whatsoever. It's maybe the most fucked up I've been ever in my life. I remember saying a lot of things, but I don't know what I was saying. I was apparently just talking and talking. My eyes were closed and my mouth was running and I felt like my eyes were going in different directions. I said, I talked a lot. Because I felt like I talked a lot, but it could be that I didn't talk at all. But there were a lot of moments where there was talk because I remember just like sitting there and was kind of staring at the wall and talking like this over and over. Maybe trying to distract from the fact that I thought my eyeballs were going like a chameleon. Like just, I just remember being debilitating. The feeling I couldn't have communicated my middle name. I don't think, well actually I probably could have said my middle name, but any sort of thought about my perception of the world. Was not good. Like not possible. Oh, so when Matthew was asking me about having sex again while in the office space, I told him that I was tired and I believe said I said something along the lines of like, I don't have it in me. She says she doesn't even know how the threesome started. And she has a different story about the erection. She says, I remember redacted asking me to give him oral sex and he said he couldn't get erect. I told him that if he couldn't get himself erect, then I wouldn't be able to. Hmm. Yeah. She says, I don't remember how that threesome started, but I do remember that both redacted and redacted, but probably Matthew and Winston were asking me to have sex so many times that I finally gave in to me. That felt like coercion. Also, I felt like due to my intoxication, they should have known how intoxicated I was based on how I was slurring my words. Jane Doe says the ketamine left her with a quote vague consciousness. She says, it's like, you look like an operating human being. You don't look dead or asleep necessarily. So it's like the lights are on. But nobody's home. Your brain is not functioning at its proper level. I know it sounds super weird to say. I know it happened, but I don't remember it. She says that at some point someone came into the focus and asked, y'all are still going to which she responded, yeah, unfortunately, in a quote, sad, not enthusiastic tone. Now this person is also a very contentious individual, one of the it seems maybe Winston was asked about, like, did someone stop by and I'm like, no, nobody stopped by. And then later it's changed to like, oh, yes, someone did stop by, slipped my mind. And he looked like he was freshly showered in PJs. Now it seems and I cannot tell you this with certainty. It seems like this individual that stopped by was Jonathan based off of little snippets that I got from all over the John Doe lawsuit that is public information. And I've deciphered in my mind that it's Jonathan based off of the fact that someone else said it was Jonathan and like the way that it was redacted made it seem like it was Jonathan. It could not be Jonathan. It could be Jonathan. But if it is Jonathan or one of the seven accused, it's being used perhaps as like an argument of, well, how fucked up were they? Because a lot of the seven accused seem like either they're saying I had nothing to do with anything or I was so fucked up, too. Like we were all fucked up. But how can you be that fucked up if you're showering and getting in PJs and then you're like, hey, are you still going at it? Yeah. But again, we don't know. So if this is Jonathan, she later describes the experience as I couldn't get much of anything out. I just kind of felt trapped with Winston and Matthew. They're sitting in front of the door in front of the exit. I mean, things are still being asked of me sexually. Ketamine is still being given to me during this point in time. It was just I don't think I felt like I could get out. I didn't want to, but I felt like I had to. She eventually gets brought into a different room to fall asleep, Matthew's room, and she says at some point while she's in Matthew's room, quote, at one point, a group of guys knocked on the door and they asked if they could snort cocaine out of my anus. But redacted told them to go away and they did. Damn. She says that she wakes up around 10 a.m. on Sunday, which like how do they know she was in Matthew's room? Because that's not the alumni room. I'm just saying if this is true, it's very suspicious and weird to me. But anyway, she says that she wakes up around 10 a.m. on Sunday, October 20th. She says shortly after I woke up, redacted was hovering over me. With both of his arms on either side of me. So this is Matthew's room. But again, because it's redacted, I can't say with certainty it's Matthew. It could be anyone like we don't know if people lock their doors. We don't know if anyone else came in later. I asked him what he was doing and he said he was going to put his penis in my mouth. I replied by saying no in a mean way to him. And at that point, he got away from me. Shortly after, she is driven back to her sorority house where she passes out. And this is not even the point that netizens are fighting about. What's crazy is October 19th. And October 20th isn't the thing that netizens are so divided on. It's everything that happens after in text messages and interactions between Jane Doe and the Cornell 7, which will be in the next part. There's so many text messages that have been released. There are so many different narratives that have been spinning around. New text messages from Jane Doe's roommate that have been released. It's just been getting messier day by day. I don't even think that this is slowing down anytime soon. Cornell has just recently suspended all. Fraternity and sorority parties. Yeah, it's not slowing down. It's not becoming yesterday's news anytime soon. What are your thoughts? Let me know in the comments. Stay safe and I will see you in the next one. Thank you for listening to this podcast. I hope you enjoyed it. I hope you enjoyed it.

Podcast Summary

Key Points:

  1. Scott Norris and Scott Kay investigate the alumni room out of concern for friend Diego, motivated by a Snapchat message containing "free pussy," which they initially interpret as a joke or prank.
  2. Upon entering, they observe no signs of drug use or incapacitation, with Jane Doe appearing coherent and engaged in conversation, leading them to believe the situation was benign.
  3. The panel finds the two Scots guilty of sexual exploitation, not assault, because their actions—entering the room to see someone naked—violate norms of consent and privacy, especially given their lack of connection to the room's residents.
  4. Multiple accounts, including Winston Lee’s, describe conflicting timelines and experiences: some claim ketamine was used, others deny it, and Jane Doe reports vivid intoxication and coercion, while the accused describe being in a social, joyful atmosphere.
  5. Discrepancies arise in the narrative, such as the sudden appearance of an unconscious person, inconsistent memories of ketamine use, and confusion over whether stories were based on real events or rumors.
  6. The investigation reveals deep inconsistencies in testimonies, particularly around consent, drug use, and the timeline of events, making it difficult to establish a clear factual account.
  7. The Snapchat message and the vague phrase "free pussy" are seen as ambiguous and potentially concerning, but none of the individuals involved believe it signaled actual sexual activity.
  8. The case highlights how intoxication, group dynamics, and social context can distort memory and perception, leading to conflicting interpretations of what happened in the fraternity house.

Summary:

FAQs

They went to check on Diego, who had left abruptly, and because Scott Kay’s vape had died. They also knew Jonathan, who lives in the alumni room, had a vape, so they wanted to see if everything was okay.

The message was ambiguous and unclear in meaning. It may have been a joke or a misinterpretation, and the recipients didn’t know if it referred to actual activity or was just a crude, attention-seeking remark.

No, both clearly stated they thought the message was a joke or a crude humor, not a serious threat. They believed it was likely an attention-seeking or absurd message, not an indication of actual misconduct.

They found the room to be normal and lively. Jane Doe was actively talking and laughing, and no one was incapacitated or using drugs. They did not see her naked or engaged in any inappropriate activity.

He responded because he heard rumors about people in the alumni room and was reacting to the speculation. He said it was immature and just followed the group's chatter, not an indication of belief in actual misconduct.

There is conflicting evidence. Jane Doe claims she was given ketamine multiple times and felt extremely intoxicated, while others, like Winston, deny it. Ketamine use is reported by some but not confirmed in detail.
