well that was a disaster uh not for everyone not for everyone just for smoke boy i just had a hankering for a fresh jar of pickles here ah yes ladies and gentlemen a fresh jar of wickles pickles uh this is not sponsored i just for some reason had a deep desire to open a jar of pickles i don't know uh guys welcome in welcome in welcome in uh not everyone can open a jar of pickles i've learned that over the last couple of weeks and some of those people shouldn't be debating either i've also learned that over the last couple of days we will go through that in detail we're also going to establish a little bit of what reasonable doubt means because smoke boy quit the debate before it began uh we'll cover that the date was technically over before it actually started um and so i um i want to cover that i want to cover that uh and then i want to go not line by line we're not going to go line by line through a three-hour debate um if you'd like to see that level of analysis ian carroll did such a remarkable job holy mackerel what a what a what a talent he is um i know he's got a lot going on in his life and he's not able to broadcast as much as he used to but when he does it is something that always delivers so he did a great job of the kind of the line by lining we're not going to do that nearly as often uh today as we are just going to run through some of the analysis some of the bigger broader pictures some of my overall thoughts um my first thought is i could not be more proud of candace i couldn't be um i was was frankly overwhelmed for the first time in this case this is the first time i was overwhelmed uh i didn't know what to expect i had heard uh that smoke boy was a qualified debater that he was excellent at what he does i think if you heard my show before we signed off on thursday i said essentially the same thing that this guy's supposedly the best of the best when it comes to debating she certainly has her hands full but i had full confidence she would come out on top i had no idea it would be an utter disaster for smoke boy i had no idea he would quit i had no idea he would not even attempt to defend his claim i had no idea he would not even attempt to defend his claim and i had no idea he would come prepared for something other than a debate something akin to pre-deposition interview which i think is sort of the purpose um but i want to go through um i want to go through that i want to clear up something about the earpiece drama i have inside information about the earpiece drama we're going to get into that clear it up i want to talk about pbd i think pbd um uh deserves a few words uh if we're going to break this thing down if we're going to talk about what happened pbd deserves some commentary because um i was very skeptical of how he would do uh and then we'll get into some of the lines from the debate before we get well we're going to start with the opening and end with the closing obviously but we'll get into some of the stuff in the middle and then we'll look at some of the things that have happened outside of the debate what what indications do we have in independent of of of my opinion or your opinion or smoke boy's opinion or candace's opinion or any of the commentators opinions or the the uh commentariat on x or or youtube podcasts or x spaces or whatever what do we have any independent verification of who did better yes we do as a matter of fact we'll get to that as well uh and then where do we go from here will there be a follow-up debate what are you kidding well i hope the price goes up if there is so let's get into this i want to start before i get to the earpiece drama i want to start with a few words this is not a typical opening i'm not going to do my whole 20 minute long opening but i'm going to give a few words on what reasonable doubt is because what i've learned is nobody knows what the hell it is um lawyers do uh if you've ever faced a criminal trial you may or may not but most people don't but reasonable doubt is the cornerstone it is the american criminal justice system in a nutshell it requires the prosecution to prove guilt to a very high degree of certainty otherwise you can't convict someone this is this is a protection this protects you it protects me and it even protects yes the bad guys the bad guys and there are some bad guys who stand trial not everyone who stands trial is a bad guy not everyone's guilty but a lot are a whole lot are and it protects them as well and you should want them protected it by protecting them you're protecting yourself it's it's a protection of individual liberty and it protects against the power of the state think of how powerful the state is not just here in the united states but around the world and historically how powerful states have been how they've been able to just grab people off the street throw them in prison never try them or throw them in prison and try them on some sort of sham trial um we don't want that here in the united states and the supreme court has given us a way to avoid it it's the principle we've talked about this that it's far far worse to convict an innocent person than it is to allow a guilty person to go free there are theological roots to it there are constitutional roots to it but the phrase itself beyond a reasonable doubt it became ubiquitous in american criminal law and it it wasn't something that happened all at once this was a gradual evolution it came it was imported into the united states i don't know how much people know this but much of our law was imported from england with many of the early settlers we just sort of imported english common law but we also imported our christian theology at the same time and so medieval early modern christian doctrine held that jurors and judges could be bound by mortal sin and eternal damnation if they condemned an innocent person while harboring any doubt so this this sprung out of the church itself the theological teachings said that there was a safer way to try criminals if you had any certainty at all if you had a reasonable doubt that something happened you should refrain from acting well english jurors because they were facing blood punishment, absorbed this anxiety. By the late 18th century, as trials began maturing and personal knowledge of events started giving away to courtroom evidence, judges actually began putting together jury instructions that would tell the juries that these little speculative or imaginary doubts, that's not what we're talking about. We don't need those things to prevent convictions. If you go all the way back to the Boston Massacre trials of 1770, you can really start to see how in America this concept of reasonable doubt became embedded in our law. I mean, federal proceedings, state proceedings, it didn't matter. By the middle of the 19th century, Massachusetts Chief Justice Limwell Shaw wrote instructions on a case called the Webster case. It was really the first formulation out loud of it. And he said, reasonable doubt. If you link reasonable doubt to an abiding conviction, wait, what did he, abiding conviction to a moral certainty. Abiding conviction to a moral certainty. And that began the process of really standardizing the language because that standard then became spread across other jurisdictions as they said, hey, that's a good rule of thumb. We'll use those words. Well, then you ended up with this mandatory standard for conviction because this widespread common law practice began to sort of percolate through all, all courts. So the Supreme Court finally had to step in. And it wasn't really until 1970. It was a case called Winship. And that's where the court held that the due process clause of the 5th and 14th Amendment required proof beyond reasonable doubt of every fact necessary to constitute a crime charge. Justice Brennan emphasized this vital role in protecting the accused's liberty and reputation. He even extended the rule to, to the Supreme Court. And that's what the Supreme Court did. It was adopted by the Supreme Court, and the Supreme Court has never really given us a firm definition. They just tell us we have to abide by it. That's what the Supreme Court does from time to time. But in Utah, there's really modern expression, practical expression of what it means. And so it is a safeguard, again, a safeguard for defendants, but a safeguard for all of us. And it is the probably most essential component to the integrity of the United States criminal justice system. So that is, I guess, your opening statement. But I hope that gives you a little guidance, and that's going to come up when we talk about this debate. Because Andrew Wilson agreed to debate a single point. Is the case against Tyler Robinson overwhelming? Now, overwhelming is not injurious. It's an Utah law. Overwhelming is not required. You don't have to be overwhelmed. You just have to be convinced beyond a reasonable doubt. But that's the language they're using. The case is overwhelming. That's the language Smokeboy has used. That's the language TPSA insiders have used. That's the language influential people, influential people, influencers have used. That this case is, in fact, overwhelming. So what does overwhelming mean? Well, I'm going to get to that in a second. I want to clear up this earpiece drama first. Yes, Smokeboy was wearing an earpiece. So was Candace. So was Patrick Bet-David. And I would argue, so has every person who's ever entered her studio. I know when I was there, I wore the exact same earpiece. They clean it, obviously, I hope, before between people. But it's a way you communicate with the production booth. It's not a way that people are sneaking answers to people or anything like that. It's all on the same channel. And so if the production booth says, "Hey, we're going to a break in two minutes," you know I got to wrap up in two minutes, and then we got to go to a break. If the production booth comes in and says, "Hey, we're going to play a clip," that's how you're going to hear the clip. See, I have these in-ear monitors. That's how I hear clips. I don't have a producer talking to me, but I do have Daisy on the back end that talks to me. And I can hear her through these earpieces. They can hear Candace, Smokeboy, and PBD all could hear the production studio and the clips through those earpieces. So I don't, I want to give, I want to, I want to exonerate Smokeboy. Yeah. I want to exonerate Smokeboy on this. I don't think he was cheating through the earpiece, but I do think he was wearing an earpiece. I think it's obvious. I think everyone who's ever been in her studio has worn a same or similar earpiece, and it's just a way that you can hear the clips and hear the production studio. And because they're all coming out on the same channel, if Candace hears it, Smokeboy hears it. If Smokeboy hears it, Candace hears it. That's just the nature of the way her studio is wired. So I hope that clarifies everything. I know there was a lot of debate on Twitter that he was cheating or he was getting fed answers or she was getting fed answers. I'd put that to rest and say absolutely not. I don't think either of them, frankly, would reduce themselves to that sort of nonsense. But, you know, is what it is, is what it is. All right, let me go. The only way I know how to do this is to just play a little bit of this open because the debate really was over before it started. Debate was over before it started. I'll explain what I mean by that in just a second, but I got to just kind of play it in its total. I'm going to play it at a faster speed. Because I don't want to be here all night and I'm going to play several clips. And so bear with me. I'm going to do it at one and a quarter speed at first. If that still feels too slow, we'll bump it up to one and a half. But I want to play this. It's about a three-minute clip, but it's the opening. It's the opening. And I'll pause it a couple of times. I don't want to show that one. I don't want to show that one either. Here we go. This will give you an idea of what they agreed to debate. PBD outlines it. He is the moderator. And when you agree to a moderator, what the moderator says goes. And if the moderator says, here's what you have to prove, if you have a problem with it, that's the time to take it up. You don't just ignore it and change the nature of the debate. So let's go through this and hear what is it that PBD wanted to accomplish. Are we live? Okay, so we're officially live. Candice, Andrew, you know, good to sit down here with you, talking to you guys about the conversation that I think started with you being on Joe Rogan when you said, hey, I'm offering $300,000. And for the audience watching this, you have to know when you see this, final product, there's a lot of stuff that happens behind closed doors. There was still communication until midnight, even some of the stuff this morning. Like, it's like you're trying to sell a company. It's the last 24 hours that the deal doesn't work out. But kudos to the both of you guys that you made it work. I hope at some point we hear from Candice on what was taking place in the last 24 hours. This should not have been a difficult discussion. You agree, Smokeboy, to come in and say why the evidence is overwhelming. I will challenge that because I don't believe the evidence is overwhelming. If you want me to defend my claims, I'll be. I'll be happy to answer any questions you have. Pay me $300,000 that you promised you'd pay me and go away. Oh, you want to put a minimum time limit? That's fine. We'll put a minimum time limit. Go away. I don't understand what they could have possibly been doing in these last hours. I hope at some point we hear directly from Candice on what that was. The topic of discussion today, how this got prompted is, Andrew, you said there's overwhelming evidence that Tyler Robinson shot and killed Charlie Kirk. And Candice, your position was he's a patsy. Tyler Robinson. Tyler Robinson is a patsy. So, of course, we'll talk about a lot of different things, but that's kind of how the whole thing got started. He just outlined it. He just outlined it. You say it's overwhelming. You say he's a patsy. Those are the decisions. Those are the claims you guys have to defend. You say it's overwhelming evidence Tyler Robinson shot and killed Charlie Kirk. The way they agreed to do it is there was going to be an hour and a half that Smokeboy was going to present the case that Tyler Robinson shot and killed Charlie Kirk and the evidence was overwhelming. And then they would pivot. Then they would pivot. And when they pivoted, they would say that for the next hour and a half, Candice has to prove the case that Tyler Robinson's a patsy. So it's a two-part deal. So anybody that you see on X that's out there saying Candice didn't prove her case. Hey, it was a two-part deal. Candice didn't bring any receipts. She didn't have any evidence he's a patsy. It's a two-part deal. That means they're ignoring the fact that Smokeboy did not present evidence that the case was overwhelming. In fact, he's going to concede here very soon started for the audience watching. I think this is a truly for three different people. Number one is anybody out there that loves Charlie respects Charlie his legacy what he did. We have a lot of love and admiration for what he did. He changed the lives of many people young men young women. You work with them for many years. You guys were friends. You've said a lot of good things about Charlie respectful towards him. You guys may have disagreed on something. We got a lot of respect for him the second audience. So that first audience is key. Why are we still talking about this 11 months and so many days later coming up on one year? Because Charlie Kirk had a profound effect on American culture. Not just not just political culture but religious culture youth culture the the political dialogue debate Charlie Kirk wrote 16 best-selling books. He had a number one podcast in America. He would go on college campuses and take questions from anybody who signed up and stood in line and he would say if you disagree with me you go to the front of the line now granted there were a lot of things Charlie said I disagreed with a lot. He started coming around more to my position towards the end of his life that might be why he's no longer with us but he and I agreed on a lot also there were a lot of things he said that I did agree with and so that's why we're here and I don't want that to get lost Jimmy people been murdered since Charlie Kirk was murdered what 11 and a half months ago probably 10,000 or more we're not having 11 and a half months of investigation of them it's not that their lives were irrelevant it's not that their lives were irrelevant it's not that their lives were irrelevant. Everybody that goes on a podcast, everybody that goes to, you know, these online X spaces to debate, everybody who gets on X and argues with each other, everybody who argues at the water cooler at work, it's always about that. Oh, the evidence is overwhelming. DNA on the rifle, DNA on the screwdriver, DNA on the towel. His rifle was there. He was there. His car was in the parking garage. He's on camera. Overwhelming evidence. I expected to at least be whelmed. Let's hear how smoke boy takes the microphone. Put in comments. Sure. And what I mean by overwhelming is I just find it very convincing. Womp, womp, womp. What I mean by overwhelming PBD is I personally think he did it. That's what I mean by overwhelming. I'm convinced. I'm convinced. And because I'm convinced everyone else by. Osmosis who sees my smoke rising around my cheeks on my podcast or smells the Marlboro ashtray as I leave comments on X. Let me redefine overwhelming for you, PBD. It doesn't mean overwhelming. It just means I personally am sort of convinced. That's I think that's what most people mean when they say overwhelming evidence. That's not at all what most people mean when they say overwhelming evidence. So he's basically quit. Now, granted. He hasn't officially quit yet. He hasn't officially quit. He could still recover his opening statement. He could come in and recover his opening statement that for some reason he reads off his cell phone. I don't have a massive problem with him reading off his cell phone, but it's not very convincing. It's not very convincing. I mean, you could get chat GPT to draft up something for you to read off your cell phone. You could get Blake Sneff to draft up something for you to read off your cell phone. You could get Blake Sneff to draft up something for you to read off you to read off your cell phone. I would rather you say, guys, this is open and shut case. I mean, Officer Tater Tot wasn't reading off his cell phone when he said it was an open and shut case. And he held up a 30-06 round next to a microphone and said, it doesn't fit. It doesn't fit. It's overwhelming. It's convincing. It doesn't fit. Benny likes Johnson. He was not reading from his cell phone when he walked out of the courtroom and talked, about the overwhelming evidence. And he just listed off all the things that he saw that, at least to him, made the case that it was overwhelming. And then we got Smokeboy. Smokeboy walked into the biggest stage he's ever been on. We're at 4.2 million and counting have tuned into Candace Owens' podcast. I don't know how many have tuned into PBD's version. How many have tuned into Smokeboy's version? How many people, I mean, frankly, how many people? Ripped it off and played it on their own platform in live, in real time. It's a once-in-a-generation thing. Super Bowl wouldn't put up with that, but they didn't seem to take any measure to try to stop that. But I mean, we're looking at millions of people who've seen this. It'll probably be 10, maybe 20 million people by the time this runs its course over the next couple of weeks. And he sat there and looked down, reading the entire time. He didn't do anything at all. He didn't do anything at all to support his claim. I just want to play a little bit of his opening here. Just a little tiny bit. Just give you an idea where he's headed. So I have a brief opening statement. On September 10th, 2025, Charlie Kirk was murdered. Not in dispute. Waste of time. Many of you already know a lot about the events which occurred after Kirk's death. Don't need you to tell me what I know. Waste of time. You remember the ghoulish laughter, celebrations, and madness we saw from leftists all over? Irrelevant to the claim that the evidence is overwhelming. Don't need to hear it. From TikTok invasion. Debates, posts on social media, destruction of memorials, and things like this. Within weeks of Kirk's death, a cottage industry began to form, peddling various alternative theories on how he died. Irrelevant to the claim that it's overwhelming. What special interests may have killed him, what nations were involved, and was our own government one of them? That goes to whether Tyler Robinson was a patsy, and that is Candace's claim to defend. It's irrelevant to the claim that the evidence is overwhelming. Waste of time. Because this was the first time we saw him. Because this was the first nationwide traumatic event in Gen Z's lifetime. The demand for answers was severe and palpable. Overwhelming evidence is your claim, Andrew. I'm waiting with bated breath. The leading theory from the conspiracy verse is that Israel worked with the United States government to murder Charlie Kirk. Thank you, smoke boy, for wasting my time. Within a day or two of Kirk's death, Ian Carroll claimed that Israel killed Charlie Kirk. Again, the evidence is overwhelming. I mean, he took the shot. The shot he took impacted Charlie Kirk. That impact caused the death of Charlie Kirk, and Charlie Kirk is dead. Those are your elements to crime. Those are your elements to the crime. This is all irrelevant. Ian Carroll's 48 hour later tweet has nothing to do with whether Tyler Robinson killed it or whether the evidence is overwhelming. Waste of time. Thank you, smoke boy. And the conspiracy caught on like wildfire. This theory was built on one misleading piece of evidence that in his final days on around September 8th, Charlie sent a text message reading Jewish donors play into all the stereotypes. I cannot and will not be bullied like this, leaving me no choice but to leave the pro-Israel cause. Nothing to do with whether the evidence against Tyler Robinson is overwhelming. Smoke boy, you are crapping your pants live with PBD and Candace there to smell it. This was sent in the context of a platforming dispute regarding Tucker Carlson. Irrelevant why it was sent has nothing to do with whether or not Tyler Robinson planned and executed Charlie Kirk. From this scintilla of misleading information, it was speculated that Israel killed Charlie Kirk because he would have successfully opposed the Iranian war. Has nothing to do with whether Tyler Robinson killed Charlie Kirk. Thank you for wasting now. What are we about a minute and a half of our time? Now that's a fun theory. Then who doesn't like a good fun conspiracy theory? I like them, but there is no evidence that Israel actually killed Charlie Kirk. Agreed. It doesn't matter. It doesn't matter. I don't want to say agreed for the purpose of this argument. It doesn't matter. Israel doesn't have to have killed Charlie Kirk in order for the evidence to be overwhelming against Tyler Robinson. And Israel doesn't have to have killed Charlie Kirk in order for Tyler Robinson to be a patsy. So it's irrelevant to this discussion, at least the claim that you're supposed to be defending Mr. Smoke Boy. Have you completely abandoned your claim? Did you come in and admit defeat before the debate started? It's starting to sound like it. And if Candace has some, I'd like her to actually show it to me. I'm open to suggestions, but to date there hasn't been any. There is, however, tons of evidence that a leftist killed Charlie Kirk. Okay. A leftist. Kind of maybe meandering towards your claim that Tyler Robinson planned and executed Charlie Kirk? Charlie feared they would. I believe Charlie Kirk and I have the receipts. No, I didn't have a dream where he came to me and told me that the left killed him. No, he didn't come to me a dream and say, "Candace Owens betrayed him." That never happened. In fact, I don't need dreams of any kind because I hold my possession never before seeing messages from Charlie Kirk. Oh, are these never before messages going to see Tyler? Are they going to say, "Tyler Robinson planned and executed me"? Is that what we're going to see? Come on, smoke boy, show them to me. I'd like to see this text. security team on September 9th, 2025. I'm going to share the message with you today, which is the first time this information has ever been publicly revealed. On September 9th, Charlie's security team wrote to him, "Yes, law enforcement has been fully supportive and agreed to a security plan and posture. Tomorrow's event will be covered by both my team and the campus PD. If additional support is required, patrol units will be available. I have 11 on site." Okay, great. Remind them that they are there for one person's security only. Because I'm somewhat worried the left is trying to kill me. That was. I think that was supposed to be some sort of mic drop moment, but again, put it in the context of what he's trying to prove. He's trying to prove Tyler Robinson planned and executed Charlie Kirk. Even if you accept that this text is real, I don't. I frankly don't. But even if you accept this text is real, if you believe he's reading an actual text message, Charlie Kirk says, "There are literally tens of millions of people who could be considered on the left." Literally tens of millions. Maybe a hundred million or more people that you could say are on the left. It is difficult to imagine that Charlie Kirk was. that this in any way aids the investigation into Tyler Robinson. That Tyler Robinson planned and executed Charlie Kirk and the evidence is overwhelming. So while I don't believe that that's a real text, I think we have context clues that it is in fact not a real text. I think this is where he was calling Erica Kirk a retard and a liar. Because that's what she would have to be in order for this text to be real. We'll talk about that in a little bit. But I don't. I don't think it adds one even hair's width of support to the claim that he's trying to defend. A message sent September 9th. What does he have meant by that? Well, I think he meant exactly what he said. That he was worried the left was going to try to kill him. Now we'll discuss this more later on in the debate. And maybe I have more never-before-seen evidence that exposes just how wrong and, in my opinion, idiotic many of these conspiracy theories have been. I'll say this. He provided no additional never-before-seen evidence, despite saying he might. He also did not show the text, despite saying he would. And I think there's a reason he didn't show it. He doesn't have it. Because it's not real. But if you. Let's accept it's real. Let's accept it. that it's real for a second let's do a thought experiment let's assume this is a real text why have they sat on it for 11 and a half months why they sat on it for 11 and a half months knowing that there's a text floating around out there saying from harrison smith saying that i think israel will kill me if i if i turn my back on them israel will kill me if i turn my back on them so this would be a nice counter to that he wasn't actually worried about that at all that might have been in august but in september he was only worried about the left here's the text and the text from the very same day saying you've left me no choice but to leave the pro israel cause if this is a real text if this is a real thing i see my camera's it's like 200 degrees here i see the camera's hot and freezing just ignore it it'll go away i hope um but this is this is if this is a real text and we accept that it's real why have they sat on it this long well strategically what a disaster that would have been they've allowed all these conspiracy theories to exist when they've had this bulletproof evidence that it was the left no that doesn't make any sense why would they want to do that um it makes them out to be liars it makes erica kirk out to be a liar she said that there were no texts charlie absolutely did not send texts to anyone saying that he feared for his life on september 9th and she would know she has the text we'll show that clip in a little bit but they also could have just shut everyone up and said no this was his concern but they chose not to do that why well i don't know other than the fact that they have the worst public relations in the history of mankind that andrew colvette is the worst pr person that has ever lived i mean that's just my opinion but that's what happens when you rely on what's called the evidence of the gaps in other words they don't have evidence they seem to just make up evidence and what did they make up well in my opinion kind of whatever line the pockets and i think it's ghoulish to profit off of the death of a good man he crowdfunded money for himself he crowdfunded money for himself i think it's ghoulish to profit off the death of a good man he literally sent a give send go link and advertised it like 300 times on x and so if if anyone's ghoulish if you believe that makes you good you're the most ghoulish because you're the one who's identified the ghoulishness of it but we came here today to debate and so let's get we did come to debate we came to debate that the evidence was overwhelming you've said nothing about it except charlie may have sent a text the night before saying some leftist might come after him to it the debate topic today is one my belief that there's overwhelming evidence that tyler robinson killed charlie kirk and two candace's belief that there's overwhelming evidence that tyler robinson was a patsy and didn't kill charlie kirk in some the audience is going to decide who has more evidence supporting their theory my theory is that the state is correct that tyler robinson is the killer at least based on evidence so far in kansas's theory that tyler robinson is not the killer and he's a patsy set up by the feds to be clear this is not a question of reasonable doubt if it was reasonable doubt and that's all it was and that's all candace was proffering i wouldn't even be here having the debate with her it's fair to have doubts as a trial has yet to occur it's fair to have doubts he's telling us the evidence is overwhelming and then in this next breath he's like but if you want to have doubts that's fine that's fine it's fair to have doubts it's fair to have doubts and the state hasn't even begun to try to prove their case beyond a reasonable doubt but candid so if the state hasn't begun and it's fair to have doubts meaning there's not enough evidence from which to conclude that the the evidence is overwhelming then why are we having a debate about it you guys remember when there were people in my comments saying you should debate andrew wilson i was like debate what there's nothing to debate yet there's nothing to debate all we've seen is a probable cause affidavit and and now we've seen the preliminary hearing evidence i mean all you can do is come in and read from it and all i can do is say i think it's bs so why are we debating that it's overwhelming you just admitted it's fair to have doubts and we don't know yet because the state hasn't shown us the evidence this makes a more forceful claim she claims that there's more evidence that tyler is not guilty of murder and was set up as a patsy than there is for the state's case and i just think that that's absurd and she will not be able to demonstrate that in any way in fact she has almost no real evidence at all of her theory whereas my theory is supported by compelling witness testimony physical evidence multiple confessions all of which are independently compelling but which are even more convincing as each piece of evidence corroborates the others you'll notice the term overwhelming was included in both theories this is because candace demanded i defend my use of that term which i think is fair in describing the evidence against tyler robinson she on the other hand only wanted to defend her theory as merely viable that is until i showed her clips in which she said she believed the evidence of her theory that tyler robinson's patsy was supported by overwhelming evidence only then did she agree to defend that position regardless we're both defending the claim there's overwhelming evidence on our side of the table and i think it's a good thing that we're both defending the claim so it's worth defining that term when i say the evidence against robinson's overwhelming all i'm saying is that i mean that as of right now i find it very convincing okay so that's that's a cool debate trick i guess take the take the claim and redefine it so that you can't possibly lose the evidence is overwhelming and by that i mean i'm convinced well how are we going to prove you're not convinced how could candace walk in and prove you're not convinced you the only Her grasp of information is astonishing. It's astonishing. You will never be able to quote her out of context because she has a memory that is basically unparalleled. I've never encountered anything like it. I think it's probably not her memory alone, but her memory, charisma, presentation. But the memory helps. I've never encountered someone like this before. I knew it the first time I talked to her on the phone. I knew it the first time I sat down with her in person. And I've been fortunate enough to have spent quite a bit of time with her over the last year or last six months. And I've been around a lot of really smart people. I've never encountered anyone like her. And you saw a little bit of it on display. We pulled out a wooden drawer and that wooden drawer had a long card catalog and it had a bunch of books, titles, authors, whatever. And it had a Dewey Decimal system on there. I don't know how all that worked, but I know when I needed a book, I knew where to go look for it. And you would, like, go in order and you would find it, flip, flip, flip. Oh, here we go. Boom, got it. And then you would take your card catalog and you would know where to go in the library to find the book. That's how our brain works. I'm serious. I've sat in awe and watched it. I'll mention something just offhanded and you'll see her go, okay, so here's what that means. How do you know that? How do you know what it means? And then she'll give you, like, a nine-minute exposition on why it means that because it fits in all this other evidence she's collected that she holds right in front of her brain. This is not a show, and this is why I didn't put it in the notes. I didn't come on here to just fawn all over. But it is impressive. And even her deepest critics, Ben Shapiro, Jeremy Boring, and others who have worked with her closely, will say, I don't like her politics, I don't like her demeanor, but I've never worked with someone as impressive. Like, she's the real deal. She's an absolute A-plus when it comes to broadcasting talent and brilliance. I mean, it's just, it's undeniable. And so I think Smokeboy went in there thinking that he would be able to pull fast ones. I don't know who helped him prep, but they obviously didn't know her. And that they would be able to pull these fast ones on her, it didn't work. It didn't work at all. And she saw right through it. I was so proud. It was like, it was like, I don't have a little sister. My sister's older than I am, but it was like a little sister winning the state championship in swimming or something. I mean, just like you just well with pride. You see all that work come to the surface in one moment. And there's all this pressure. And they didn't buckle. And they rose to the occasion. And they did it with a smile. And they held their head high. It's what it felt like. Like, I was beaming with pride watching this. I was high-fiving in the air like, yes! I haven't felt that way. In a debate, since the 2016 debate, when Donald Trump told Hillary Clinton, "Because you'd be in jail," it was a raw moment. Mrs. Coleman and I were watching that live. I remember what house we were in at the time. And we both stood up and high-fived and were like, "Yeah!" I mean, it was a crazy moment. We'd never seen anything like it in presidential politics. It was a plain-spoken moment. It wasn't rehearsed. It was top of mind. He obviously believed it. But that's how I kept feeling over and over during this debate with Smokeboy. No more fawning, Candace. That's all you get. That's all you get. But let me go to the question. Because now we've seen that his entire opening statement was just him trying to redefine the nature of the debate in a way that he couldn't lose. He lost anyway. PBD saw right through it. Candace gives her opening. And PBD's like, "No, I'm not going to let you weasel out of this. You've got to give me a number. You're not going to do this. It's convincing to me business." Just out of curiosity, are you, between zero to a hundred, what is the likelihood that you think Tyler Robinson shot Charlie Kirk and killed him? This is the way PBD's mind works. He's a numbers guy. He's a numbers guy. He sells, he buys and sells things. He markets. He does not want to do this. It's convincing to me business. And that's, if I say it's convincing to me, then I win. No, no, no friends. Give me a number. Scale of one to a hundred. Where are we? Here's the only thing I would have told Smokeboy if, if, if I had helped him prepare. And I've said this before, when you go into an oral argument or you go in to defend a position in front of a court, I always take, I don't have one in front of me, but I always take one of those legal pads and I write at the top, the position at which I cannot retreat or I will lose. Even if I look stupid, even if the judge threatens to hold me in contempt, even it, but, but if I can see this position, my guy loses and he paid me and he put his trust in me and I let him down, my position. Here would have been overwhelming evidence, 99% or higher, 98%, maybe. You can't concede beyond that. Or you've already lost. You you've what you're wasting your time. You wasted the money of whoever's donated to you or whoever helped you pay this $300,000 fee. You have to say this, he's asking you a question. What percentage would you put it at anything, anything lower than 98%, you've lost, you've lost. And so what does he say? What's his answer? Based on the evidence right now, um, I don't know. I'd say 75, 85%. That's the end of the debate. Good night. He just conceded defeat. The call of the debate was the evidence is overwhelming. He redefined that to, I am convinced I find it convincing. How convinced? Yeah. Three quarters. Maybe 85%. Now I am not a gambling man, but that's, those aren't great odds. Those aren't great odds. Um, would smoke boy right now? I doubt it. Agree to the penalty. That's going to be assigned to Tyler Robinson based on a roulette wheel. That's stacked up to 85% or 75% even let's call three quarters. Let's call it 80%. Four out of five. Let's say he said 75 to 85. Let's be fair. 80%. Four out of five. In other words, you're playing Russian roulette with a five round revolver and four of them are empty. Would you play that game? This is important because allegedly Charlie, Kirk was struck with a projectile that took his life. The nature of that projectile is important. Ladies and gentlemen, it matters. It matters. It matters because if, if it's impossible or if it can't be recreated, that that projectile stays inside Charlie Kirk's neck yet takes his life. Then we have a problem on our hands. Reproducibility is science. Science is reproducibility. So let's hear what smoke boy has to say about this compelling evidence about the bullet. There's some steel neck and it's a smaller caliber. You have to make it. You have to make it. You have to counter explanation. Why wouldn't a smaller caliber also go through bone? It could. I didn't say it can't. Right. Exactly. So. Okay. So what he's saying there is I am defending the position as a 30 out six. Well, let's say it was a two, two, three round or say it was a nine millimeter. Let's say it was a 17 caliber. Why couldn't those go through irrelevant? And that's, I think she did a great job. I don't care. It has nothing to do with your claim smoke boy. That's just a small jacket that goes around the actual lead piece. These did this thing could have split apart in air for all we know. This, this thing could have been a split apart in air for all we know. Do you, do you, do you have any evidence that that's ever happened? That a, that around like this has ever just split apart in air for all we know, this is a thing to you. This, this is your, this is your area of expertise. Smoke boy. You're supposedly the army sniper. You're supposedly the, the, the gun expert. You incorrectly identify that it's frangible round. You've said the shell around the lead is, is in fact thin and that for all we know, it's split apart in there. Um, I've been following this case closely. I've been following this case very closely. I've not heard a single gun expert suggest that the ammunition used to take down Charlie Kirk could have split apart in there, nor have I seen it demonstrated. I've never heard of it happening. I, in fact, you probably aren't going to find a lot of evidence that it doesn't happen because it's just, it's like, again, it's like if I drop quarters and they're going to fall down on the ground, right? I take this deck of card. It took me like three minutes to open. I drop it. It hits the ground. Probably not going to find a lot of evidence that if I drop it, it goes to the ceiling because it doesn't go to the ceiling. It doesn't go to the ceiling. That's not what happens with ammunition like this. It doesn't just break apart in midair for all we know, not his finest moment. Ladies and gentlemen, the smoke boy is scrambling. That's the moment when I heard him say that I thought, all right, it's over. It's just over. Just over. Uh, we do have a little fact check on this, but I'm going to let it play for another 10 seconds or so, but definitely upon impact. And we have the medical examiner who confirms this in a summary. And my team can bring that up the summarization, which means he would have to be a part of some kind of conspiracy as well. Okay. Okay. Um, you're talking about the medical examiner who's married to a furry that, that medical examiner that, that has now gotten out of town. And taking a promotion that he's now the director at another facility or another County that, that medical examiner you're talking about that, that he might, that he might've been in. Okay. Okay. Well, I'm not here to talk about the medical examiner. Uh, we do have a little bit of fact check though. Um, we have no evidence that anything he just said is true. We have evidence that what he said is not true actually. Uh, here is the summary ATF revealed the bullet that killed Mr. Kirk was a 30 caliber. class round. It created a complex entrance gunshot wound and fragmented in Mr. Kirk's neck. There's no evidence that the round that struck Kirk was the brand or type he described not the grain, not the, not the Remington, not the core lock, nothing, just a 30 caliber class round. That's all we have in the medical examiner's report or the, uh, ATF report. That's it. That's it. And so if you want to make up that it is frangible, certainly you're right. I guess you can make up that it's frangible. Did not mean to hit play. Uh, you can make up that it's frangible. That's fine. It was not. And there's no evidence, no discussion whatsoever that there's, um, that is frangible. Uh, we also have agent Falmina that testified that it was one 30 caliber class, deformed, damaged bullet jacket, fragment, and four lead fragments. Again, nothing about Remington, nothing about lock tip core soft point. Nothing. I just, none of that. None of that. Uh, we have Samantha Carner who testified that no further testing was able to be done to determine the specific round. So where he's getting this idea that he knows the brand, the grain, the type of the tip, the type of cover. We have no evidence on that. This is supposed to be the guy that's demanding that Candace has all the evidence. And this is kind of what happens here. This is the whole nature of this debate. Candace is not allowed to use any hearsay testimony, at all. He requires what he calls positive evidence. You have positive evidence that the Israelis killed him. Do you have positive evidence? The French foreign Legion was after you. Do you have positive evidence of that? He was at the steakhouse. Do you have positive evidence of the receipt, but all the evidence he used, he either made up like what we just saw, just made it up out of whole cloth, or he took the word of the people who were reading statements in court, just hearsay evidence. That's the definition of hearsay evidence. It's an out-of-court statement provided in court for the truth of the matter asserted. He's relying on that hearsay, but he's refusing to accept eyewitness testimony from her. We'll get to that in a minute. I want to go to her closing real quick. I'm going to go back to some of the other stuff. Let me fast forward to here. We're going to jump forward about an hour. I told you I'm not going to go through every line of this debate. I don't find value in going through every line of the debate. But I to go through this one because this is a good summary of why we don't believe the feds love it's a nice little summary candace provides of why we don't believe the feds love i just doubt the state's theory okay yeah i mean sure those are the things that i do doubt the state's theory i also am welcome to say what i think you know if you want to move into opinions if you want to talk about erica kirk if you want to talk about turning point usa like to talk about all and get into it i'm totally happy to do that but i just want to say that like i do not feel because i've said what's important to me is that we exhaust this topic first of our actual debate claims i do not feel that you sufficiently have argued that the evidence is overwhelming in fact not only has he not argued the preliminary hearing actually the almost the inverse of what he was saying is true right so the this is now the time the state is putting on their evidence that's the purpose of this hearing right the state is using hearsay but they're also putting on their evidence so i was just expecting some sort of a slam dunk like we got him on camera taking the shot we at least we have them clear on camera you're telling me this guy drove 13 hours all around like we can definitely show you a picture that it's going to be beyond a reasonable doubt before we even get to the trial people are going to see and go oh crap like it was really tyler robinson um i'll be let me pause it here i i kind of half expected that now i'd looked at the evidence list and i did not see or the witness list i did not see tyler robinson's parents and it shocked me i'm i did a show on it um i was a little shocked that they didn't have tyler robinson's parents on the witness list but you're not convincing that would have been to me i mean i've sat here for 11 and a half months that i think tyler robinson didn't do this and i can't see how he would have but if you'd had his mom on the stand and his mom would have said he told me he did it told me he pulled the trigger killed charlie kirk that's why we helped turn him why we helped turn him in now he may have been lying to us i don't know but that's what he told me i mean i'd have had to walk away and go well guys it's been fun but i think we're barking up the wrong tree here i don't think we're right i we're gonna have to rethink this we're gonna have to look for a lot better evidence if we're gonna say he's a patsy because he told his mom he did it he told his daddy did it can you imagine dad getting up there what dad's gonna get up there and testify against his son yep that's what he told me told me he did it told me he killed charlie kirk that's why we arranged with the bishop and a former friend of our friend of our friend of our friend of ours yes and the court reporter makes you raise your right hand and you have to swear yourself you get sworn in yes and then the lawyers take turns asking questions in other words we could have just popped And the fact that there are people betting against Tyler Robinson get convicted, those people have a pecuniary interest in Tyler Robinson not making it to trial. And so I I worry about Tyler Robinson. I've always worried about Tyler Robinson, and I think this is evidence that that worry is. Is now backed by money. That people could make a handsome profit if something happened to him. I don't like that. I don't think that should be the case. I hope if we dug into it and I have not. I hope if you open this up, it says basically the contract gets canceled if he if he something happens to him. That everybody gets their money back and no one no one walks away a loser. I hope something like that happens because if they're putting a price on Tyler not making it to trial, that's a problem. That's I have a moral issue with that. Now, who are the winners and losers? Candace is a winner. No doubt. No doubt Candace walked away a winner. She walked away a winner on every claim on every count. You can say all you want smoke boy that she doesn't have any evidence. Derelevant she's allowed to have an opinion and her opinion is backed by evidence that she's receiving. It's backed by circumstantial evidence of things that are happening around. So I think Candace is a winner. PBD, believe it or not, I had very low expectations for PBD. I thought PBD would would really show up and not do a good job. good job moderating this debate. I thought he would put his thumb on the scale for Smoke Boy and really try to be unfair like sometimes you see in presidential contests that the moderator will take a side and start fact-checking in real time and all that. He didn't do that. I thought his follow-up questions were fair. I thought they were at times difficult for both of them and at least helped flesh out some of the ideas they were struggling with. And so I think we came out winners. Who came out losers? I think Tyler Robinson came out a winner, to be honest with you. I think the debate proved that the people are right to continue asking questions. Now, who came out a loser? Obviously, Smokeboy. His reputation is in shatters. They can, in tatters. But the other losers are the influencers who walked out of the courtroom saying the case was overwhelming. Will you ever believe anything Officer Tater Tot ever says again? No wonder TPSA refused to publicly claim their boy. PBD looked stunned by Andrew's lack of professionalism. I would say it's more than just professionalism. Lack of professionalism. It's a lack of preparation. Well, maybe that's professionalism. Professionals are prepared. She was prepared. I was surprised that smoke boy said he watched the preliminary with a lawyer. And yet he still argued that during the preliminary, it was when the defense should have brought their evidence. Maybe he should listen to our humble host. Yeah. Let me clear that up real quick. And I know it's late and, and, uh, but I want to clear this up. So we, we talked about the standard in the preliminary hearing that if the, and I think I did a whole opening on this or if not, I did a segment on it. If the prosecution prevents presents evidence and the D and the defense produces contradictory evidence, right? The judge is not permitted to consider this. He just must. The only thing he's allowed to consider is. This evidence, is it credible? Is it reliable? If it is, he has to consider it. What, what they've done here. This is called weighing. You use that for the jury, not for the judge at the preliminary stage. This is trial court stuff. And so this idea that, well, why didn't they produce this? Why didn't they produce that? But because the prosecution had already produced this. And so all this is going to do is get ignored. So why produce it? That doesn't make it. I mean, it's just people that don't understand how this stuff works. Trying to comment is if they do, and it doesn't make sense. What part of Indiana are you from? I grew up in Martinsville, but now live in Australia. Um, I was born outside of Indianapolis, 20 minutes or so outside of Indianapolis and, uh, lived there till I was eight years old, eight years old. And then I went back to Indiana for law school. I was in Bloomington. Uh, do you think Tyler or whoever's job was to shoot inside the back of the van to create the sound? What role do you think Rick? Cutler played? Uh, I'm not going to answer that last one. Cause I'm not prepared to talk about that right now. The first one. I don't think anyone shot inside the back of the van. Then they come out and they're starting to drop. Evidence that they've supposedly been sitting on. Why have you been sitting on evidence? Do you not want to know who killed Charlie Kirk, how and why? Do you not want the people investigating this to have all the information in front of them? You say we shouldn't be investigating it, but then you're holding back from us evidence that you think should make our investigation pointless? Well, if you don't want us investigating it, drop everything. Let us know everything you have. Maybe it'll change my mind. Maybe I'll stop covering this case. So it's a hard week. It's a hard week. I could not be more proud of Candace. I could not be if I had to be. I think she did a fantastic job. And I think she deserves all the praise she's getting. Genuinely, genuinely do.
