Speaker 2Sem citar episódios específicos, Fachin ressaltou que divergências jurídicas são legítimas, mas não podem virar confrontos pessoais. O presidente reforçou que o julgamento analisa fatos e questões jurídicas, não pessoas, e lembrou que a decisão final cabe ao plenário e precisa ser respeitada mesmo quando não houver convergência entre os colegas. Na sequência da abertura, o ministro Cássio Nunes Marques se declarou impedido de votar. Ele afirmou que precisa assegurar o equilíbrio nas eleições de 2026 e que o julgamento pode impactar o processo. O ministro comentou as mensagens em que o filho é citado, comensou a um valor de 500 mil reais, que eu citei há pouco, e negou qualquer irregularidade. E depois ele deixou o plenário do STF. Outro integrante do tribunal que se afastou foi o ministro Dias Toffoli, que se declarou suspeito por motivo de foro íntimo. Toffoli, lembramos, era o relator original das apurações sobre o Banco Master no Supremo, mas deixou a relatoria em fevereiro, depois que as investigações da Polícia Federal apontaram ligações dele com o Master. Na ocasião, o caso passou então para as mãos do ministro André Mendonça. Toffoli avisou que não vai votar, mas decidiu continuar no plenário, para se manifestar nos debates, caso achasse necessário. Logo no início, os ministros Gilmar Mendes e Flávio Dino questionaram a decisão do presidente do STF, Edson Fachin, de assumir a relatoria do processo sobre as mensagens entre Daniel Vorcaro e ministro Alexandre de Moraes. Gilmar Mendes sustentou que não existe previsão no regimento do Supremo para permitir que o presidente da corte tome para si a relatoria de um processo. Ele defendeu que as ações precisam ser distribuídas por sorteio entre os ministros. O ministro Fachin, que é o presidente do STF, disse que Flávio Dino concordou com o decano e disse que aceitar essa mudança pode abrir espaço para o autoritarismo nos tribunais. Dino declarou que André Mendonça é o relator natural do caso e destacou que, mesmo discordando da condução do colega em outros processos, a ação não pode ser retirada dele. Dino encaminhou um ofício a Gilmar Mendes, que apresentou formalmente uma questão de ordem no plenário, pedindo a redistribuição da relatoria. E Flávio Dino pediu o adiamento do julgamento para o dia 23 de setembro, na mesma sessão marcada, para debater a conduta do ministro André Mendonça. Em resposta aos questionamentos, o presidente Edson Fachin afirmou que não tomou a relatoria para si. Segundo Fachin, o próprio relator André Mendonça é quem enviou o caso para ele. E depois de receber o processo, Fachin orientou a Secretaria Judiciária a alterar a relatoria da petição para o nome da presidência da corte. Foi uma tentativa de Fachin de reduzir os conflitos internos no tribunal entre os grupos de Moraes e de Mendonça. E aí os ministros discutiram abertamente o afastamento do diretor-geral da Polícia Federal, André Rodrigues, determinado por André Mendonça, e apoiado pelos ministros Cássio Nunes Marques e Luiz Fux, da segunda turma. Na ocasião, Gilmar Mendes pediu vista e Flávio Dino, no dia seguinte, reverteu o afastamento de André Rodrigues. E aí, no julgamento, nessa terça, o ministro Gilmar Mendes subiu o tom e afirmou que a decisão de tirar o chefe da corporação do cargo submeteu a Polícia Federal a um vexame institucional e chamou Mendonça e os colegas da Secretaria Judiciária da segunda turma de sem noção.
Speaker 4Qualquer cidadão que tenha um mínimo de noção do que significa a Polícia Federal, que é um órgão armado, submetido à hierarquia, não faria afastamento de um diretor-geral da Polícia. Moraes e André Mendonça Moraes exigiu que a análise sobre a sua própria conduta fosse feita em conjunto com a investigação contra a postura de Mendonça. Moraes ainda acusou Mendonça de tentar incluir o próprio Moraes na delação premiada de Vorcaro.

No dia 7 de setembro, agora na Avenida Paulista, um boneco representando André Mendonça foi erguido durante um ato bolsonarista. Gilmar Mendes ainda tocou no vazamento de informações das investigações perguntando quem é o vazador-geral da República, ironizando que nos outros gabinetes não se vaza nada. Ao defender que Mendonça foi seletivo ao direcionar as investigações apenas contra Alexandre de Moraes, Gilmar Mendes ressaltou que relatórios de inteligências da PF indicam que o relacionamento de Vorcaro alcançava um número expressivo de autoridades e parentes, destacando que o caso de Cássio Nunes Marques foi o que mais chamou a atenção. Segundo Gilmar, Mendonça adotou uma postura abertamente defensiva sobre Nunes Marques, sugerindo à PF que eventuais imputações contra ele seriam estratégias para enfraquecê-lo. André Mendonça rebateu imediatamente afirmando que não tem conhecimento sobre a citação a outros ministros nem teve acesso à íntegra do celular de Daniel Vorcaro. O ministro Gilmar Mendes ainda fez menção indireta ao fato de Mendonça ser evangélico, dizendo que em nome de Deus já se fez muita patifaria e afirmou que até a máfia tem ética. Bom, a sessão foi suspensa a uma da tarde depois de todo esse bate-boca e voltou duas horas e meia depois, às três e meia da tarde. Já na volta, o ministro Edson Fachin, votou para manter os casos de Alexandre de Moraes e André Mendonça separados.
