The NTSB is investigating why this Amazon cargo jet overshot the runway in Miami by some 1300 ft. That's more than 4 football fields. And then you saw the flames shooting from an engine. It first slammed into a van with a cleaning crew of 7 on board and then into another car. It was a small Toyota SUV. 5 people were killed. 5 more injured. Looks like we have a aircraft over and around the runway. Yes sir. And you could hear the calls from the control tower via ATC.com. Plains on fire. Plains on fire. Put your game pages on. Hundreds of first responders racing to the scene straight to the cockpit to rescue the two pilots. We had a very complex fire engine compartments that were on fire including a search and rescue of the pilot and co-pilot that were trapped in this aircraft. Teams had to free one person who was trapped underneath the vehicle. We've learned from the NTSB that this was the plane's third flight of the day. There's fuel everywhere that will have to be remediated. But then they are also removing fuel from the aircraft. They have a large team on the ground now more than 30 people saying that there is debris and fuel everywhere. They also have to remove the fuel from the plane and they'll be here for at least a week. Yeah, who were the victims? We're concerned for them, but were the majority of the victims on the ground or in the air do we know? Right at the end of the news conference the NTSB chair said that the victims were inside those two vehicles that I mentioned earlier at the van and that small Toyota SUV. The recovery of victims is most important. The investigation and access to the aircraft as well as evidence can wait. Also saying that they are still in an active recovery operation and that really is their most important mission. So I guess the big question is how did this happen? And could this have been prevented somehow? Well that is the big question for the NTSB. If we are in the business of repeatedly investigating an accident or tragedy and our recommendations are not implemented, then we're here again and again. And the FAA credits it was saving nearly 500 lives the NTSB chair saying that whether that would have helped prevent this tragedy and if EMAs should be at every airport well this will all be part of the investigation. Yeah really interesting because you're so used to thinking about airplane crashes happening on touchdown this very different situation and still several people dead. Victor Okendo, thank you so much. Was it a stink possibility in the case of Lindsay Clancy? Last week, as jurors deliberated whether she killed her children out of malice or out of a devastating case of postpartum psychosis, they twice told the judge they were unable to reach a unanimous verdict. Twice, they were told to go back and keep deliberating. On Friday, they once again said they were deadlocked. This time, the judge declared a mistrial. At this point, I'm going to declare that the jury is deadlocked and I'm going to declare a mistrial. But not until after the defense had lodged on appeal, saying one of these jurors should have already been dismissed. Unfortunately, they're not holding out based on a good faith issue with the facts or with the law, but they are refusing to apply the law as you've given it. This morning, there are not only questions about the decisions here. There's also another case drawing attention and another child dead. ABC's chief investigative correspondent, Erica Turski, is with us. Aaron, a straightforward as a hung jury can be. Right, what happened here? Oh, it was not, Brad. This jury, at least according to Lindsey Clancy's attorney, Kevin Reddington, split 11 to 1 in favor of finding her not guilty by lack of criminal responsibility, by reason of insanity, because as the defense argued, her postpartum psychosis made her follow a voice in her head telling her to do the unimaginable. And the lone holdout, according to Reddington, was someone who was not applying the law that requires a defense.
defendant to be found guilty beyond a reasonable doubt. Nonetheless, after three separate deadlock notes, the judge gave the defense an hour to file an emergency appeal with Massachusetts highest court, the Supreme Judicial Court. There was a virtual hearing Lindsey Clancy was there looking on, but in the end, the Supreme Judicial Court declined to get involved, and the judge did grant the mistrial. And were they asking Aaron for this juror just to be replaced with an alternate? I guess I'm wondering, is there precedent for that where a higher court could just tell a lower court? Like, no, this guy, he's got to go. And then you can keep proceeding as usual. Was that normal? Interestingly, Brad, Reddington did not cite any case law that would establish precedent for going to the state's highest court and effectively forcing the trial judge to allow deliberations to continue or to kick off the holdout juror and replace with an alternate and start deliberations all over again, but Reddington wanted to try because he believed he was on the cusp of victory. He said, with the jury split 11 to one, that he effectively won the case, and that the holdout juror was just giving Lindsey Clancy a raw deal. Where do I begin to thank these jurors minus one? Well, this is what I was wondering, is what does this mean for Clancy? Because is there a chance prosecutors look at that 11 to one? And go, yeesh, like maybe we shouldn't bring this case again. We might just lose officially. Is there a chance they could try to read some sort of plea agreement with the defense? Because they do seem aligned on a lot of different points of the case. Those are all possibilities. The district attorney in Plymouth County, Timothy Cruz, would not make an immediate decision. But he said he did want justice for Clancy's three children. We're not sure what that's going to look like. It could be another trial for first degree murder, prosecutors could seek to retry Clancy and pursue a conviction on a lesser charge or arrange a possible plea deal. And it sounded like Reddington was open to that on behalf of his client. For now, even with the mistrial, she is not free to go. She is being held in custody without bail at a state psychiatric hospital, which for the defense is at least preferable to prison. The defense was never advocating for Lindsey Clancy to simply escape responsibility. The whole idea was to find her not guilty by reason of insanity effectively and get her more permanently into mental health treatment. And down the road, perhaps evaluate her to see whether it would ever be safe enough for her to return and live among society. Well, and the other thing looking forward here is how I do think this case has kind of spurred this broader conversation about maternal mental health. But on the other side of that, the question is going to be like where is the line? How does it get invoked? Because just this weekend there was this really terrible case and just a warning to our listeners. Like there is graphic stuff here. So if you want to skip forward a couple of minutes, that's fine. But I mean, the interesting thing about this case was police are already referencing the Lindsey Clancy case in all of this. This one in Illinois, it's the case against Corey Walsh who had, according to police, become very invested in the Lindsey Clancy trial, especially as the jury was deliberating. And she allegedly killed her two-year-old son, hanging the toddler from a basement rafter in the family home while two of her other kids were not there while her husband was out of state. A neighbor apparently found the toddler tried to revive him. The mother was upstairs in a bathtub, according to police stabbing herself, apparently trying to kill herself. And her attorney now says that she was suffering a psychotic episode at the time. And her attorney said she hopes we all will realize this heartbreak for what it is. Absolutely heart-breaking. And a good reminder probably that there are more of these cases than people might be aware of. Thank you, Brad. Labor Day weekend is always a big one for politicians. It's one of the last holiday weekends before November. You got families out about town. This is one of your last chances to shake hands and kiss babies from people who otherwise might not know about you. Which is why this weekend in Canfield, Ohio, political candidates were making the rounds at the local county fair, including the Democratic nominee for governor Amy Acton. What was unusual here, though, was a scary scene in which police said a man appeared to lunge at Acton. This was violent, it was chaotic, and authorities say they later found the man was armed with multiple weapons. ABC's Matt Rivers has been covering all this, Matt. Can you just describe how this unfolded? Yes, so this was a scary one, Brad. This happened on Sunday afternoon, as you said, the Democratic candidate in a very tight race for governor there in Ohio. Amy Acton was there addressing a crowd at the Canfield fair. There, as you know, you said, political candidates are wanting to do this time of year. So she's talking, and at some point, according to police, she's inside of a tent and a man kind of barges his way into the tent yelling, screaming. When he came in, it was kind of one of those moments where I think everybody froze. Rolling on his own cell phone, apparently, moving his way, making his way toward Amy Acton to the point where it was described as, you know, lunging toward her. In that process, he, according to police, assaults two people. Two elderly women standing right in front of Amy. And he tackled them to the ground. And then I witnessed that we spoke to you said that, you know, it was two people that were in between him and Amy Acton. They eventually get pushed to the ground. And as that happens, her security detail, which includes Ohio State Police officers, managed to subdue him. They arrest him and they take him into custody. She's okay. She's not injured. And her running mate actually says that as soon as it was over, she actually helped treat one of the people who was assaulted there because she is a physician. Right after the incident, she actually went and helped take care of one of the people who was hurt. So that's just sort of her instinct. She runs to the fire. But during the process of the arrest, Brad, officials say that they find two pistols on this guy, 38-year-old Patrick Habas, as well as a set of brass knuckles. Now, we need to be very explicit here where he made clear, the suspect made clear that he never brandished those weapons. And it appears that police are agreeing with him because there are no weapons charges against him. And that those weapons are legal to carry in the state of Ohio. But what he is eventually charged with, two counts of assault and account of disorderly conducts. So no weapons charges, but those three charges do stick. And he was arrested and booked on those three charges. But the weapons thing is what makes this so scary because it's not illegal to be angry at someone. It's not illegal to yell at a politician that happens all the time. The concern is that somebody might be trying to hurt the politician. Do they think he was, do they have an idea of what the motive would have been here? Was he trying to hurt her? Well, we know that this investigation, Brad, is still ongoing. And police haven't come out with any more indication of what his eventual motive might have been here. You would imagine if they had some clear cut sort of evidence that he intended to do her harm. They wanted to charge him with some sort of an attempted act of violence. Again, they might have done that already, but they have not yet done that. But it is scary. I mean, he has those weapons on him. Even if they are legal to carry in Ohio, given his overall behavior there. Knowing he had those weapons on him, how close he was able to get to her. You know, it doesn't take a great leap of imagination to wonder what might have happened there. Well, that's a thing because this is such a normal part of campaigning. It should be a normal part of campaigning. It's just being among regular people, not behind secret service or, you know, state patrol, whoever happens to be in charge of a given event. But if people are carrying more guns than ever, and there is more political anger than ever, we've been told this again and again. Are these sorts of confrontations, this sort of scary new normal as far as cops are concerned? Well, look, Brad, this isn't happening in a vacuum, right? I mean, think about all the political violence that we've seen in just the last couple of years. You've had multiple attempts on President Trump's life. You had the violence there at the White House Correspondence Center. You had those two Democratic lawmakers who were shot in Minnesota last year. I mean, the list goes on. This is not a one-off incident. Unfortunately, this is the kind of thing that we've seen happen before. And it could very well happen again. Now, we should come right out and say, though, that both sides have condemned this as political violence. So Amy, actor was campaigning yesterday. She talked about it. I refused to look the other way, like people didn't look the other way when I was a struggling kid in Yamstown, Ohio. And then her opponent in this race, again, a very tight race, former Republican presidential candidate Vivek Ramaswami, he came out and condemned it in no uncertain terms. Political violence has no place in America, period, full-stop. You have both sides saying, look, we should be doing this democratic process in a civil way. Both candidates agree on that. Even if the race has become vitriolic, they say that the vitriol should end with words obviously not violence. And yet the America that we live in today, I think we all need to be prepared for the possibility of more political violence, even if the vast majority of the country does not want to see that. Right. And how do you know what some of these intentions are until they actually come up, especially if it's in an environment where people are allowed to have weapons? Under a program called a gate side, people will be able to use their TSA pre-check credentials to get through security without a plane ticket. This has been an option of a couple smaller airports last year, starting now it's available at 13 airports including LAX and Dallas Fort Worth International. This is also partly a new branding exercise. Local airports aren't just selling this as a way to wait in line with your family members. Frankly, I'm cool without paying for parking, I'll drop you off at the curb, thank you. They're selling this as a way to enjoy the amenities and restaurants at the airport when you're not even flying. You don't go to malls anymore, hey come to the airport, do some shopping with us.
